nement, ainsi que le texte des résolutions mentionnées dans la question,
est parvenue au Greffe le 27 décembre 1961 sous le couvert d'une lettre
du Secrétaire généralpar intérim des Nations Unies, datée du 21 dé-
cembre 1961. Le Greffe va établir une édition imprimée de la lettre et

Le paragraphe 2 du mêmearticle du Statut prévoit qu'à tout État
admis à ester devant la Cour et à toute organisation internationale jugés,
par la Cour ou 'par son Président si elle ne siège pas, susceptibles de
fournir des renseignements sur la question, le Greffier fait connaître, par
communication spéciale et directe, que la Cour est disposée à recevoir
des exposés écrits dans un délaià fixer par le Président, ou à entendre
des exposésoraux au cours d'audiences tenues à cet effet.
Appliquant cette disposition, j'ai l'lionneur de faire connaître à Votre
Excellence, par la présente comtnunication spéciale et directe, qu'en
l'espèce et à ce jour les Etats Membres de l'Organisation des Nations
Unies ont étéconsidéréspar le Président comme susceptibles de fournir
des renseignements sur la question; et, d'autre part, que la date à laquelle
expire le délai pour la présentation d'exposés écrits a,par ordonnance
du Président du 27 décembre 1961 ', étéfixée au 20 février 1962. La
suite de la procédure est réservée.
Au cas où votre Gouvernement désirerait se prévaloir de la faculté,
qui lui est ainsi ouverte, de présenter un exposé écrit dans le délai fixé,
j'attacherais du prix à en êtreinformé aussitôt que possible. J'ajoute
que l'exposédevrait être rédigésoit en français, soit en anglais, langues
officielles de la Cour (article39, paragraphe 1, du Statut).

Sir,
1wish to refer tomy letter of21 December 1961 ,ransmitting to you
General Assembly resolution 1731 (XVI) of 20 December 1961 which
contains a request by the Assembly for an advisory opinion on the
financial obligations of Members of the United Nations.
By operative paragraph z of resolution 1731 (XVI) the Assembly
requested me, in accordance witk Article65 of the Statute of the Inter-
national Court of Justice, to transmit to the Court al1documents likely
to throw light upon the question. Pursuant to this, 1 am sending to the
Court thirty dossiers inEnglish and thirty dossiers in French containing
the aforementioned documents. Each dossier consists of five parts.
Parts 1, IIand III of nine dossiers in Englisli and eight in French have
been transmitted to-day by airmail. Parts IV and V will be forwarded
by airmail within the next few days. The remainder of the dossiers have
been sent by surface mail. 1 certify thatthe documents are final official
records of the .United Xations or true copies therefrom.
Each dossier contains a table of contents setting out a complete list
of al1 the documents therein and an Introductory Note which has
been prepared with a view to facilitating the use of the dossier. Part 1
of the dossier contains documentation relating to the proceedings in
United Nations organs leading to the request by the General Assembly
for an advisory opinion; Part II contains documentation relating to the
United Nations operations in the Congo; Part III contains documentation
relating to the operations of the United Nations Emergency Force; Part
IV contains a note on the records of the United Nations Conference on
International Organization, San Francisco, 1945, relating to the drafting
and adoption of Article 17, paragraph 2,of the Charter, and Part V a
note on the procedures and practices of the United Nations organs in
application of that Charter provision together with the related docu-
mentation. The Introductory Note refers to the relevant documents and
furnishes a chronological survey of the proceedings and decisions of the
United Nations relating to United Nations operatjons in the Republic
of the Congo and in the Middle East.
I will be glad to provide the Court with any additional United Nations
documentation or information in my possession which the Court might
find usefulin its consideration of the opinion requested by the General
Assembly.
1 would like to avail myself of this opportunity to draw the Court's
attention to documents Nos. (23)(seeA/C.5/864); (175 (seeA/3943) and
(184) (seeA/4176) contained in the dossier which set out the views of
my predecessor in regard to the financing of the United Nations opera-

En réponse à votre lettreno34891 du 27 décembre 1961 'ai l'honneur
de vous communiquer que la position de la République socialiste sovié-
tique d'Ukraine au sujet du financement des opérations d'urgence des
Nations Unies au Moyen-Orient et au Congo a été a maintes reprises
exposéedans les discours des représentants de l'Ukraine aux sessions de
l'Assembléegénéralede l'ONU.
Aux termes de la Charte des Nations Unies, la décisiondes questions
du financement des opérations de ce genre est uniquement de la compé-
tence du Conseil de Sécurité.Tel est justement le sens qui est donné à
l'article II de la Charte selon lequel toute question se rattachant au
maintien de la paix et de la sécuritéinternationales est renvoyée au
Conseil de Sécuritépar l'Assembléegénérale,avant ou après discussion.
Les articles43 et48 de la Charte fixent le droit exclusif du Conseil de
Sécuritéde prendre des décisionssur les questions concernant la partici-
pation de tel ou tel Etat aux actions ou aux opérations de l'ONU visant
à maintenir la paix et la sécurité ainsique sur l'étendueet les conditions
de la participation de tout Membre de l'ONU a ces opérations.
L'article 43 de la.Charte ne prévoit aucunement la création de forces
arméesde l'ONU, ilénonce seulement la mise à la disposition du Conseil
de Sécuritédes forces armées des États Membres des Nations Unies en
vertu d'accords spéciaux.
Aucun accord de ce genre ayant trait aux questions susnommées n'a
étéconclu par le Conseil de Sécurité,pour autant qu'on le sache. Guidés
par les considérations qui précèdent, nous sommes d'avis que les opéra-
tions de la Force d'urgence des Nations Unies dans le Moyen-Orient
ainsi que l'opération de l'ONU au Congo n'imposent aucune obligation
financière aux Membres de l'ONU étant donné que ces opérations sont
effectuéesen violation des obligations de la Charte des Nations Unies.
C'est précisément en raison de ces considérations que la délégation
d'Ukraine aux Nations Unies a voté contre la proposition touchant les
contributions pour l'application de ces opérations. Quant à laquestion
de savoir si lesdépenses entraînées par les opérations de l'ONU au Congo
et au Moyen-Orient sont des ((dépensesde l'organisation JJau sens de
l'article17, paragraphe 2, de la Charte, nous devons nous référer& la
réponse non équivoque que contient la résolution du 20 décembre de
l'Assemblée générala eu sujet des opérations desNations Unies au Congo,
résolution indiquant très nettement que (la nature des dépenses extra-
ordinaires afférentes aux opérations des Nations Unies au Congo est
essentiellement distincte de celle des dépenses de l'organisation inscrites
au budget ordinaire, si bien qu'il faut appliquer, pour les couvrir, une
procédure différente de celle qui est appliquée dans le cas dudit budgei).
Nous pouvons nous référerégalement aux résolutions antérieures de
l'Assemblée générale: aucune d'eIles ne considkre les dépenses de la
Force d'urgence de l'ONU comme les dépensesdel'organisation au sens
