The International Court of Justice, Composed as above, After deliberation, Having regard to Article 48 of the Statute of the Court and to Article 79bis, paragraphs 1 and 3, of the Rules of Court, Having regard to the Application filed in the Registry of the Court on 26 February 2022, whereby Ukraine instituted proceedings against the Russian Federation with respect to “a dispute . . . relating to the interpretation, application and fulfilment of the 1948 Convention on the Prevention and Punishment of the Crime of Genocide”, Having regard to the Order of 23 March 2022, whereby the Court fixed 23 September 2022 and 23 March 2023 as the respective time-limits for the filing of the Memorial of Ukraine and the Counter-Memorial of the Russian Federation, - 2 - Having regard to the Memorial of Ukraine filed on 1 July 2022, within the time-limit thus fixed; Whereas, on 3 October 2022, the Russian Federation filed preliminary objections to the jurisdiction of the Court and to the admissibility of the Application, and whereas a signed copy of those preliminary objections was immediately transmitted to the other Party; Whereas, accordingly, by virtue of Article 79bis, paragraph 3, of the Rules of Court, the proceedings on the merits are suspended and a time-limit has to be fixed for the presentation by the other Party of a written statement of its observations and submissions on the preliminary objections; Taking account of Practice Direction V, pursuant to which the time-limit for the presentation of such a written statement shall generally not exceed four months from the date of the filing of the preliminary objections, Fixes 3 February 2023 as the time-limit within which Ukraine may present a written statement of its observations and submissions on the preliminary objections raised by the Russian Federation; and Reserves the subsequent procedure for further decision. Done in English and in French, the English text being authoritative, at the Peace Palace, The Hague, this seventh day of October, two thousand and twenty-two, in three copies, one of which will be placed in the archives of the Court and the others transmitted to the Government of Ukraine and the Government of the Russian Federation, respectively. Vu la requête déposée au Greffe de la Cour le 26 février 2022, par
laquelle l’Ukraine a introduit une instance contre la Fédération de Russie
relativement à « un différend … concernant l’interprétation, l’application
et l’exécution de la convention de 1948 pour la prévention et la répression
du crime de génocide »,
Vu l’ordonnance du 23 mars 2022, par laquelle la Cour a fixé au 23 septembre
2022 et au 23 mars 2023, respectivement, les dates d’expiration des

Whereas, on 3 October 2022, the Russian Federation filed preliminary
objections to the jurisdiction of the Court and to the admissibility of the
Application, and whereas a signed copy of those preliminary objections
was immediately transmitted to the other Party;
Whereas, accordingly, by virtue of Article 79bis, paragraph 3, of the
Rules of Court, the proceedings on the merits are suspended and a timelimit
has to be fixed for the presentation by the other Party of a written
statement of its observations and submissions on the preliminary objections;
Taking account of Practice Direction V, pursuant to which the timelimit

Fixes 3 February 2023 as the time-limit within which Ukraine may present
a written statement of its observations and submissions on the preliminary

Vu le mémoire de l’Ukraine déposé le 1er juillet 2022, soit avant l’expiration
du délai ainsi fixé ;
Considérant que, le 3 octobre 2022, la Fédération de Russie a déposé
des exceptions préliminaires d’incompétence de la Cour et d’irrecevabilité
de la requête, et qu’un exemplaire signé de celles-ci a immédiatement été
transmis à l’autre Partie ;
Considérant qu’en conséquence, en vertu des dispositions du paragraphe
3 de l’article 79bis du Règlement, la procédure sur le fond est suspendue
et qu’il échet de fixer un délai dans lequel la Partie adverse pourra
présenter un exposé écrit contenant ses observations et conclusions sur les
exceptions préliminaires ;
Compte tenu de l’instruction de procédure V, aux termes de laquelle le
délai pour la présentation d’un tel exposé écrit ne devra en général pas
excéder quatre mois à compter de la date de présentation d’exceptions
préliminaires,
Fixe au 3 février 2023 la date d’expiration du délai dans lequel
l’Ukraine pourra présenter un exposé écrit contenant ses observations et
conclusions sur les exceptions préliminaires soulevées par la Fédération
de Russie ;
Réserve la suite de la procédure.
Fait en anglais et en français, le texte anglais faisant foi, au Palais de la
Paix, à La Haye, le sept octobre deux mille vingt-deux, en trois exemplaires,
dont l’un restera déposé aux archives de la Cour et les autres
seront transmis respectivement au Gouvernement de l’Ukraine et au
Gouvernement de la Fédération de Russie.
