Sir,
1 have the honour to iliform you that the Executive Board of

the United Nations Educational, Scientific and Cultural Organi-
zation, by a resoIution adopted at its 42nd session on November
~Sth, 1955, acting within the framework of Article XII of the
Statute ofthe Adrninistrat~ve Tribunal of the International Labour
Organisation, decided tochallenge the decisions rendered by the
Tribunal on April zSth, 1955 ,n the Leff, Duberg and Wilcox cases
and on October zgth, 1935,in the Bernstein case, and to refer the
question of their validity to the Ii~ternational Court of Justice.

Accordingly, the Executive Board of the United rùations Educa-
tional, Scientific and Cultural Organization, by a resolution adopted
at its42ndsession on Novernber 25th, 1955, decided torequest the

International Court of Justice togive an advisory opinion on the
following questions :
"Having regard to the Statute of the Administrative Tribunal
of the InternationaLabour Organisation ;

Having regard to the Staff Regulations and Staff Rulesof the
United Nations Educational, Scientific and Cult~zraOrgani-
zation, and to anyother relevant texts ;
Having regard to the contracts of appointment of Messrs.
Dubesg and Leff and Mrs. Wilcox and Mrs. Bernstein :

1.-Was the AdministrativeTribunal comptent, under Article

The Execzttive Board,

Whereas, by its JudgrnentsNos. 17, 18 and rg of 26 April 1955,
and No. 21of 29 October 1955,the Administrative Tribunal ofthe
International Labour Organisation confirrned its jurisdiction in
the cornplaints introduced by Messrs, Duberg and Leff and Mrs.
Wilcox and Mrs.Bernstein against the United Nations Educational,
Scientific andCultural Organization,

Whereas Article XII of the Statute of the Administrative Tri-
bunal of the International Labour Organisation provides as
follows : REQUEST FOR ADVISOKY OPIHION (30 XI 55) IO

"1. In any case 111which the Executive Board of an inter-
national organization wbich haç made the declaration specified
in Article II, paragraph 5, of the Statute of the Tribunal chal-
lenges a decision of the Tribunal confirrning its jurisdiction, or
considers that a decision of the Tribunal is vitiated by a funda-
mental fault in the procedure followed, the question of the
validity of the decision given by the Tribunal shall be subrnitted
by the Executive Board concerned, for an advisory opinion, to
the International Court of Justice,

2. The opinion given by the Court çhall be binding."
Wh~reas the Executive Board, after consideration, wishes to
avail itselof the provisions of the said Article,

Decides to submit the following legal questions to the Inter-
national Court of Justice for an advisory opinion :

Having regard to the Statute of the Administrative Tribunal

Raving regard to the Staff Hegulatioils and Çtaff Rules of the
United Nations Educatioilal, Scientific and Cizltural Organi-
zation, and toaily other relevant texts ;

Nations Educational, Scientific and Cultural Organization in
force prior to and following the adoption of amendrnents to the
Constitution by the General Conference at itç eightk session heId
at Montevideo in November-Decemloer 1954.

5. Section II containç an extract of the Agreement between the
United Nations and Unesco reproducing the text of the Article
thereof dealing with the relations of the United Nations Educa-
tlonal,Scientific and Cultural Organization with the International
Court of Justice.
6. Section III coiltains official records bearing on the recognition
by the United Nations Educational, Çcientific and Cultural Organi-
zation of the cornpetence of the Administrative Tribunal of the
International Labour Organisation. Documents numbers (5),
(9) and (II) are notes subrnitted by the Director-General to the
Executive Board and the General Conference. Documents nurnbers
(4)) (6),(IO)and (rzj contain the texts of the various resolutions

adopted on the subjeçt by the Executive Board and the General
Conference and documents nurnberç (71, (8),(13)and (14 )eproduce
the texts of letters exchanged fortkat purpose between the Inter-
national Labour Organisation and the United Nations Eduçational,
Scientific and Cd tural Organization.
7. Section IV contains the documents (including summary
records, reports and decisionsjofthe 4znd session of the Executive
Board of the United Nations Educational, Scientificand Cultural
Organization which concern the adoption by the Board of the
resolution of 25 November 1955 .ocuments (rs) and (16)contain
the çumrnary record of the fourteenth and twenty-fifth meetings

of the Executive Board atwhich the rnatter was consideted. Docu-
ments numbers (r7) and (~g) deal with the communication toMem-
bers of the Executive Board of the texts ofthe judgments rendered FILE TRANSMITTET) BY U.N.E.S.C.O. 15
ordinary session ofthe General Conference. These documents deal
with such questions as the application to the United Nations
Educational, Scientificand Cultural Organization of Executive
Qrders ofthe President of the United States of America, provisions
of Staff Regulations concerning standards of integrity, common
personnel policy of the United Nations and the United Nations

Educational, Scientific and CuIturâl Organization, obligations
and rights ofstaff members, personnel recruitment standards and
methods, etc.
g. Section VI of the documentation contains documents relaéing
to the creation of the Administrative Tribunal of the League of
Nations. It contains the texts ofthe various draft statutes which
~esulted in the creation in 1927of the Administrative Tribunal of

the League of Nations, the statute of which became in 1946 the
Statute ofthe Administrative Tribunal of the International Labour
Organisation. Documents numbers (57) to (69) are reports and
minutes of meetings of the Superviçory Commission of the League
of Nations which was entrusted with thepreliminary studies on the
establishment of an Administrative Tribunal ; documents numbers
(70) to (72)relate to the proceedings of the Fourth C.ornmittee of
the Assembly anddocument nunlber (73) to the proceedings of the
Assernbly which adopted the Statute in plenary meeting.
IO. Section VI1 gives the textsof the judgments rendered by the
Administrative Tribunal oftlie International Labour Organisation
from 1947 to 1355, including judgments nurnbers 17, 18, 19 and 21
which gave rise to the questions submitted to the Court. The
texts of judgrnents numbers 17, 18and rg are dso found in annex
to a document subrnitted to the Executive Board and which con-

stitutes document numbes (17). The complete series is contained
in documents numbers (74) to (97).
11. Section VI11 of the documentation contains the complete
dossiers of the Du Berg, Leff, Wilcox and Bernstein cases as they
were subrnitted to the Administrative Tribunal of the International
Labour Organisation. The Du Berg, Leff and Wilcox dossiers
were submitted tothe Administrative Tribunal at the firspart of
its fifth session in April1955 ,he Bernstein dossier at the second
part of the çame session in October 1955.The written complaints
instituting proçeedings, togethes with the accornpanying documen-
tation, are found in documents numbers (98) to (1o8). Each
cornplaint submitted was accompanied by an individual documen-

tation. In addition, a general documentation was subrnitted
to the Administrative Tribunal at each of the two parts of
the session at which the cases were considered. The çtatements FILE THANSMITTED BY U.N.E.S.C.O. 16
subrnitted in these cases by Mr. Pierre Heilquet, President of the
Staff Association of the United Mations Educational, Scientific
and Cultural Organization. In documents (115)and (1x4 ) ilibe

found the stenographic records of the oral proceedings before the
Administrative Tribunal in the four cases. These records which
have been taken on behalf of the United Nations EducationaI,
Scientific and CulturalOrganization are unofficial in charactand
do not constitute officia1recordsof the Administrative Tribunal ;
Section VI11 also contains documents constituting the terms of
appointment ofthe fout cornplainants. These documents, numbers
(117 o (rzo), reIate to the original appointments, tproIongation
of the contracts and the expiration of the contracts of the cornplain-
ants.
12. In addition to the documents transmitted to the Court in
the present documentation, copies of the judgments rendered by
the Administrative Tribunal of the League of Nations during the
years 1929-194 a6d which fosm part of the historical backgroun'

of the questions submitted to the Court have been sent for the
files ofthe Registry of the Court. The texts of these judgments
