ORDER
The President of the International Court of Justice,
Having regard to Article 48 of the Statute of tlie Court and to
Article 88 of theules of Court,
Having regard to the Application filed by theslamic Republic of Iran
in the Registi-y of the Court on 17 May 1989 instituting proceediiigs
against the United States of America in respect of a dispute concerniiig
the interpretation and application of the 1944 Convention on Interna-
tional Civil Aviation and the 1971 Convention for the Suppression of
Unlawful Acts Against tlie Safety of Civil Aviation, which arosem the
destructioii of anranian aircraft, and the killing of its 290 passengers
and crew, on 3 July 1988,
Having regard to the notifications addressed, respectively, to the Inter-
national Civil Aviation Organization, pursuant to Article 34, para-
graph 3, of the Statute, and to the parties to the aforementioned
Conventions, pursuant to Article 63, paragraph 1, of the Statute,
Having regard to the Order made by the Court on 13December 1989
fixing 12June 1990as the time-limit for the filing of the Memorial of the
Isla~nicRepublic of Iran, and 10December 1990as the time-limit for the
filing of the Counter-Memorial of the United States of America,
Having regard to tlie Order made by the President of the Court on
12June 1990extending to 24 July 1990and 4 March 1991the time-liniits
for the filing of the Memorial and the Counter-Memorial, respectively, Having regard to the Memorial filed by the Islamic Republic of Iran
and the preliminary objections to thejurisdiction of the Court filed bythe
United States of America, within those extended time-limits,
Having regard to the Order made by the Court on 9 April 1991 fixing
9 December 1991as the time-limit within which the Islamic Republic of
Iran might present a written statement of its observations and submis-
sions on the preliminary objections raised by the United States of
America,
Having regard to the Orders made by the President of the Court on
18December 199 1and 5 June 1992extending successivelyto 9 June and
9 September 1992 the time-limit within which the Islamic Republic of
Iran might present such a written statement,
Having regard to the written statement of the observations and sub-
missions of the Islamic Republic of Iran on the preliminary objections,
filed within that extended time-limit,
Having regard to the written observations submitted by the Inter-
national Civil Aviation Organization on 4 December 1992 uiithin the
time-limit fixed by the President of the Court for thatpurpose, pursuant
to Article 69, paragraph 3, of the Rules of Court,
Having regard to the letter of 8 August 1994 by which the Agents of
the two Parties jointly i~lformedthe Court that their Governments had
"entered into negotiations that may lead to a full and final settlement of
[the]case" and requested the Court "[to postpone] sinedit.the opening of
the oral proceedings", for which it had fixed the date of 12 September
1994;
Whereas by a letter dated 22 February 1996, filed inthe Registry on
the same day, the Agents of the two Parties jointly notified the Court that
their Governments had agreed to discontinue the case because they had
entered into
"an agreement in full and final settlement ofal1disputes, differences,
claims, counterclaims and matters directly or indirectly raised by or
capable of arising out of, or directly or indirectly related to orn-
nected with, this case",
Pluces on recorcithe discontinuance, by agreement of the Parties, of
the proceedings instituted on 17 May 1989 by the Islamic Republic of
Iran against the United States of America; and
Directs that the case be removed from the list.
Done in English and in French, the English text being authoritative, at
the Peace Palace, The Hague, this twenty-second day of February, one
thousaiid nine hundred and ninety-six, in three copies, one of which willbe placed in the archives of the Court and the others transmitted to the
Government of the Islamic Republic of Iran and the Government of the
United States of America, respectively.

Le Président de laCour internationale de Justice,
Vu l'article 48 du Statut de la Cour et l'article 88 de son Règlement,
Vu la requêteenregistréeau Greffe de la Cour le 17 mai 1989 par
laquelle la République islamique d'Iran a introduit une instance contre
les Etats-Unis d'Amérique au sujet d'un différend concernant I'inter-
prétation et l'application de la convention de 1944 relaàil'aviation
civileinternationale et de la convention de 1971pour la répressiond'actes
illicites dirigés contre la sécuritéde l'aviation civile, différend qui a
découléde la destruction, le3 juillet 1988, d'un avion iranien et de la
mort de ses deux cent quatre-vingt-dix passagers et membres d'équipage,
Vu les notifications adressées, respectivement, l'Organisation de
l'aviation civile internationale, conformément au paragraphede I'ar-
ticle 34 du Statut, et aux parties aux conventions sus-indiquées,confor-
mémentau paragraphe 1de l'article 63 du Statut,
Vu l'ordonnance du 13 décembre 1989par laquelle la Cour a fixéau
12juin 1990 ladate d'expiration du délaipour le dépôtdu mémoirede la
Républiqueislamique d'Iran et au 10décembre1990la date d'expiration
du délaipour le dépôt du contre-mémoire des Etats-Unis d'Amérique,
Vu l'ordonnance du 12juin 1990par laquelle le Présidentde la Cour a
reporté au 24 juillet 1990 et au 4 mars 1991 les dates d'expiration des
délaispour le dépôt,respectiveii~ent,du mémoireet du contre-mémoire, Having regard to the Memorial filed by the Islamic Republic of Iran
and the preliminary objections to thejurisdiction of the Court filed bythe
United States of America, within those extended time-limits,
Having regard to the Order made by the Court on 9 April 1991 fixing

islamique d'Iran pourrait présenterun tel exposé écrit,
Vu l'exposé écrictontenant les observations et conclusions de la Répu-
blique islamique d'Iran sur les exceptions préliminaires, déposédans le
délaiainsi prorogé,
Vu les observations écrites présentéep sar l'organisation de l'aviation
civile internationale le décembre1992,dans le délaifixé à cet effet par
le Présidentde la Cour conformémentau paragraphe 3 de l'article 69 du
Règlement,
Vu la lettre du 8 août 1994par laquelle les agents des deux Parties ont
conjointement informéla Cour que leurs gouvernements avaient «entamé
des négociationsqui pourraient aboutir à un règlementtotal et définitif
de [l']affaire» et l'ont priéede <crenvoy[er]sine diel'ouverture de la pro-
cédure orale)), dont elle avait fixéla date au 12 septembre 1994;
Considérant que, par une lettre datéedu 22 février1996et déposéeau
Greffe le même jour, les agents des deux Parties ont conjointement notifié
à la Cour que leurs gouvernements sont convenus de se désisterde l'ins-
tance parce qu'ils sont parvenus
«à un arrangement amiable complet et définitifpour ce qui est de
tous les différends, divergencesde vues, demandes, demandes recon-
ventionnelles et questions que suscite ou peut susciter, directement
ou indirectement, la présente instance, ou qui sont directement ou
indirectement liésou associés à celle-ci)),
Prend ucte du désistement,par accord des Parties, de l'instance intro-
duite le 17mai 1989par la Républiqueislamique d'Iran contre les Etats-
Unis d'Amérique;
Prescrit que l'affaire soit rayéedu rôle.
Fait en anglais et en français, le texte anglais faisant foi, au Palais de
la Paix,iiLa Haye, le vingt-deux févriermil neuf cent quatre-vingt-seize,
