ANSWER TO JUDGE DONOGHUE'S QUESTION
Question : Nicaragua bas made written and oral sùbmissions to the Court regarding
Costa Rica's Application to intervene.d concerns about Costa Rica's
Application but its submissions, with respect to this particular Application, do not
expressly state that Nicaragua opposes the granting of permission to intervene.
Therefore, question is: Does Nicaragua oppose intervention by Costa Rica?
Ispite of the important burden they impose to the Parties to the main case, Nicaragua
has no oppositionnciple against interventions provided it is established that the State(s) seeking
to intervene show that they have a legal interest which may be affected by the future decision of the
Court. While it already expressed strong doubts legal interest ofthat nature in the
present case in its Written Observations, the hearings of last week have finally convinced Nicaragua
that this was not the case.
The answer to Judge Donoghue's question is therefore that the Republic of Nicaragua
does oppose intervention by Costa Rica case.
