PREVENTION AND PUNISHMENT OF THE CRIME OF GENOCIDE

(UKRAINE v. RUSSIAN FEDERATION)

 

ORDER

 


The President of the International Court of Justice, 
Having regard to Article 48 of the Statute of the Court and to Article 44, paragraph 3, of the
Rules of Court, 
Having regard to the Order of 2 February 2024, whereby the Court fixed 2 August 2024 as the
time-limit for the filing of the Counter-Memorial of the Russian Federation; 
Whereas, by a letter dated 25 July 2024, the Agent of the Russian Federation requested the
Court to grant an extension of the time-limit for the filing of the Counter-Memorial until 2 February
2025; whereas, in his letter, the Agent stated that the scope of the proceedings in the case had changed
significantly following the Judgment rendered by the Court on 2 February 2024 on the preliminary
objections presented by the Russian Federation; whereas the Agent referred to the complexity of the
case, which raised issues of fact involving voluminous evidence, including witness evidence from
persons residing in areas affected by ongoing armed conflict; whereas the Agent further referred to
parallel proceedings between the Parties in other fora and to the number of declarations of
intervention filed in the present case; 
Whereas, on receipt of that letter, the Registrar immediately transmitted a copy thereof to
Ukraine, in accordance with Article 44, paragraph 3, of the Rules of Court; 
Whereas, by a letter dated 29 July 2024, the Agent of Ukraine stated that his Government was
of the view that the Court should reject the request of the Russian Federation; whereas, in particular,
the Agent referred to the “legal interest” that Ukraine has under the Convention on the Prevention

and Punishment of the Crime of Genocide to have the Court resolve without delay the dispute
concerning the Russian Federation’s “false allegations of genocide against Ukraine”; whereas,
according to the Agent, the Russian Federation has had ample time to collate evidence for the
purposes of its Counter-Memorial; and whereas the Agent dismissed as lacking in substance the
arguments made by the Russian Federation that it required additional time as a result of the parallel
proceedings between the Parties in other fora and the number of declarations of intervention filed in
the present case; 

Taking into account the views of the Parties, 

Extends to 16 September 2024 the time-limit for the filing of the Counter-Memorial of the 
Russian Federation; and 

Reserves the subsequent procedure for further decision.


Done in English and in French, the English text being authoritative, at the Peace Palace, The
Hague, this thirtieth day of July, two thousand and twenty-four, in three copies, one of which will be
placed in the archives of the Court and the others transmitted to the Government of Ukraine and the
Government of the Russian Federation, respectively.
