1 have the honour to inform you that the Assembly of the Inter-
Governmental Maritime Consultative Organization, by a resolution
adopted at its 11th meeting, held on 19 January 1959,in connexion
with the election of members of the Maritime Safety Committee,
decided to request the International Court of Justice to give an
advisory opinion on the following question:
"1s the Maritime Safety Committee of the Inter-Govern-
mental Maritime Consultative Organization, which was elected
on 15January 1959 ,onstituted in accordancewith the Conven-
tion for the Establishment of the Organization?"
One copy each of the English and French texts of the aforemen-
tioned resolution of the Assembly, both duly certified, are herewith
enclosed. In accordance with Art65lof the Statute of the Inter-
national Court of Just1cshdl transmit to the Court dl documents
likely to throw light upon the question, including the relevant
records of the proceedings of the Assembly as soon as the officia1
records are available.

To submit to the International Court of Justice, in accordance

I. On 23 March 1959 ,he Secretary-Generalof the Inter-Govern-
mental Maritime Consultative Organization infor~ned the Inter-
national Court of Justice that, at its eleventh plenary meeting, the
Assembly of IMCO had adopted resolution A. 12(1), requesting an
advisory opinion £rom the Court on whether the Maritime Safety
Committee of IMCO, elected by the Assembly on 15 January 1959,
had been constituted in accordance with the Convention for the
establishment of the Organization.The full text of the Assembly
resolution referrinthe matter to the Court is as follows:

z. The present dossier, sent to the Court in accordance with
Article65 ofits Statute, comprises documents that, in the Secretary-
General'sview, are likely to throw light upon the question on which
the Court's opinionhas been asked. The dossier is in three sections;
the first contains certain basic documents concerning the Inter-
Govemmental Maritime Consultative Organization and its relation-
ship with the United Nations; the second, the records and documents
of the first session of the Assembly of the Inter-Governmental
Maritime Consultative Organization relevant to the request for an
advisory opinion, and the third, records and documents of the
"travaux préparatoires" concerning the provisions of the Conven-
tion on the Inter-Governmental Maritime Consultative Organi-
zationrelating to the composition ofthe Maritime Safety Committee.

3. The Secretary-General of IMCO certifies that the documents
of the Inter-Governmental Maritime Consultative Organization are
the officia1documents of the Organization or authentic copies of
those documents; each document or extract therefrom bears a title,
and, where possible, the Organization's officia1document number.
With regard to the documents of the United Nations Maritime
Conference and the United Nations General Assembly, the Secre-
tary-General of IMCO certifies that the documents in question
are authentic copies of, or excerpts from. official United Nations
documents. In order to facilitate consultation of the documents,
they have been numbered in the order in which they appear in the
dossier.

4. The Assembly of the Inter-Governmental Maritime Consul-
tative Organization began its consideration of the substance of
item II of the agenda of its first session, entitled "Election of
members of the Maritime Safety Committee, as provided in Article
28 of the Convention", at its scventh meeting, hcld on 14 January
1959 (document 16).
5. The Assembly had before it a United Kingdom draft resolu-
tion (document 12) the operative part of which provided that a
separate vote should be taken for each of the eight places to be
filled, that the voting should be in the order in which the nations
appeared in the Secretary-General's list (documents IO and II),
and that those eight nations which first received a majority of votes
in favour should be declared elected.
6. The United States submitted a proposa1 that the election of
the Maritime Safety Committee should be deferred until the Assem-
bly's second regular session, and that in the meantime a Provisional
Maritime Safety Committee should be established, open to al1mem-
bers of IMCO desiring to participate in its work and willing to send
to its meetings technically qualificd rcpresentatives (document 13).
7. At the same meeting Liberia suhmitted a draft resolution
(document 14) the operative part of which provided that the eight
largest ship-owning nations shoiild be determined hy reference to
the figures for gross rcgistered tonnage as they appeared in the
latest issue of Lloyd's Register of Shipping.
8. Liberia also proposed an amendment ta the United Kingdom
draft resolution, replacing its operative part by that of the Liberian
draft resolution and adding that at the present time those nations
were the United States of America, the United Kingdom, Liberia,

porte un titre et, le cas échéant,la cote officiellede l'organisation.
Pour les documents de la Conférencemaritime des Nations Unies et
de l'Assembléegénéraledes Nations Unies, le Secrétaire général
certifie qu'il s'agit de copies authentiques des textes qui figurent
dans la documentation officielle de l'organisationdes Xations
Unies. Les piècesont éténumérotéesdans l'ordre selon lequel elles
figurent au dossier, afin de faciliter l'examen de celui-ci.

5. L'Assembléeétaitsaisie d'un projet de résolutiondu Royaume-
Uni (pièce 12)dont le dispositif prévoyait que les titulaires des huit
sièges à pourvoir seraient élus séparément,le vote se déroulant
dans l'ordre où les pays figuraient sur la liste qui avait étéétablie
par le Secrétaire général(pièces IO et II) ,es huit premiers pays
ayant recueilli la majorité des voix étant proclamésélus.
6. Les États-Unis présentèrent une proposition tendant à
remettre l'électiondu Comitéde la sécuritémaritime à la deuxième
session ordinaire de l'Assembléeet à établir entre temps un Comité
de la sécurité maritime provisoire ouvert à tous les membres de
l'organisation désireux de participer à ses travaux et disposésà
envoyer à ses réunions desexperts techniques qualifiés (piè13).
7. A la même séance, le Libériaprésenta un projet de résolution
(pièce 14),dont le dispositif prévoyait que les huit pays possédant
les flottes de commerce les plus importantes seraient déterminés
en fonction des chiffres de jauge brute inscrits dans le dernier
numérodu 1Lloyd's Register of Shipping II.
8. Le Libéria présenta également un projet d'amendement au
projet de résolution du Royaume-Uni tendant notamment à rem-
placer le dispositif par un texte qui reprenait les termes du disposi-
tif de son projet de résolutionet qui ajoutait que ces pays étaient
alors: les États-Unis, le Royaume-Uni, le Libéria, la Norvège, le

g. The Assembly voted first on the United States proposal. The
proposal tas not adopted, the result of the vote being 12 in favour,
14 against and 2abstentions.
IO. At its eighth meeting held on 15 January 1959 (document 19)
the Assembly continued its debate on item II of the agenda, by
considering an amendment, submitted jointly by the United States
and Liberia (document 18), tothe United Kingdom draft resoliition.
The joint amendment replaced the earlier Liberian amendment
(document 15); it had a differentlast paragraph. The joint amend-
meut was uot adopted by the Assembly, the result of the vote on
each paragraph being II in favour and 17 against.
II. At the same meeting of the Assembly the Liberian represen-
tative orally presented a motion to request the International Court
of Justice for an advisory opinion on whether gross registered ton-
nage was the appropriate test for determining the size of the mer-
chant fleet of a ship-owning nation for the purpose of electing the
eight largest ship-owning nations under Article 28ofthe Convention,
or whether registration in the name of nationals was the appro-
priate test. If the answer to either question was in the affirmative,
and having regard to the fact that by the first test Liberia ranked
third and Panama ranked eighth among States, and hy the second
test Liberia ranked fifth and Panama ranked eighth, was the Assein-
bly under a dutyto elect Liberia and Panama tothe Maritime Safety
Committee? The motion concluded with a proposa1 to establish an
Interim Committee on Safety at Sea until such time asthe Assembly
received the advisory opinion of the Court.
12. After a debate on the motion, the Liberian representative
said that he would later introduce the motion in the form of a draft
resolution.
13. The Assembly adopted the United Kingdom idraft resolution
by 18 votes to 9,with I abstention, by aroll-callvote(docnment 20).
The Assembly then elected the eight members of the Maritime
Safety Committee in accordance with the procedure provided in the
resolution adopted. The eight countries elected were: the United
States of America, the United Kingdom of Great Britain and
Northern Ireland, Norway, Japan, Italy, the Netherlands, France

Japon, l'Italie, les Pays-Bas et le Panama, lesquels seraient déclarés
éluslorsqu'ils auraient recueilli la majorité des voix (p15).
g. L'Assembléeprocédaen premier lieu à un scrutin sur la pro-
position des États-Unis. Le résultat du scrutin ayant étédrz voix
pour, 14 voix contre, avec z abstentions, cette proposition ne fut
pas adoptée.
IO. L'Assemblée, à sa huitième séance, le 15 janvier 1959 (pièce
19). continua la discussion du point II de son ordre du jour par
l'examen d'un projet d'amendement, présenté conjointement par
les États-Unis et le Libéria (pièce18),au projet de résolution du
Royaume-Uni. Ce projet d'amendement commun remplaçait le
projet d'amendement antérieur du Libéria(pièce 15), dont il modi-
fiait notamment le dernier paragraphe. Le projet d'amendement
commun ne fut pas adopté par l'Assemblée,le résultat du scrutin
sur chaque paragraphe ayant été de II voix en faveur et 17 voix
contre.
II. Le représentant du Libéria présenta oralement, à la même
séancede l'Assemblée,une motion aux fins de soumettre à la Cour
internationale de Justice une demande d'avis consultatif portant
sur les points de savoir si le tonnage de jauge brute immatriculé
constituait le critère à appliquer pour déterminer l'importance de
la flotte de commerce d'un pays donnéen vue de l'électiondes huit
pays qui possèdent les flottes de commerce les plus importantes,
conformément àl'article28 de la Convention, ou bien si l'immatri-
culation au nom d'un ressortissant d'un pays donnéconstituait le
critère approprié. Dans le cas d'une réponseaffirmativeà l'une ou
l'autre des questions et en tenant compte du fait que selon le pre-
mier critère, le Libériase plaçait au troisièmerang et le Panama au
huitième rang et que selon le second critère, le Libéria se plaçait
au cinquième rang et le Panama au huitième, l'Assembléeavait-
elle le devoir d'élirele Libériaet le Panama au Comitéde la sécurité
maritime? La motion concluait en proposant la création d'un
Comitéde la sécurité maritime temporaire jusqu'à réception par
l'Assembléede l'avis consultatif de la Cour.

tion des huit membres du Comitéde la sécuritémaritime,conformé-

14. At its ninth meeting, held on 15 January ~ggg,.the Assembly
elected the other six members of the Maritime Safety Committee
(document 22).
1j. The Presitlent, referring to the provisional rules of procedure,
proposed that the elections should be held by a panel vote. The
United States representative said that the standard practice aas
for the vote to bc taken by secret ballot, without nominations. The
President put that question to the vote, and the result of the vote
was 9 in favour and 9 against. The Assembly theii held elections
for the six members of the Maritime Safety Committee by a panel
vote. each ballot paper being identified by the member voting. The
following six countries were declared elected: Argentina, Canada,
Greece, l'akistan, the Union of Soviet Socialist Republics and the
United Arab Republic.
.16. The Liberian representative submitted a draft resolution to
the effect that the Assembly should request an advisory opinion
from the International Court of Justice on the legal issues which had
arisen in connexion with the interpretation of Article 28 of the
Convention and should ask the Legal Committee to formulate the
questions to be put to the Court and to refer them back to the
Assembly for approval (document 21).
17. At its teiith meeting on 16 January Igjg, the Assembly
considered the Liberian draft resolution and approved it in principle
(document 23).
16. The Legal Committee, at its fourtli meeting on 16 January
1959 (document 26). had before it a Liberian draft resolution the
operative part of which repeated the motion submitted to the
Assembly at its cighth meeting (seeparagraph II above) except for
the proposal conceming the establishment of an Interim Committee
on Safety at Sea (document 24).
19. The Committee also liad before it a United Icingdom amend-
ment replacing the questions in the operative part of the Liberian
draft resolution by two other questions, namely, whether the
eight largest ship-owning nations should be determined solely
according to the tonnage on the national register, and, if so,
whether the Assembly was under a legal obligation to elect to the
Maritime Safety Committee the States with the largest registered
-tonnage (document 25).
zo. The French representative introduced a draft resolution to
the effect that the Assembly should request the Court for an advis-
ory opinion on the follo~\ingtwo questions:
(1) Whether the cight "largest ship-owning nations" should be
determined by the sole criterion of the tonnage registered

mis cette questionaux voix, le résultat du vote fut de 9 voix pour et
9 voix contre. L'Assemblée procédaalors aux élections des six
membres du Comité de la sécurité maritime au scrutin de liste,
chaque bulletin étant identifiépar le membre votant. Les six pays
suivants furent déclarésélus: Argentine, Canada, Grèce, Pakis-
tan, Union des Républiques socialistes soviétiques et République
arabe unie.
16. Le représentant du Libéria présenta un projet de résolution
aux termes duquel l'Assembléedéciderait de soumettre à la Cour
internationale de Justice pour avis consultatif les points de droit
soulevéspar l'interprétation de l'article 28 de la Convention et de
charger la Commission juridique de formuler les questions à poser
à la Cour, ces questions devant ensuite être soumises à l'Assemblée
pour approbation (pièce 21).
17. L'Assemblée examina le projet de résolution du Libéria à
sa dixième séance, le 16 janvier 1959, et l'approuva en principe
(pièce23).
18. La Commission juridique, lors de sa quatrième séance, le
16 janvier 1959 (pièce 26), fut saisie d'un projet de résolution du
Libéria, dont le dispositif reprenait les termes de la motion soumise
à l'Assemblée lorsde sa huitième séance(paragraphe II ci-dessus)
àl'exception de la proposition relativeà la constitution d'un Comité
de la sécurité maritime temporaire (pièce24).
19. La Commission était également saisie d'un projet d'amende-
ment du Royaume-Uni tendant à remplacer les questions contenues
dans le dispositif du projet de résolution du Libériapar deux autres
questions, à savoir si le critère de détermination des huit pays qui
possèdent les flottes de commerce les plus importantes devait être
uniquement le tonnage de jauge bmte immatriculé au Registre
national et, dans l'affirmative, si l'Assembléeétait tenue en droit
d'éliremembres du Comitéde la sécurité maritime les Etats possé-
dant les plus forts tonnages immatriculés (pièce 25).
20. Le représentant de la France introduisit un projet de réso-
lution par lequel l'Assemblée déciderait de soumettre à la Cour
pour avis consultatif les deux questions suivantes:

21. The United States representative submitted a draft resolu-
tion according to which the advisory opinion requested of the Court
would be on the question whether, considering the registered ton-
nages of the member countries of IMCO as shown in document
IMCO/A.I/Working Paper j of 13 January 1959 (documents IO
and II). and considerina that a Maritime Safetv Committee com-

22. The Comrnittee decided to estahlish a Working Party, com-
posed of the representatives of France, Liberia, the United King-
dom and the United States.
23. The Committee met again on 17 January r959 (document
29). The Liberian representative reported on the Working Party's
proceedings. The Canadian representative made an oral proposal
that the question to be submitted to the Court shi~uldbe: "1s the
election of the members of the Maritime Safety Committee valid?",
and that the relevant documents should be transmitted with the
question.
24. The Committee decided that the proposa1 was before it in
the same nay as the proposals studied by the Working Party.
25. At its sixth meeting, held on 19 January 1959 (document 33),
the Committee had before it a document in which al1 the
various proposals submitted were assembled (documents 30 and
31), and a memorandum submitted by the Liberian delegation
(document 32).
26. The United States representative, supported by the Liberian
representative, proposed that the Committee should take a decision
on annex IO of Working Paper 9 (document 30). containing the
Canadian representative's proposal, it being understood that the
whole of Workiiig Paper 9 would be transmitted ti, the Assembly,
which would be informed of the results of the vote taken in the
Committee. By a roll-cal1 vote, the Committee adopted the United
States proposal by S votes to z, with 3 abstentions.
27. At its eleventh meeting, held on 19 January 1959 ,he Assem-
bly had hefore it a draft resolution submitted joi~itly by Liberia,
Panama and the United Kingdom (documents 34 and 35).
28. The Assembly adopted the joint draft resolutii~nunanimously,
with I abstention. The full text of the resolution is reproduced in
paragraph I of this introductorj~ note.
29. The second section of the dossier also contains documents

21. Le représentant des États-Unis présenta un projet de réso-
lution aux termes duquel l'avis consultatif demandé à la Cour
porterait sur le point de savoir si, considérant les tonnages de jauge
immatriculés dans les pays membres de l'organisation tels qu'ils
figuraient dans le document IMCO/A.I/Document de travail 5,
du 13 janvier 1959 (pièces IO et II) et considérant qu'un Comitéde
la sécurité maritime avait étéélu, composédes pays mentionnés
aux paragraphes 13et 15 ci-dessus, le Comitéde la sécuritémaritime
était valablement constitué (pièces 27et 28).
22. La Commission décida de constituer un groupe de travail
composédes représentants de la France, du Libéria,des États-Unis
et du Royaume-Uni.
23. La Commission se réunit à nouveau le 17 janvier 1959
(pièce29). Le représentant du Libéria fit rapport sur les travaux
du groupe de travail. Le représentant du Canada proposa oralement
que la question à transmettre à la Cour fût rédigéecomme suit:
K L'élection des membresdu Comitéde la sécuritémaritimeest-elle
valide? », cette question devant êtreaccompagnéede la documen-
tation pertinente.
24. La Commission décida de considérer cette proposition au
mêmetitre que les autres projets qui avaient étéétudiés par le
groupe de travail.
25. A sa sixième séance, tenue le 19 janvier 1959 (pièce33), la
Commission était saisie d'un document réunissant les différents
projets qui lui avaient étésoumis (pièces30 et 31). ainsi que d'un
mémorandum présentépar la délégationdu Libéria (pièce32).
26. Le représentant des États-Unis, appuyé par le représentant
du Libéria, proposa que la Commission prenne une décision sur
l'annexe IO du document de travail no g (pièce 30) contenant la
proposition du représentant du Canada, étant entendu toutefois que
le document en son entier serait transmis à l'Assembléeavec le
résultat du scrutin au sein de la Commission. A la suite d'un scrutin
par appel nominal, la Commission approuva la proposition des
États-Unis par 8 voix contre 2, avec 3 abstentions.
27. Lors de sa onzièmeséance,tenue le 19 janvier 1959,l'Assem-
bléefut saisie d'un projet de résolution commun du Libéria. du
Panama et du Royaume-Uni (pièces34et 35).
28. L'Assembléeadopta ce projet de résolution à l'unanimité
avec une abstention. Le texte complet de la résolution est repro-
duit au paragraphe I de la présente introduction.
29. La deuxième section du dossier contient également la docu-

which, according to Article 17 of the Convention on the Inter-
Governmental Maritime Consultative Organization, shall consist of
sixteen members and shall be composed asfollows: "six shall be
governments of the nations with the largest interest in providing
international shipping services; six shall be governments of other
nations with the largest interest in international seaborne trade;
two shall be elected by the Assembly from among the governments
of nations having a substantial interest in providing international
shipping services; and txvoshall be elected by the Assembly from
among the govemments of nations having a substantial interest in
international seaborne trade", the first Council to be constituted as
provided in Appendix 1to the Convention (documents 37 and 39).
30. As the relation between tonnage and the apportionment of
expenses among the member States \vas referred to at meetings of
the Assembly concemed with the election of members of the Mari-
time Safety Committee, it appears appropriate to include documents
on that subject in the present dossier (documents 40 to 49). Itwill
be seen from the resolution adopted by the Assembly on 19 January
1959 (document 49) that the scale of apportionment of expenses
among member States is based on the following principles: (a) a
basic assessment as determined by the percentage of the contri-
bution of each member to the budget of the United Nations; (b) an
additional assessment determined by the gross registered tonnage
of each member as shown in the latest edition of Lloyd's liegister
of Shipping.

31. Section III of the dossier contains extracts from documents
of the United Nations Maritime Conference of February-March
1948, which adopted the provisions of the Convention on the Inter-
Governmental Maritime Consultative Organization. These extracts
relate to the compositio~iof the Maritime Safety Committee.
32. It is perhaps appropriate to recall that the United Nations
Economic and Social Council had recommended, in a resolution
adopted on 21 Jnne 1946, that the question of the establishment of
a world-wide intergovemmental shipping organization should be
examined by the Council's Transport and Communications Com-
mission, and had authorized the Secretary-General of the United
Nations to seek the views of the United Maritime Consultative
Council, which had been established on 3 March 1946 and whose
aims included the study of common problems relating to shipping.
33. The United Maritime Consultative Council, at its session
held at \Vashin&on in October 1446. examined the question of

membres du Conseil qui, selon l'article 17 de la Convention relative
à la création d'une Organisation maritime consultative inter-
gouvernementale, est composéde seize membres répartis comme
suit: osix sont les gouvernements des pays qui sont le plus inté-
ressésà fournir des services internationaux de navigation maritime;
six sont les gouvernements d'autres pays qui sont le plus intéressés
dans le commerce international maritime; deux sont élus par
l'Assembléeparmi les gouvernements des pays qui ont un intéret
notable à fournir des services internationaux de navigation mari-
time; et deux sont éluspar l'Assembléeparmi les gouvernements
d'autres pays qui ont un intérêt notable dans le commerce inter-
national maritime iile premier Conseil devant être'composé comme
il est prévuà l'annexe 1 de la Convention (pièces37 à 39).
30. La relation entre le tonnage et la répartition des dépenses
entre les États membres ayant étémentionnéeau cours des séances
de l'Assembléerelatives à l'élection des membres du Comitéde la
sécurité maritime, il a semblé utile de joindre au présent dossier
la documentation relative à cette question (pièces40 à 49). Il appa-
raît, d'après la résolution adoptée par l'Assembléele 19 janvier
1959 (pièce49), que le barème de répartition des dépensesentre les
États membres est établiselon les principes suivants: a) une contri-
bution de base arretée en fonction de la participation en pourcen-
tage de chaque membre au budget de l'organisation des Nations
Unies; b) une contribution supplémentaire calculée en fonction
du tonnage brut des navires de chaque membre immatriculés selon
la dernière livraison du «Lloyd's Rcgister of Sbipping 11.

31. La section III du dossier contient des extraits de documents
de la Conférencemaritime des Nations Unies de février-mars 1948
qui adopta les dispositions de la Constitution de l'organisation
intergouvernementale consultative de la navigation maritime. Ces
extraits sont relatifs à la composition du Comité de la sécurité
maritime.
32. Il est sans doute utile de rappeler que le Conseil kconomique
et social des Nations Unies, par une résolution adoptée le 21 juin
1946, avait recommandéque la question de la création d'une Orga-
nisation mondiale de la navigation soit examinéepar la Commission
des transports et des communications du Conseil et avait autorisé
le Secrétaire généralde l'organisation des Nations Unies à recher-
cher les vues de l'United Maritime Consultative Council, qui, créé
le 3 mars 1946, avait pour objet, entre autres, d'étudier des pro-
blèmes communs intéressant la navigation maritime.
33. Lors de sa session tenue à Washington en octobre 1946,
l'United Maritime Consultative Council examina la question de la
création, par l'intermédiaire del'organisation des Nations Unies,

shipping, and decided to recommend to the Govemments of parti-
cipating States the text of a draft convention for that purpose.
United Maritime Consultative Council documents other than those
officiallytransmitted tothe Secretary-General of the United Nations
(arelevant extract from which is givenin document jo of the dossier)
were restricted to participating members.
34. The Economic and Social Council, having examined the
report of the Transport and Communications Commission, requested
the Secretary-General, in a resolution adopted on 28 March 1947,
at its fourth session, to convene a conference of interested Govern-
ments to consider the establishment of an intergovernmental mari-
time organization, and specified that the draft convention prepared
by the United Maritime Consultative Council on the matter, con-
cerning the scope and purpose of the proposed organization, would
serve as a working paper forming the basis of discussion for the
conference.
35. Article VI1 of the draft convention, relating to the Maritime
Safety Committee, is reproduced in document 50 of the dossier. A
commentary on the article appears in a paper submitted to the
Conference by the United States delegation (document 52).
36. The United Nations Maritime Conference had before it at
itseighth meeting on 27 February 1948a United States proposa1for
the establishment of a special Working Party to consider matters
affecting the Maritime Safety Committee (document 53). At the
same meeting, the Conference adopted the proposa1 and agreed on
the membership of the Working Party (document 54 and 55).
37. The Working Party, a relevant extract from one of whose
unofficial records appears in document 56 of the dossier, recom-
mended that the Conference shoiild adopt Article VI1 of the draft
convention with, inte rlin,certain amendments proposed by the
United States (document 51).
38. At its ninth meeting, held on I March 1948, the Conference
examined the report of the Working Party on Maritime Safetyand
adopted the text of the article concerned on first reading (docu-
ments 57 and 58). At its twelfth meeting, on 5 March 1948, the
Conference adopted the text of the Convention, including what had
become part VII, which in turn included Article 28, without amend-

nent est reproduit à la pièce 50 du dossier) ont eu une distribiitjon
limitée aux membres participants.
34. Le Conseil économiqueet social, après examen du rapport de
sa Commission des transports et des communications, par une
résolution adoptée le 28 mars 1947, lors de sa quatrième session,
pria le Secrétairegénéralde convoquer une conférencedesgouverne-
ments intéresséspour étudier la création d'une Organisation inter-
gouvernementale des transports maritimes, en spécifiant que le
projet de convention élaboré par l'United Maritime Consultative
Council sur ce sujet et portant sur les pouvoirs et le but de l'organi-
sation envisagée servirait de document de travail et de base aux
discussions de la Conférence.
35. L'articleVI1 de ce projet de convention, qui traite du Comité
de la sécuritémaritime, est reproduit à la pièce 50 du dossier. Un
commentaire de cet article figure dans un document de la Confé-
rence soumis par la délégation desÉtats-Unis (pièce 52).
36. La Conférence maritime des Nations Unies, lors de sa hui-
tième séance, le 27 février 1948, fut saisie d'une proposition des
États-Unis tendant àla constitution d'un groupe de travail spécial
chargé d'examiner les questions concernant le Comitéde lasécurité
maritime (pièce 53). A la meme sCance, la Conférenceadopta cette
proposition et décida de la composition de ce groupe de travail
(pièces 54 et55).
37. Le groupe de travail, dont un extrait pertinent des comptes
rendus dactylographiés des séances figure à la pièce 56 du dossier,
recommanda à la Conférencel'adoption de l'article VI1 du projet
de convention avec, notamment, certains amendements proposés
par les États-Unis (pièce 51).
38. La Conférence procéda à l'examen du rapport du groupe de
travail de la sécurité maritime lors de sa neuvième séance,tenue le
I~~ mars 1948, et adopta en première lecture le texte de l'article
