Mr. Secretary-General,
1 have the honour to acknowledge the receipt of note No. CN.rg6 a,
of 18 December of last year, by which you inforrned this Ministry
that the Governrnent of the Republic of Poland has confirmed its ratifi-
cation of the Convention of December. 1948, on the Prevention and
Punishment of the Crime of Zenocide accepting it with reservations to
Articles IX and XII of that international instrument.
In reply, 1 have the honour to inform you that the Government of
Ecuador does not accept the afore-said reservations made by the Govern-
ment of the Republic of Poland to Articles IX and XI1 of the Conven-
tion on the Prevention and Punishment of the Crime of Genocide.

Me référant à toute la correspondance que vous avez bien voulu
m'adresser au sujet de la ratification ou de l'adhésion, avec ou sans
réserves, de divers gouvernements, 3Iemhres ou non membres de
l'organisations des Nations Unies. i la Convention du 9 décembre
1948 pour la prévention et la répression du crime de génocide, j'ai
l'honneur de vous rappeler que le Sénat a, en date de 8 novembre
1950, voté a l'unanimité et sans aucune réserve en faveur de ladite
convention. Il ne fait pas de doute que la Chambre des Députésen
fera bientbt de meme, et que les instruments de ratification de cette
convention par l'Iran poiirront vous êtreremis.
Toutefois, une question se pose à propos de laquelle je voudrais
dès à présent vous informer de l'opinion de mon gouvernement. Il
s'agit de la question des reserves faites par certains gouvernementsà
l'effet de certains articles de la convention. J'ai appris avec plaisir

la solution recommandée par la Sixième Commission et adoptée par

ne soit pas interprété dans le sens de l'acceptation des effets des
réserves formulées.

Sir,
1 have the honour to refer to the letter of 15th November, 1950,
in which, by direction of the Minister of State for External Affairs,
you were informed (interalia)that the Australian Government did
not accept the reservations contained in the instrument of ratification
of the Kepublic of the Philippines, dated 23rd June, 1950, of the
Convention of 9th December, 1948, on the Prevention and Punishment
of the Crime of Genocide.
1 refer to paragraph z of the above letter, which is as follows:
"Also, the Australian Government does not accept any of the
reservations made at the time of signature of the ahove-named
Convention by Czechoslovakia, the Union of Soviet Socialist
Kepublics, the Ukrainian Soviet Socialist Republic and the Byelo-
russian Soviet Socialist Republic respectively, and would not,
therefore, regard as valid any ratification of the Convention
maintaining such reservations."
1 have been informed by my Government that the Government of
the Republic of the Philippines in a written statement to the Registrar
of the International Court of Justice on the matter now pending before
the Court, namely the Advisory Opinion requested hy the General
Assembly on the questions set out in the resolution adopted on the
16th November, ~gjo, with respect to reservations to multilateral
conventions, refers to the existence of a dispute between my Government
and tlie Government of the Republic of the Philippines, it heing the
words "would not regard as valid any ratification of the Convention
maintaining such reservations",contained in the said paragraph 2 set
out above, which have given rise to the alleged dispute.
After further consideration of this matter by the Australian Govern-
ment, and acting on its instructions, 1 hereby withdraw from para-graph 2 of the letter of 15th November, ~gjo, the words "would not
regard as valid any ratification of the Convention maintaining such
reservations".

27 January, 1951, in which you state that your Government "does not
accept the reservations madeby the Union of Soviet Socialist Republics,
the Byelorussian Soviet Socialist Republic, Czechoslovakia, the l'hilip-
pines, Bulgaria and Romania" to the Convention on the Prevention
and Punishment of the Crime of Genocide.1should like in this respect
to draw your attention to the last paragraph of the resolution on reser-
vations to multilateral conventions adopted by the General Assembly
at its 305th plenary meeting on 16 Xovember, 1950. which instructs the
Secretaq-General, pending the rendering of the Advisory Opinion bythe
International Court of Justice, the receipt of a report from the Inter- DOCUAlESTS SUBYITTEDDURISG ORALPROCEEDINGS 447
national Law Commission and further action by the General Assembly,
to follow his prior practice with respect to the receipt of reservations to
conventions and with respect to the notification and solicitation of
approvals thereof, al1without prejudice to tlie legal effect of objections
to reservations to conventions as itmay be recommended by tlie General
Assembly at its sixth session.
The practice followed by the Secretary-General is based i?&terdia
oii the principle that "A State or international organization nccepting a
treaty impliedly consents to every reservatiou thereto of which that
State or organization then has notice" (Article IO, paragraph 5, of the
draft Convention on the Law of Treaties included in the Report on the
Law of Treaties by Professor J. L. Brierly, preknted to the Intema-
tional Law Commission at its second session, Document A/CN.4/23,
page 49, of the English test). It is in accordance with this principle
that the Secretary-General addressed to your Government his letter
So. LEG.~IS/Z/O~ of 15 November, 1950.

rgjr, il a reçu du ministère de la Défenseet des Affaires extérieures
de Ceylan une lettre déclarant que le Gouvernement de Ceylan n'accepte
pas les réserves formuléespar la Roumanie à la Convention pour la
prbvention et la répression du crime de génocide.
La présente communication est transmise conformément au para-
graphe 3 de la résolutionadoptéepar 1'Asscinhléegénéralele 16novcmbre
1950, relative aux réserves aux conventions multilatérales.

In view of the fact that the question of the legal effect of certain
reservations made by several States to the afore-mentioned Convention
has been submitted to the International Court of Justice with a request
for an Advisory Opinion, the Norwegian Government ?esires to await
this opinion beforeespressing any view concerning the said reservations.
