Introductory Note
30 January 2025
I. Background
1. On 19 December 2024, the United Nations General Assembly adopted resolution 79/232 entitled “Request for an advisory opinion of the International Court of Justice on the obligations of Israel in relation to the presence and activities of the United Nations, other international organizations and third States”. Operative paragraph 10 of the resolution contains the following request:
The General Assembly,

10. Decides, in accordance with Article 96 of the Charter of the United Nations, to request the International Court of Justice, pursuant to Article 65 of the Statute of the Court, on a priority basis and with the utmost urgency, to render an advisory opinion on the following question, considering the rules and principles of international law, as regards in particular the Charter of the United Nations, international humanitarian law, international human rights law, privileges and immunities applicable under international law for international organizations and States, relevant resolutions of the Security Council, the General Assembly and the Human Rights Council, the advisory opinion of the Court of 9 July 2004, and the advisory opinion of the Court of 19 July 2024, in which the Court reaffirmed the duty of an occupying Power to administer occupied territory for the benefit of the local population and affirmed that Israel is not entitled to sovereignty over or to exercise sovereign powers in any part of the Occupied Palestinian Territory on account of its occupation:
What are the obligations of Israel, as an occupying Power and as a member of the United Nations, in relation to the presence and activities of the United Nations, including its agencies and bodies, other international organizations and third States, in and in relation to the Occupied Palestinian Territory, including to ensure and facilitate the unhindered provision of urgently needed supplies essential to the survival of the Palestinian civilian population as well as of basic services and humanitarian and development assistance, for the benefit of the Palestinian civilian population, and in support of the Palestinian people’s right to self-determination?

2. The certified true copies of the resolution, in English and in French, were transmitted to the International Court of Justice (hereinafter, “the Court”) under cover of a letter dated 20 December 2024 from the Secretary-General of the United Nations to the President of the Court. In his letter, the Secretary-General informed the President of the Court that, pursuant to Article 65, paragraph 2, of the Statute of the Court, the United Nations Secretariat would prepare a dossier containing a collection of all relevant documents that are likely to throw light upon the question referred to above, to be transmitted to the Court in due course.
II. Framework of the Dossier
3. The dossier consists of two parts. Part I contains material relating to the adoption of the resolution containing the request by the General Assembly for an advisory opinion of the Court.
4. Part II comprises material of the United Nations relating to the question before the
Court. In view of the fact that the General Assembly’s question concerns the Occupied Palestinian Territory (hereinafter, “the OPT”) and of the time constraints associated with the General Assembly’s request for an advisory opinion “on a priority basis and with the utmost urgency”, Part II retains the structure of and documents contained in the dossier provided by the Secretariat to the Court in connection with the General Assembly’s request in resolution 77/247 of 30 December 2022 for an advisory opinion on the Legal Consequences arising from the Policies and Practices of Israel in the Occupied Palestinian Territory, including East Jerusalem, delivered by the Court on 19 July 2024 (“the previous dossier”). The retained sections or sub-sections have been updated by adding documents issued since the submission of the previous dossier. Part II also includes additional sections or sub-sections containing documents pertaining to the question asked to the Court in resolution 79/232.

Part II is divided as follows: (a) General Assembly and Economic and Social Council (hereinafter, “ECOSOC”) Documentation; (b) General Assembly Emergency Special Sessions Documentation; (c) Security Council Documentation; (d) Human Rights Documentation; (e) Relevant Instruments; and (f) Other Documents Without Document Symbols. An overview of these sections and sub-sections therein can be found further below in the present introductory note. For ease of use, the newly included sections or sub-sections are indicated in the present introductory note with asterisks on the headings of those sections.
6. The dossier is generally comprised of United Nations documents bearing an official document symbol of the United Nations published from 1967, the year in which the occupation began, through the present. Documents that are primarily administrative or procedural in nature are not included. Letters from individual Member and Observer States, even if circulated as United Nations documents, are not included, with the exception of those that are contained in a

report of the Secretary-General or provide additional and useful context to a particular document. Sections II (E) entitled “Relevant Instruments” and II (F) entitled “Unpublished Communications to Israel” include documents that relate to the question before the Court but do not bear an official document symbol.
7. The present introductory note is accompanied by an annex which contains a list of all documents in the dossier. In Part II of this list of documents, new documents are sequentially numbered alongside the letter “N” (indicating that they are new documents), starting with N1. The numbering of documents contained in the previous dossier remains unchanged.
III. Part I: Material relating to the Request by the General Assembly for an Advisory Opinion of the Court
8. Part I of the dossier contains those documents pertaining to the adoption of General Assembly resolution 79/232.
IV. Part II: Material of the United Nations Relating to the Question before the Court
A. Section II (A): General Assembly and ECOSOC Documentation
1. Types of documents contained in this section
9. Given the significant volume of documentation of the General Assembly and ECOSOC concerning the OPT and on the presence and activities of the United Nations in and in relation to the OPT, this part of the dossier mainly contains resolutions of the General Assembly and ECOSOC and reports to those principal organs that provide a substantive overview of the situation in the OPT and of the presence and activities of the United Nations in and in relation to the OPT. Some relevant letters published as official documents of the General Assembly have also been included.
10. Given the volume of official records of the relevant meetings of the General Assembly and its subsidiary organs, these have not been included. For similar reasons, the reports and documents of the relevant committees of the General Assembly have not been included as the outcome of the committees’ deliberations is generally contained in the resolutions of the General Assembly.
11. In instances where similar information appears in multiple documents of the General Assembly, such as a source document and a summary document, the source document has been included in the dossier rather than the summary or reporting document.
2. Structure of this section

12. Section II (A) is divided into 11 sub-sections as outlined further below. Sub-sections II (A)(1) to II (A)(8) correspond to the same sub-sections in the previous dossier. Some official documents which belong to one of those sub-sections and were issued after the submission of the previous dossier, as well as other relevant official documents which were not included in the previous dossier, have been added to the relevant sub-sections.
13. Sub-section II (A)(9), entitled “United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA)”, which was also in the previous dossier, has been retained, but contains the following three new items: item l. entitled “General Assembly resolutions concerning assistance to Palestine refugees”; item m. entitled “General Assembly resolutions concerning UNRWA and the proposed programme budget”; and item n. entitled “Letters to the President of the General Assembly”.
14. As far as item l. is concerned, General Assembly resolutions concerning assistance to Palestine refugees were part of the resolutions on UNRWA (contained in item a. of Part II (A)(9)) until the fiftieth session and became stand-alone resolutions as of the fifty-first session. Therefore, the stand-alone resolutions on assistance to Palestine refugees have been included in item l. so that all of the resolutions on this subject are under sub-section II (A)(9). With respect to item n., it contains letters of the Secretary-General (some of which are identical letters to the President of the General Assembly and the President of the Security Council) and a letter of the Permanent Representative of Israel to the United Nations addressed to the President of the General Assembly and the President of the Security Council concerning UNRWA which have been issued as official documents from October 2024 onwards. Additional, unpublished correspondence from the Secretariat concerning UNRWA is contained in section II (F).
15. Two new sub-sections added in section II (A) are as follows: sub-section II (A)(10) entitled “Assistance to the Palestinian People” and sub-section II (A)(11) entitled “Safety and security of humanitarian personnel and protection of United Nations personnel”.

16. This sub-section contains:

Sub-section II (A)(4): Permanent Sovereignty over Natural and National Resources
19. This sub-section contains:

23. 26. This sub-section contains:

B. Section II (B): General Assembly Emergency Special Sessions Documentation
27. This section contains General Assembly resolutions from its fifth, seventh, ninth and tenth emergency special sessions and reports of the Secretary-General to the General Assembly.21 Resolutions adopted in 2023 and 2024 by the General Assembly at its tenth emergency special session have been added to the resolutions of the tenth emergency special session which were already in the previous dossier. A letter of the Secretary-General on the implementation of General Assembly resolution ES-10/26 entitled “Demand for ceasefire in Gaza” has also been added to the dossier.22

C. Section II (C): Security Council Documentation
28. This section contains documentation of the United Nations Security Council relating to:
1. The situation in the OPT;
2. The safety and security of humanitarian personnel and United Nations and associated personnel. *
29. Sub-section II (C)(1) contains all the documents which were included in the previous dossier concerning Security Council documentation, as well as relevant documentation which was not contained in the previous dossier. Sub-section II (C)(2) is an entirely new sub-section; the documents therein may throw light upon the question of the General Assembly.
30. For both sub-sections, documents are provided in chronological order and include: (i) Security Council resolutions; (ii) statements and notes by the President of the Security Council; (iii) Security Council Commission reports; (iv) Security Council press statements; (v) reports and notes of the Secretary-General to the Security Council; and (vi) letters from the Secretary-General to the President of the Security Council and letters to the Secretary-General.
31. The verbatim records of the Security Council have not been included in sub-section II (C)(1), with three exceptions. First, as in the previous dossier, the dossier includes verbatim records containing oral reports of the Secretary-General or his representative to the Security Council in response to Security Council resolution 2334 (2016). Second, the dossier includes the verbatim records containing oral reports of the Senior Humanitarian and Reconstruction Coordinator for Gaza pursuant to resolution 2720 (2023). Third, it contains verbatim records pertaining to relevant briefings of the Secretary-General or his representative since December 2024, as the last report of the Secretary-General on the Occupied Palestinian Territory covers the period up to 6 December 2024 (S/2024/913), and those briefings provide information on the events that have happened after that date.
D. Section II (D): Human Rights Documentation
32. This section corresponds to the section of the previous dossier concerning human rights documentation. It has been updated and contains relevant documents issued since the submission of the previous dossier. No new sub-sections have been added.
Sub-section II (D)(1): General Assembly
33. This sub-section contains:

a. Resolutions and a Note by the President of the General Assembly;
b. Reports of the Secretary-General;
c. Report of the Independent International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and Israel;

35. For the reports of special procedures mandate holders, only reports specific to the Occupied Palestinian Territory have been included. Reports by special procedures mandate holders that are not specific to the Occupied Palestinian Territory, but that include passages dealing with the Occupied Palestinian Territory, are not included.
Sub-section II (D)(3): Commission on Human Rights
36. This sub-section contains:
a. Resolutions on the human rights situation (1968-2005);
b. Resolutions entitled “The right of peoples to self-determination and its application to peoples under colonial or alien domination or foreign occupation” (1978-1985);

Sub-section II (D)(4): Treaty Bodies
37. This sub-section contains documents relating to the work of the following human rights treaty bodies: the Committee Against Torture; the Committee on Economic, Social and Cultural Rights; the Committee on the Elimination of Discrimination Against Women; the Committee on the Elimination of Racial Discrimination; the Committee on the Rights of the Child; and the Human Rights Committee.27
38. For each of these treaty bodies, the national (periodic) reports of Israel and the State of Palestine are included, as well as the concluding observations and recommendations adopted by such bodies, and the States’ follow-up comments or views in response to the concluding observations.28 Correspondence from these bodies seeking additional information prior to or following the submission of States’ reports, including “lists of issues”, and the replies from Israel or the State of Palestine to this correspondence, are not included in the Dossier.
Sub-section II (D)(5): Universal Periodic Review
39. This sub-section contains documents submitted or adopted in the context of the Universal Periodic Review (“UPR”):29

E. Section II (E): Relevant Instruments *
40. This section contains relevant instruments relating to the presence and activities of organizations of the United Nations system in the OPT, including those containing provisions on the legal status, privileges and immunities of the concerned entities.30 Such instruments have been concluded between the relevant organization and the Palestinian Authority, the Palestinian Liberation Organization or Israel. Upon request of the Secretariat, the following United Nations organs and specialized agencies submitted relevant instruments:
1. The following organs of the United Nations:
a. The United Nations Development Programme (UNDP);
b. The United Nations Office for Project Services (UNOPS); and
c. UNRWA; and
2. The following specialized agencies:
a. The Food and Agriculture Organization of the United Nations (FAO);
b. The International Labour Organization (ILO); and
c. The United Nations Educational, Scientific and Cultural Organization (UNESCO).
F. Section II (F): Other Documents Without Document Symbols *
41. This section contains some recent documents without document symbols which may be relevant to the question of the General Assembly. This section includes letters from the Secretary-General, notes verbales from the Office of Legal Affairs of the Secretariat of the United Nations, letters from the Ministry of Foreign Affairs of Israel and the Permanent Representative of Israel to the United Nations, and a report concerning UNRWA. Some letters from UNRWA to the relevant Israeli authorities which UNRWA provided to the Secretariat for the purpose of inclusion in the present dossier have also been included in this section.
42. Some of these communications relate to concrete cases in which UNRWA faced difficulties in carrying out its activities in the OPT. The purpose of including these
