provisionnel, alors que les gouvernements alliés avaicnt disposé
de plus de deux ans pour administrer la preuve clelcurs allégations.
L'autorité de recours décida cn corisEquence, le 5 jaiivier 1948,
dc lever le blocagc d'lnterhandel avec eEet retruactif (ai-incse 3).
Conforméinent aux dispositions de l'Accord cle kVasliiiigtori,
l'autorité suisse dc rccours notifiasa iiCcision i la C:onitnission
mixte. hlaiç les gouvernements alliés iic firent poiiit usage clc 1;i
faculté que leur accordait l'article III de l'Annexe ri 1'Accorrlde
Washington de sriumettre le diflbrend au tribunal arbitral prkvu
par ledit Accord. Dans ces conditions, la dkcision dc 1':iuturité
de recours confirmant le cûractCrc non-allemalid d'lntcrliandcl
acquit force de chose jugSe et devint doilc opposiible ri tous Ics
États parties k l'Accord.

4. En dépit de ce qui préciide, les autoritEs arnkricaincs rciii-
shrent catigoriquement de fairedroit aux requCtcs suisscs clq~natl-
dant la libération desactions G. A. F. qui se trouvriicnt aux Etats-
Unis. L'&change de notes qui intervint b cc sujct etitre les cleux
Gouvernements fit apparaître dc part et d'autre des points clevuc
diamétralement opposés. (Voir les communications des 4 niai 1948,

suisse d'lntcrhandel. On demandait en ccins&queilce que, confor-
mement au droit intcrnationül général et plus sl~éçinlcmcnt cn
application de l'articleIV de l'Accord de Washirigtoii, lcs avoirs
de la société se trouvant aux Etats-Unis fussent libcrhs ciltant
que biens appartenant à des rcssortissantç d'un pays neutre. On
ajoutait que le Gouvernement antériçain ne pouvait ~ncttrc en
doute le caractère suissed'Interhande1 à la suite des constata t'ns
et expertises f~itc tsnt par l'Oflicesuissedc coinpcnsatiui~
par l'autoritéde recours et çontrc lesrluclles le Gouvcriicniciit
ambricain n'avait poirit recouru, comme il en avait pourtant la
faculté. De son coté, l'adininistratioiîaméric;iinc coiîtestait que

l'Accord de Wasliingtuil fût riplilicablcaux avoirs cl'Intcrliantlcl

5. Quand il eut acquis la conviction que les autorités aniéricai~~es
ne se départiraient pas de leur refus de libérerlesactions G. A. F.,
le Gouvernertien t suisse proposa au Gouvcrnemen t clcs gtats-~iiis
d'engager avec lui des negociations pour rechercher une sulutio~r
amiable au différencl. 11renouvela cettc dcrnande à plusieurs repri-
ses (voir les notes des g avril 1953, L''déccrnbrc 1954 ct iilnrs

Aux termes des notes qu'il adressacn réponsc en dates dcs 27mai

1953et 7 juin 1955 (annexes II, rz), le Gouverneincnt arncricain
rejeta purernciit et simplement la proposition suisse, rlkclar;ii~t
qu'à son avis l'affaire Interhandel ressortissait exclusivcnzcri;ila

L'engagement de recourir à l'arbitrage est gétibral pour tout
différend concernant une prktention de nature juridéyuc; I'articlc V
