ORDER

The President of the International Court of Justice,

Having regard to Article 48 of the Statute of the Court and to
Articles31,44 and 79of the Rules of Court,
Having regard tothe Application filed by theRepublic of Nauru inthe
Registryof the Court on 19May 1989,institutingproceedings against the
Commonwealth of Australia in respect of a "dispute.overthe rehabili-
tation of certain phosphate lands [inNauru] worked out before Nauruan
independence",

Having regard to theOrder made by the Court on 18 July 1989by
which, interalia,21January 1991was fixed asthe time-limit forthe filing
ofthe Counter-Memorial of the Commonwealth of Australia,
Having regard to the preliminary objections filed by the Common-
wealth of Australia in the Registry of the Court on 16 January 1991,
whereby it asked theCourt to adjudge anddeclare "that the Application
by Nauru isinadmissible and thattheCourt lacksjurisdiction to hear the
claims made by Nauru",

Having regard to therder made by the Court on 8 February 1991,by
which 19July 1991was fixed as the time-limit for the presentation by
Nauru of a written statement of its observations and submissions on the
preliminary objections made by the Commonwealth of Australia, which
was duly filed within the time-limit so fixed; Whereas the Court, by itsJudgment of 26June 1992,has found: that it
hasjurisdiction to entertain the Application andthat theaid Application
is admissible; and that the claim concerning the overseas assets of the

British Phosphate Commissioners, made by Nauru in its Memorial of
20April 1990,isinadmissible;
Whereas a meetingbetween the President and the Agentsofthe Parties
forthe purpose ofascertaining their viewsonthefurther proceedings was
held on 29June 1992 ;
Whereas atime-limithas now to be fixedforthe Counter-Memorial of

the Commonwealth of Australia,
Fixes29 March 1993as the time-limit for the filing of the Counter-
Memorial of the Commonwealth of Australia; and

Reservesthe subsequent procedure for further decision.

Done in English and in French, the Englishtext being authoritative, at
the PeacePalace,TheHague,thistwenty-ninth day ofJune,onethousand
nine hundred and ninety-two,inthree copies, one ofwhich willbe placed
inthe archivesofthe Courtand theothers transmitted to the Government
