Après délibéré en chambre du conseil,
Vu l’article 48 du Statut de la Cour et les articles 31, 44, 45, paragraphe
1, et 48 de son Règlement,
Vu la requête introductive d’instance déposée par la République de
Guinée équatoriale (ci-après la « Guinée équatoriale ») le 29 septembre
2022 contre la République française (ci-après la « France ») au sujet de
la violation alléguée, par cette dernière, de ses obligations souscrites au
titre de la convention des Nations Unies contre la corruption du
31 octobre 2003, et la demande en indication de mesures conservatoires
présentée en même temps que la requête,
Vu la lettre, transmise au Greffe sous le couvert d’une note verbale de
l’ambassade de Guinée équatoriale à Bruxelles datée du 19 octobre 2022,
par laquelle l’agent de la Guinée équatoriale a informé la Cour que son

ORDER
Present: President Donoghue; Vice-President Gevorgian; Judges Tomka,
Abraham, Yusuf, Xue, Sebutinde, Bhandari, Salam,
Iwasawa, Nolte, Charlesworth, Brant; Registrar Gautier.
The International Court of Justice,
Composed as above,
After deliberation,
Having regard to Article 48 of the Statute of the Court and to Articles
31, 44, 45, paragraph 1, and 48 of the Rules of Court,
Having regard to the Application filed by the Republic of Equatorial
Guinea (hereinafter “Equatorial Guinea”) on 29 September 2022 instituting
proceedings against the French Republic (hereinafter “France”)
concerning the alleged violation, by France, of its obligations under the
United Nations Convention against Corruption of 31 October 2003, and
to the Request for the indication of provisional measures submitted
together with the Application,
Having regard to the letter communicated to the Registry under cover
of a Note Verbale from the Embassy of Equatorial Guinea in Brussels
dated 19 October 2022, whereby the Agent of Equatorial Guinea informed

gouvernement avait « décidé de retirer sa demande en indication de mesures
conservatoires afin de se concentrer sur la procédure au fond pour
permettre à la Cour de trancher le différend le plus tôt possible »,
Vu l’ordonnance en date du 21 octobre 2022, par laquelle la présidente
de la Cour a donné acte à la Guinée équatoriale du retrait de sa demande
en indication de mesures conservatoires ;
Considérant que, le 7 décembre 2022, la présidente de la Cour a tenu
une réunion avec les agents des Parties, en application de l’article 31 du
Règlement de la Cour, afin de s’informer de leurs vues en ce qui concerne
les délais pour le dépôt des premières pièces de la procédure écrite en
l’affaire ;
Considérant que, à cette réunion, l’agent de la Guinée équatoriale a
sollicité un délai de cinq mois pour l’élaboration d’un mémoire par le
demandeur ; et que le coagent de la France a indiqué que son gouvernement
aurait besoin de neuf mois, à compter du dépôt du mémoire, pour
la préparation de son contre-mémoire ;
Compte tenu des vues des Parties,
Fixe comme suit les dates d’expiration des délais pour le dépôt des
pièces de la procédure écrite :
Pour le mémoire de la République de Guinée équatoriale, le 17 juillet
2023 ;
Pour le contre-mémoire de la République française, le 19 février
2024 ;
Réserve la suite de la procédure.
Fait en français et en anglais, le texte français faisant foi, au Palais de
la Paix, à La Haye, le quinze décembre deux mille vingt-deux, en trois
exemplaires, dont l’un restera déposé aux archives de la Cour et les autres
seront transmis respectivement au Gouvernement de la République de
Guinée équatoriale et au Gouvernement de la République française.

the Court that his Government had “decided to withdraw its Request for
the indication of provisional measures in order to focus on the proceedings
on the merits, so that the Court may settle the dispute at the earliest
opportunity”,
Having regard to the Order dated 21 October 2022, whereby the President
of the Court placed on record the withdrawal by Equatorial Guinea
of its Request for the indication of provisional measures;
Whereas, on 7 December 2022, a meeting was held by the President of
the Court with the Agents of the Parties pursuant to Article 31 of the
Rules of Court, in order to ascertain their views with regard to the timelimits
for the filing of the initial written pleadings in the case;
Whereas at this meeting, the Agent of Equatorial Guinea requested a
period of five months for the preparation of a Memorial by the Applicant;
and whereas the Co-Agent of France stated that his Government
would need a period of nine months, after the filing of the Memorial, for
the preparation of its Counter-Memorial;
Taking into account the views of the Parties,
Fixes the following time-limits for the filing of the written pleadings:
17 July 2023 for the Memorial of the Republic of Equatorial Guinea;
19 February 2024 for the Counter-Memorial of the French Republic;
and
Reserves the subsequent procedure for further decision.
Done in French and in English, the French text being authoritative, at
the Peace Palace, The Hague, this fifteenth day of December, two thousand
and twenty-two, in three copies, one of which will be placed in the
archives of the Court and the others transmitted to the Government of
the Republic of Equatorial Guinea and the Government of the French
Republic, respectively.
