Sir,
Upon the instruction of my Government, 1have the honor to transmit
to you herewith, in accordance with the Statute and Rules of the Inter-
national Court of Justice, an application' to the Court instituting
proceedings on behalf of my Government against the Government of
the Union of Soviet Socialist Republics. My Government has appointed
Mr. Herman Phleger, the Legal Adviser of the Department of,State,
asits Agent in this case.1 certify that the signature on the application
transmitted herewith is the signature of Mr. Phleger. The address for
service to which al1 communications relating to the application should
be sent is this Embassy.
For the pnrposes of the provisions of the Statute and the Rules of
Court, particularly Article40 (2)and (3) and Article 63 of the Statute,
and Article 33 (1)and Article34 of the Rules of Court. 1have the honor,
on behalf of my Government, to transmit with the original of this
application one hundred printed copies which 1 certify to be correct
copies of the original.

le zjuin 1955,le Gouvernement des Etats-Unis d'Amérique adéposéau
Greffe de 1;~Cour internationale de Justice une requête (avec annexes),
introduisant une instance contre le Gouvernement de l'Union des Répu-
bliques socialistes soviétiques. Cette requête fait état de certains actes

qui auraient étécommis par des chasseurs de l'aviation du Gouvernement
soviétique au large de Hokkaido, Japon, le 7 octobre 1952.
Sept exemplaires de cette requ>te dans l'édition qui a étédéposée
au nom du Gouvernement des Etats-Unis sont joints à la présente
lettre. Je vous en ferai prochainement parvenir d'autres exemplaires,
certifiés conformes. dans l'édition anglaise et française qui sera établie
par les soins du Greffeaux fins des communicationsà effectuer en confor-
mité de l'article 40, paragraphes2 et 3, du Statut.
A cette occasion, j'attire votre attention sur l'article 35 du Règlement
de la Cour qui dispose (par. 3) que la partie contre laquelle la requête

enclosed herewitli,1 have the honour to confirm that on June 2nd. 1955.
the United States Government submitted an Application instituting
proceedings against the Government of the Union of Soviet Socialist
Republics, alleging certain acts committed by fighter aircraft of the
Soviet Government against a United States Air Force B 29 Aircraft
and its crew off Hokkaido, Japan, on October 7th, 1952.
For your information, 1 am sending you herewith an advaiice copy
of this Application and its annexes.
1 should be grateful if, in accordance with Article 40, paragraph 3,
of the Statute of the Court, you would be good enough to notify the
Members of the United Nations of the submission of this Application.
For tliis purpose 1shall fonvard to you in the next few days 75 certified
true copies and 300 copies of the Application.

J'ai l'honneur de communiquer ce qui suit :
En rapport avec la lettre de la Cour internationale de Justice du
4 juin 1955 no 22247. le Gouvernement de l'union des Républiques
socialistes soviétiques a l'honneur de porter à la connaissance de la
Cour qu'il estime inacceptable la proposition du Gouvernement des
Etats-Unis d'Amériqued'examiner à la Cour interiiationale de Justice
l'affaire concernant le bombardier américain cB-zg» qui a violé le
7 octobre 1952 la frontière d'Etat de l'URSS.
Dans sa dernière note sur cette question en datedu 30 décembre1954,

adressée au Gouvernement des États-Unis d'Amérique, le Gouverne-
ment de l'URSS a indiqué qu'autant que l'avion militaire américain a
violéla frontière de l'URSS et sans aucune raison a ouvert le feu sur
les avions de chasse soviétiques, la responsabilité pour l'incident qui a
eu lieu et ses conséquencesincombe entièrement à la partie américaine ;
dans ces conditionsle Gouvernement soviétiouene ~ëut nas , . rendreen

soviétique estime que dans ce cas-là ne surgit aucune question qui
aurait besoin de la résolutionde la Cour internationale de Justice et ne
voit pas de raisons pour que cette question soit examinée à la Cour
internationale de Tustice.
