ORDER

Present: Acting President ELIAS ; Judges FORSTER,GROS, LACHS,
Mo~ozov, NAGENDRA SINGH,MOSLER,ODA,AGO, SETTE-
CAMARAE , L-KHANI,SCHWEBE ;LJudge ad hoc COHEN(in
attendance at the invitation of the Cou;Registrar TORRES
BERNARDEZ.

The International Court of Justice,

Composed as above,
After deliberation,

Havingregard toArticle 48of theatute of theCourt,and toArticle 44,
Article 46 and Article 92, paragraph 1, of the Rules of Court,
Having regardto the SpecialAgreement concluded on 29 March 1979,
and subsequently altered, between Canada and the United States of
America to submit to achamber of the Court the delimitation of the
maritime boundary in the Gulf of Maine area,

Havingregard to therder of20January 1982accedingto therequest of
the Parties to form a special chamber of fivejudges to deal with the case,
and declaring a chamber to have been duly constituted to that effect,

Makes thefollowing Order:
Whereas Article VI, paragraph 1, of the Special Agreement recites in
terms the agreement of the Parties that, without prejudice to any question
as to burden of proof, the following procedure should be observed with
regard to the written pleadi:gs(a) a Memorial to be subrnitted by each Partynot later than sevenmonths
after the Registrar shall have received notification of the .lame of the
judge ad hoc,
(6) a Counter-Memorial to be submitted by each Party not later than six

months after the exchange of Memorials, and
(c) any further pleadings found by the Chamber to be necessary;
Whereas the Registrar on 26 January 1982received notification of the
name of thejudge adhocchosen by the Government of Canada to sitin the
case ;

Having consulted the Chamber and ascertained the views of the
Parties,

by ten votes to two,

Reserves the subsequent procedure for further deasion.

Done in English andin French, the English text being authoritative, at
the Peace Palace, The Hague, this first day of February,one thousand nine
hundred and eighty-two, in three copies,one of which willbe placed in the
archives of the Court, and the others transmitted to the Government of

Canada and to the Government of the United States of America, respec-
tively.

Canada et les Etats-Unis d'Amérique en vuede soumàtune chambre
de la Cour la question de la délimitationde la frontière maritime dansla
régiondu golfe du Maine,

Vu l'ordonnance du 20janvier 1982accédaàla demande des Parties
en vue de former une chambre spécialede cinq juges pour connaître de
l'affaire, et déclarantla chambre dûment constituéeeffet,
Rend l'ordonnance suiva:te

Considérant que, dans son article VI, paragraphe 1,le compromis fait
expressément état d'un accord des Parties selon lequel, sans préjuger
aucune question relatiàla charge de la preuve, la procéduresuivante
serait observéeau regard des piècesde procédure :crite(a) a Memorial to be subrnitted by each Partynot later than sevenmonths
