(REQUEST FOR ADVISORY OPINION)

ORDER

The President of the International Court of Justice,

Having regard to Article 66, paragraph 2, of the Statute of the
Court,
Whereas on 23August 1984,the Committee on Applicationsfor Review
of Judgements of the Administrative Tribunal of the United Nations
adopted the following decis:on

"The Committee on Applications for Review of Administrative
Tribunal Judgements at the 4th meeting of its twenty-fourth session
on 23 August 1984decided that there was a substantial basis, within
the meaning of Article 11 of the Statute of the Administrative Tri-
bunal, for the application for review of Administrative Tribunal
Judgement No. 333 delivered at Geneva on 8 June84.
Accordingly, the Committee on Applications for Review of Ad-
ministrative Tribunal Judgements requests an advisory opinion of
the International Court of Justice on the following questions

'(1)In itsJudgement No. 333of 8June 1984(AT/DEC/333), did
the United Nations Administrative Tribunal fail to exercisejuris-
diction vested in it by not responding to the question whether a
legal impediment existed to the further employment in the United
Nations of the Applicant after the expiry of his on 26 De-

ORDONNANCE

Le Présidentde la Cour internationale de Justice,
Vu l'article 66, paragraphe 2, du Statut de la Cour,

Considérantquele23août 1984leComitédesdemandesde réformation
de jugements du Tribunal administratif des Nations Unies a adoptéune
décisionainsi conçue:

(iLe Comitédes demandes de réformation de jugements du Tri-
bunal administratif,à la4e séancede sa vingt-quatrième session,
tenue le 23 août 1984,a décidéque la demande de réformation du
jugement no333 du Tribunal administratif rendà Genèvele 8juin
1984repose sur des bases sérieusesau sens de l'article 11du statut du
Tribunal.
En conséquence, leComitédes demandes de réformationdejuge-
ments du Tribunal administratif prie la Courinternationalede Justice
de donner un avis consultatif sur les questions suiv:ntes

(1) Dans sonjugement no333, du 8juin 1984(AT/DEC/333),
leTribunal administratif des Nations Unies a-t-il manquéd'exercer
sajuridiction en nerépondantpaà laquestion de savoirs'ilexistait
un obstaclejuridique au renouvellement de l'engagementdu requé-
rantà l'organisation desNations Unies aprèslavenuàexpiration
de son contrat le 26 décembre1983? (2) Did the United Nations AdministrativeTribunal, in the same
Judgement No. 333,err on questions oflawrelating to provisions of
the Charter of the United Nations ?'"
Whereas certified true copies of the English and French texts of the
aforesaid decision were transmitted to the Court by a letter from the
Secretary-General of the UnitedNationsdated 28August 1984and filedin
the Registry on 10 September 1984 ;

Whereas the Secretary-General stated in that letter :
"as required by paragraph 2 of Article 11 of the Statute of the
Administrative Tribunal, 1 shall arrange to transmit any views that

its Judgement No. 333, may wish to submit",
Fixes 14 December 1984as the time-limit within which written state-
ments may be submitted in accordance with Article 66,paragraph 2, of the
Statute of the Court ;

Reserves the subsequent procedure for further decision.

Done in English and in French, the English text being authoritative, at
the Peace Palace, The Hague, this thirteenth day of September one thou-

Considérant que, dans cette lettre, le Secrétaire généraal déclaré :

administratif, je veilleraià ce que soient transmises à la Cour toutes
observations que voudrait lui soumettre M. Yakimetz, fonctionnaire
visépar lejugement no 333 du Tribunal administratif )),

Fixe au 14décembre1984la date d'expiration du délaidans lequel des
exposésécritspourront êtreprésentésconformément à l'article 66,para-
graphe 2, du Statut de la Cour ;

Réservela suite de la procédure.
