Sir,
1 have the honour, upon the instructions of His hlajesty's

Principal Secretary of Statc for Foreign Affairs, to transmit to
you, with rcference to paragrapI of Articl40 of the Statuteof
the Court and to paragrapiixof Article 32 of the RuleofCourt,
tlieenclosed certified copy oa Special Agreement between the
Government of the United Kingdoni of Great Britain and Northern
Ireland and the Government of the French Republic signed on the
tmenty-ninth day of Decernber,1950 he instruments of ratifica-
tion in respect of which were exchangedat Parison the twenty-
fourth day of September, 19j1,to submit to the Courta dispute
which has arisen between them as a result of claims hy each of
them JO sovereignty over tlie islets and 'rocks in the Minquiers
and Lcréhous groups, alid to request you to bring tlie above-
mentioned Agreement before the Court.
1.have also the honour to inform you, in conformity with para-
graph r of Article 35 of the Rules of Cou~t,tMT.R. S. B. Best,
'Third Legal Adviser to the Foreign Office, has been appointed
Agent oftheGovernment of the United Kingdom for the purposes
of this case and that this Embassy is the permanent arldress at
the seat of the Court to which notices and communications intended
for the Agent of the Goverliment of the United Kingdom in regard
to this case should be sent.

SPECIAL AGREEMENT FOR SUBMISSION TO THE INTEK-

NATIONAL COURT OF JUSTICE OF DIFFERENCES
BETWEEN THE UNITED KINGDOM OF GREAT BRITAIN
AND NORTHERX IRELAND AND THE FRENCH REPUBLIC

CONCERNING SOVEREIGNTY OVER THE NINQUIERS
AND ECREHOS ISLETS

The Government of the United Kingdom of Great Britain and
Northern Ireland and the Government of the French Republic ;

Considering that differences have arisen between thern as a result
of claims by each of them to sovereignty over the islets and rocks
in the Minquiers 'and 1Screhosgroups;

Ilesiring that these differences should be settled by a decisioii
of the International Coiirt of Justice determining their respective
rights as regards sovereignty over those islets and ro;ks
Ilesiring to define the issues to be submitted to the International
Court of Justice;
Have agreed as follows :

The Court is requested to determine whether the sovereignty
over the isIets and rocks (in so far asthey are capable of appro-
priation) of the Minquiers and Ecrehos groupç respectively belongs
to the United Kingdom or the French Republic.

Without prejudice to aily question as to the hurden of proof,
the Contracting Parties agrec, having regard to Article 37 of the
Rules of Court, that the written proceedings should co~isist of
(1) a United Kingdorn memorial to bc submitted within three

montlis of the lotif fi cofithe liresent Agreement to the
Court in pursuanceof Article III below;
(2) a French cotinter-mcmorial to be submitted within three
months of delivery of the United Kingdom memorial;

(3) a United Kingdoin reply followed by a French rejoinder to
be delivered withinuch timesas the Court may order.IO SPECIAL AGREEJIEST (29 XII 50)

ARTICLEIII

Upoii the entry into forcc of the present Agreement, it rnay be
notified to the Court under Article 40 of the Statute of the Court
by either of the Contracting Parties.

(a) The present Agreement shall be subject to ratification.
(b) The i~lstrumcnts of ratification shall be exchangedas soon
as,possible in Parisand the present Agreement shall enter into force
immediately upo~ithe exchange of ratifications.

In witness whereof the undersigned, being duly authorized
thereto by thcir respective Governments, have signed the present
Agreement and have affixed thereto their scals.

Done in duplicate in London, the 29th day of December, 1950,
in English and French, both texts being equally authoritative.

24th September, 1951, by instruments of ratification exchanged
at Paris in accordance with the terms of Article IV (b) of thSAID
Agreement .

objet de soumettre à la Cour ut1différend qui est survenuB la

Cour le compromis précité.

DE JUSTICE LES DIFFÉRENDS EXISTANT ENTRE LA
RÉPUBLIQUE FRANCAISE ET LE ROYAURIE-UNI DE

GRANDE-BRETAGNE ET n'IRLANDE DU NORD
CONCERNANT LA SOUVERAINETÉ SUR LES ILOTS DES
MINQUIERS ET DES ÉCKÉHOUS

Le Gouvernement de la République française et le Goiiverne-
ment du Royaume-Uiii de la Grande-Bretagne et de l'Irlande du

Considérant que des différends sont survenus entre eux A la
suite de revendications de souveraineté de la part cle l'une et
l'autre partie sules ilots et rocherdes groupes des Minquiors et
des Écréhous ;
Désirant que ces différends soient résoluspar une décisionde la
Cour internationale de Justice qui déterminera leurs droits respec-
tifs quantà la souveraineté sur ces îiots et rochers ;
Désirant qiie soient définiesles questionà soumettre a la Cour
internationale de Justice;
Sont convenus de ce qui suit :

La Cour est priCe de déterminer si la souveraineté sules îlots
et rochers des groupes des Minquiers, d'une partet des Écréhous,
d'autre part, dansla mesureoù ces îlots et rochers sont susceptibles
d'appropriation, appartient à la République française 01.1au
Royaume-Uni.

Sans préjuger en rien de la charge de la preuve, les Parties
contractantes sont convenues, se référantà l'article 37 du RègIe-
ment de la Cour, que la procédure écrite consisterait en :

'I) un memoire di1 Royaume-Uni devant être soumis à la Cour .
dans les trois mois qui suivront la notification du présent
accord prévue à l'article III ci-apr;s

2) un contre-mémoire français devant être soumis dans les
.trois mois qui suivront la remise du mémoiredu lioyaume-
Uni ;
3) une réplique du Royaume-Uni, suivie d'une duplique de la
France, devant êtresoumises l'une et l'autre dans un délai

par l'une ou l'autre des Parties contractantes.

possible à Paris et le présent accord entrera en vigueur irnmé-
ciiatcrnent après l'échangecles ratifications.
