ALLEGED VIOLATIONS OF THE 1955 TREATY OF AMITY, ECONOMIC RELATIONS, AND CONSULAR RIGHTS
(ISLAMIC REPUBLIC OF IRAN v. UNITED STATES OF AMERICA)
ORDER
Present: Vice-President GEVORGIAN, Acting President; Judges TOMKA, ABRAHAM, BENNOUNA, YUSUF, XUE, SEBUTINDE, BHANDARI, ROBINSON, SALAM, IWASAWA, NOLTE, CHARLESWORTH, BRANT; Registrar GAUTIER.
The International Court of Justice,
Composed as above,
After deliberation,
Having regard to Article 48 of the Statute of the Court and to Article 44, paragraph 3, of the Rules of Court,
Having regard to the Application filed in the Registry of the Court on 16 July 2018, whereby the Islamic Republic of Iran (hereinafter “Iran”) instituted proceedings against the United States of America (hereinafter the “United States”) concerning alleged violations of the Treaty of Amity, Economic Relations, and Consular Rights, which was signed by the two States in Tehran on 15 August 1955 and entered into force on 16 June 1957,
Having regard to the Order dated 21 January 2022, whereby the Court authorized the submission of a Reply by Iran and a Rejoinder by the United States, and fixed 21 November 2022 and 21 September 2023 as the respective time-limits for the filing of these pleadings,
- 2 -
Having regard to the Order dated 20 October 2022, whereby the Court extended to 21 December 2022 and 23 October 2023, respectively, the time-limits for the filing of the Reply of Iran and the Rejoinder of the United States,
Having regard to the Reply of Iran filed within the time-limit thus extended;
Whereas, by a letter dated 5 September 2023, the Agent of the United States, referring to the time allotted to Iran for the preparation of its Reply and to the voluminous documentary material annexed thereto and the new arguments presented therein, requested the Court to grant an extension of approximately three months, until 15 January 2024, for the filing of the Rejoinder;
Whereas, on receipt of that letter, the Registrar immediately transmitted a copy thereof to Iran, in accordance with Article 44, paragraph 3, of the Rules of Court;
Whereas, by a letter dated 12 September 2023, the Co-Agent of Iran stated that his Government opposed the request of the United States, arguing that the time-limits for the filing of the Reply and the Rejoinder were fixed in accordance with the Court’s standard practice and that the documentary evidence annexed to the Reply of Iran merely contains a more detailed description of the United States’ measures and elucidates their various impacts on Iran and Iranian companies and nationals;
Taking into account the views of the Parties,
Extends to 15 December 2023 the time-limit for the filing of the Rejoinder of the United States of America; and
Reserves the subsequent procedure for further decision.
Done in English and in French, the English text being authoritative, at the Peace Palace, The Hague, this eighteenth day of September, two thousand and twenty-three, in three copies, one of which will be placed in the archives of the Court and the others transmitted to the Government of the Islamic Republic of Iran and the Government of the United States of America, respectively.
Kirill GEVORGIAN,
Vice-President.
Philippe GAUTIER,
Registrar.
