bien également faire savoir que, conformément à l'article 6j d.u Statut,
tous documents pouvant servir à élucider la question seront transmis
à la Cour le plus tôt possible.

Unies (demande d'avis consultatif), j'ai fait connaitre à Votre Excel-
lence, en me référantaux dispositions de l'article 66, paragraphe 2,
du Statut de la Cour internationale de Justice, que la Cour était
disposée à recevoir, avant le 14 février 1949, des exposés écrits des
fitats admis à ester en justice devant elle. J'ai ajouté que la Cour
tiendrait à partir du lundi 7 mars 1949 des audiences pour entendre
des exposés oraus.
J'ai aujourd'hui l'honneur de faire connaitre à Votre Excellence
que plusieurs gouvernements se sont prévalus dela :facultéde présenter
cles exposés écrits. Vous voudrez bien trouver ci-joint, pour votre

The answer to question (r)inust depend upon the terms of service
or the conditions of employmeut by which the agent concerned l~as
agreed Io scrve with the United Nations Organization. Ifthcrc are
specific terms in regard to siichmatter as suffering injury wliilst per-
forming duIy on behalf of the United Nations Organization, then the
daim for cotnpensation rnust surely be iri accordance with the terms
containecl in the contract oconditions of employn~ent. In the absence
of any terms of employment the Governmcnt of tlie Union of Burma
Is of the view that the victim ar the agcnt liimself must prefera clairn
agninst the rcsponsibIe de jure or qiefactogovernment for the injury
suffered bÿ him in the performance of duties on heh~lf of the Unitcd
Nations Organization. The reason is that it is a personal injilry
sustained by the agent himself and itis not an injury to the United
Nations Organization. If the United Nations Organization is inter-
ested at al], it isinterestecl only in its r~leas ari employer or as a
principal ; and if at al1 a cIaim is prcfcrred by the United Nations
