(REQUEST FOR ADVISORY OPINION)

ORDER

The President of the International Court of Justice,

Having regard to Article 66, paragraph 2, of the Statute of the
Court,
Whereas, on 13July 1981,theCommittee onApplications for Reviewof
Judgements ofthe Administrative Tribunal of theUnited Nations adopted
the following decisio:

"The Committee on Applications for Review of Administrative
Tribunal Judgements has decided that there is a substantial basis
within themeaning of Article 11of the Statute of the Administrative
Tribunal for the application presented by the United States of
Amenca for review of Administrative Tribunal Judgement No. 273,
delivered at Geneva on 15 May 1981.Accordingly, the Committee
requests an advisory opinion of the International Court of Justice on
the following question

"1sthejudgement oftheUnitedNations Administrative Tribunal
in Judgement No. 273, Mortished v. the Secretary-General,war-
ranted in determining that General Assemblyresolution 34/ 165of
17December 1979could notbe givenimmediate effectin requiring,
for the payment of repatriation grants, evidence of relocation to a
country other than the country of the staff member's last duty

ORDONNANCE

Le Président de la Cour internationale de Justice,

Vu l'article 66, paragraphe 2, du Statut de la Cour,

Considérant quele 13juillet 1981le Comité desdemandes de réforma-
tion dejugements du Tribunal administratif des Nations Unies a adopté
une décision ainsi conçue

<Le Comitédes demandes de réformation de jugements du Tri-
bunal administratif a décidé que,au sens de l'article 11du statut du
Tribunal administratif, la demande de réformation des Etats-Unis
d'Amériqueconcernant lejugement no273du Tribunal administratif
rendu à Genèvele 15mai 1981reposait sur des bases sérieuses.Par
conséquent,leComitépriela Courinternationale deJustice dedonner
un avis consultatif sur la question suivante

<Dans sonjugement no273 concernant l'affaire Mortished c. le
Secrétaire générdal l'Organisation des Nations Unile Tribunal
administratifesNations Uniespouvait-illégitimement déterminer
quela résolution34/ 165de l'Assembléegénéraleednatedu 17dé-
cembre 1979, qui subordonne le paiement de la prime de rapa-
triement àla présentation de pièces attestant la réinstallation du
fonctionnaire dans un pays autre que celui de son dernier lieu

d'affectation, ne pouvait prendre immédiatement effet) Whereas certified true copies of the English and French texts of the
aforesaid decision were transrnitted to the Court by a letter from the
Secretary-General oftheUnitedNations dated 23July 1981and filedin the
Registry on 28 July 1981 ;

Whereas the Secretary-General stated in that letter :
"as required by paragraph 2 of Article 11 of the Statute of the
Administrative Tribunal, 1shallarrange to transmitany viewsthatMr.
Mortished, the person in respect of whom the Tribunal rendered its

Judgement No. 273, may wish to submit",

Fixes30 October 1981as the time-limitwithin whichwritten statements
maybe submitted in accordancewithArticle66, paragraph 2,of the Statute
of the Court ;

Reserves the subsequent procedure for further decision.

Peace Palace, The Hague, this sixth day of August, one thousand nine
hundred and eighty-one.
