requestmade by the United Nations General Assembly (resolution AIRESIES-10/14 of 8
December 2003) for an advisory opinion on the question ,,What are the legal
consequences arisingfrom the construction of the wall being built by Israel, the occupying
Power, in the Occupied Palestinian Territory, including in and around East Jerusalem, as
described in the report of the Secretary-General, considering the rules and principles of
interrtationallaw, including the Fourth Geneva Convention of1949, and relevant Security
Courzciland GeneralAssembly resolutions? "
The Czech Republic greatly values the role of the International Court of Justice as the
principaljudicial body of the United Nations and is fully committed to support the Court. The
Czech Republic takes thisopportunity to convey to the Court its position conceming the issue
ofthe Court's advisoryopinion onthe securitybarrier being builtby Israel.
The Czech Republic has expressedits view on the construction of the security barrier,
inter alia, by aligning itself with the European Union Statement presentedon the occasion of
the adoption of the United Nations General Assembly resolution AIRESIES - 10114of
December 8,2003.
The Czech Republic believes thatthe honourable judges of the International Court of
Justice will exercise their discretion and declineto answer the question raised in the UNGA
resolution concerning the legal consequences of the construction of the security barrier by
Israel. In the Czech Republic's opinion the International Court of Justice should not give an
advisory opinion on this issue,since the question is political rather than legal. Our abstention
in the voting on resolution AIRESIES-10114should be understood as an expression of Our Déclarationde la Républiquetchèqueadressée à la Cour internationale de justice

tenu des règles etdesprincipes du droit international, notamment la Quatrième Convention
de Genèvede 1949 et les résolutionsconsacréesà la question par le Conseil de Sécurité et
1'Assembléegénérale» ?
La Républiquetchèque apprécie hautementle rôle jouépar la Cour internationale de
justice en tant qu'organe judiciaire principaldes Nations Unies et elle est pleinement dévouée
à son soutien. La République tchèque saisit cette occasionpour faire savoirà la Cour sa
position en matièrede l'avis consultatif sur l'édification par Israëld'une barrièrede sécurité.
LaRépublique tchèque a exprimé saposition au suje dte l'édificationd'une barrièrede
sécurité, entre autres,en s'alignant la déclaration de l'Union européenne présentée à
l'occasion de l'adoption par l'Assemblée générad es Nations de la résolutionAfRESIES
10114du 8 décembre2003.
La Républiquetchèqueespèreque lesjuges de la Cour internationale dejustice vontà
leur discrétion déciderde ne pas répondre à la question, posée par la résolution de
l'Assemblée généraledes Nations unies, portant sur les conséquences juridiques de
l'édificationpar Israël d'une barrièrede sécur. a République tchèqueassume que la Cour
internationaledejustice ne devrait pas prendre d'avis consultatifen cette matière, car ils'agit-
là d'un problème politique plutôtquejuridique. Notre abstentionlors du vote de la résolution
AIRESIES 10114doit être comprise comme l'expression de notre opinion que cette requête
adresséeà la Cour est inopportune.
