regard'ing the interpretatian of Article 4 of the Charter.
In conformity with the terms of the final paragraph of the Kesolution tuwnty
copies in English and one copy in French of the records of the zoqth, zogtii and

separate cover.

a Resolution in which it asked the International Court of Justice for an advisory

\Vith further reference to your two lctters (Nos. 3747 and 3748) both dated
December 12th. 1947, regarding a Kesulution adopted on November 17th. 1947.
by the General Assembly of the United Nations, which requesti the International
Court of Justice to render an advisory opinion on the conditions of admission of
a State to membership in the United Nations (Article 4 of the Charter). 1 have the
honour to submit hereunder a written stutement ofthis Governmenton the question
at issue.
Article 4 of the Charter of the United Nations provides :
"1. Xfemhership in the United Nations ia open to al1 other peace-loving
States iuhich accept the obligations contained in the present Charter and, in
the judgment of the Organiration, are able and willing to cirry put these
obligations.
2. The admission of any such State to membership in the United Nations
will be effected by a décision of the General Assembly upon the recommend-
ation of the Security Council."
Article 4thus expresslysets forth the conditions upon which a new Member may
he admitted. namely. that it should be a peace-loving State whieh accepti the
obligations contained in the Charter of the United Nations. and that said nation
k. in the judgment of the Organizatioo, able and willing to carry out those obliga-
tions. It is felt that in accordance with a familiar canon of hermeneuticç. this
express declaration of the terms of admission of a State precludes the imposition
of other conditions not set forth in the Charter.
A State which solicits membership in the United Nations is either qualified for
admission or not. Each application should be deeided on its own merit independ-
ently of any other application. It is believed that affirmative votes on applic-
ations for membership çhould be guided solely by the conviction thnt the applicant
%&te is worthy to be amember. uninflucnced by considerations wholly unconnected
with the'fitness of the applicant.
It is the view of tbiç Government, therefore, that aFilember of the United Pjations
which iç caUed upan, by virtue of Article 4 of the Charter, to pronaunce itself by
its vote. eitherin the Security Council or in the General Assembly, on the admission
of a State to memberçhip in the United Natipns. is not juridically entitled to make
its consent to the admission dependent on conditions not expressly provided by
paragraph I of the said Article. It is also suhmitted that such aMember, while it
recognizes that the conditions set fortb in Article 4 of the Charter are fulfilled by
the Statc concerned. cannot subject its affirmative vote to the additional condition
that other States be admitted to membership together with that State.

of admission of a State to membership in the. United Nations (Article 4 of the
Charter) submitted to the Court for an advisory opinion, the Court was prepared
to receive. before Fehmary gth. ig48, .written statements from Governments
signatory to the Charter, without prejudice to any oral statements for the purpose
of hearing u'hich it might hold public sittings.
1 have to-day the honour to inform Your Excellency that several States have
availed themselves of the opportunity of submitting written statements. You
will find herewith. for your information. a volume. printed by the Kegistry, in ,
which these statements are reproduced.
1 also have the honour, with reference to the provisions of paragraph 4 of the
above-mentioned Article of the Statute, to inform you that the President of th?
Court has decided to fix Thursday, April 15th. ,948. as the date for the opening
of the oral proceedings. If, on this occasion, your Government intends to present
an oral statement. 1 should be obliged if you would hc good enough to notify me
