the above-mentioned case,

After deliberation,
Having regard to Article48ofthe Statute ofthe Court,

MakesthefollowingOrder:
Having regard to Article IV of the Special Agreement concluded be-

tween the Parties on 16September 1983forthe submission oftheir fron-
tierdisputetoa chamber oftheCourt, wherebythe Parties agreedto effect
the demarcation oftheir commonfrontier inthedisputed area withinone
yearfollowingtheJudgment ofthe Chamber, and to requestthe Chamber
"to nominate, initsJudgment, three expertsto assistthem inthe demarca-
tion operation",
Having regard to the Judgment delivered by theChamber on 22 De-
cember 1986,paragraph 176of which State:

"The Chamber is ready to accept the task which the Parties have
entrusted to it. However, having regard to the circumstances of the
present case,the Chamber is ofthe opinionthat it isinappropriate at
thisjuncture to makethe nomination requested bythe Parties. It will
do so later by means of an Order, after ascertaining the viewsof the
Parties,particularly asregardsthe practical aspectsofthe exerciseby
the experts of their functions", FRONTIER DISPUTE (ORDER 9 IV 87) 8

Whereasthe Parties are requestingthe Chamber,not to order an expert
opinion within the meaning of Article 50of the Statute of the Court, the
purpose of which would be "to assistthe Court in givingjudgment upon
the issuessubmitted to it for decision" (ApplicationforRevisionandInter-
pretation oftheJudgment of24 February1982in the case concerningthe
Continental Shelf (Tunisia/Libyan Arab Jamahiriya) (Tunisiav. Libyan
Arab Jamahiriya), I.C.J.Reports 1985, p. 228,para. 65),and any costs of
which would be borne by the Court under Article 68 ofits Rules,but to
exercisea power, conferred upon it by the SpecialAgreement,of nomin-
ating three persons whom the Parties have themselvesdecided to entrust
withthe task ofgivingan expertopinion for the purpose ofimplementing

the Judgment ofthe Chamber;
Whereas there is nothing in the Statute of the Court nor in the settled
jurisprudence to prevent the Chamber from exercising this power, the
verypurpose of whichisto enablethe Partiesto achieveafinal settlement
oftheir disputeinimplementation ofthe Judgment whichithasdelivered;

1. Nominates, pursuant to Article IV, paragraph 3, of the Special
Agreement,the following three experts who will assistthe Parties in the

operation of demarcation oftheir frontier in the disputed area:
Mr. Gilbert Mangin, of French nationality, conseilleratthe Courde cas-
sation of France;
Mr. Zaki Belcaïd, of Algerian nationality, ingénieurdes travaux géo-
graphiques et cartographiques de 1'Etat(Ecole nationale des sciences
géographiquesde Paris) ;
Mr. Petrus Richardus, of Dutch nationality, GeodeticConsultant, former
Chief Scientistof the Agricultural Universityof Wageningen (Nether-

lands).
2. Authorisesits President, in the event of a vacancy in the group of
three expertsthus appointed, to nominate asubstituteto carryoutorcom-
plete the demarcation.

Done in French and in English,the French text being authoritative, at
the Peace Palace,The Hague, this ninth day of April, one thousand nine

hundred and eighty-seven,in three copies, ofwhich one willbe placed in
the archives of the Court and the others transmitted respectivelyto the
Government of Burkina Faso and to the Government of the Republic of
Mali.

Considérantque rien dans leStatut de la Cour ni dans lajurisprudence
établiene s'opposeàceque la Chambre exerce cepouvoir, dont lebut est
précisémend tepermettre aux Parties de parvenià un règlementdéfinitif
deleur différend en applicationde l'arrêt qu'ea rendu;

1. Désignec,onformément àl'articleIV,paragraphe 3,du compromis,
lestrois expertssuivantsqui assisteront lesPartiesaux fins de l'opération
de démarcationde leur frontière dans la zone contestée:

M. Gilbert Mangin, de nationalité française, conseilàela Cour de cas-
sation de France;
M. Zaki Belcaïd, de nationalité algérienne, ingénieur des travaux géo-
graphiques et cartographiques de 1'Etat(Ecole nationale des sciences
géographiquesde Paris);
M. Petrus Richardus, de nationalité néerlandaise, expert consultant en
géodésie,ancien directeur scientifiquà l'université agronomiquede
Wageningen (Pays-Bas).

2. Autorisesonprésident,au casou ilseproduirait unevacance au sein
du groupe des trois experts ainsinommés,àdésignerun suppléantpour
effectuerou acheverl'opérationde démarcation.

Fait enfrançais etenanglais,letextefrançaisfaisantfoi, au palais dela
Paix, à La Haye, le neuf avril mil neuf cent quatre-vingt-sept, en
trois exemplaires, dont l'un restera déposé aux archivesde la Cour et les
autresseronttransmisrespectivement au Gouvernement du BurkinaFaso

et au Gouvernement de la Républiquedu Mali.
