The International Court of Justice,
composed asabove,
after deliberation,
having regard to Article 48 of theute of the Court and to
Articl69 of the Rules of Court,
Makes the followingOrder:
Having regard to the Application, dated 24 Octo1957and
filed in the Registry of the Court on 28 October, by which the
Government of the United States of America instituted proceedings
against the Government of the People's Republic of Bulgaria with
regard to the damage suffered by American nationals, passengers147 AERIAL INCIDENT (U.S.A. V.BULGARIA) (ORDER 30 V 60)
on board an aircraft of El Al Israel Airlines Ltd., which was
destroyed on 27 July 1955 by Bulgarian fighter aircraft ;
Having regard to the Orders of 26 November 1957, 27 January,
19 May, 12 August and 8 October 1958, fixing or extending the
time-limits for the filing of the Memorial of the Government of the
United States of America and of the Counter-Memorial of the
Government of the People's Republic of Bulgaria;
Having regard to the Memorial filed by the Government of the
United States of America within the time-limit fixed;
Havingregard to the Preliminary Objections filedby the Govern-
ment of the People's Republic of Bulgaria within the time-limit
fixed for the filing of the Counter-Memorial;
Having regard to the Order of 9 September 1959, recording that
the proceedings on the merits were thereby suspended and fixing
9 November 1959 as the time-limit within which the Government
of the United States of America might present a written statement
of its Observations and Submissions with regard to the Preliminary
Objections ;
Having regard to the Order of 23 October 1959, extending that
time-limit to 9 February 1960 at the request of the Agent for the
Government of the United States of America;
Having regard to the written statement filed within the time-
limit thus extended by the Government of the United States of
America and containing its Observations and Submissions with
regard to the Preliminary Objections;
Whereas the Agents of the Parties were informed on 18 March
1960 that the Court had decided to open the oral proceedings with
regard to the Preliminary Objections on IJune 1960;
Whereas the Registry received on 16 May 1960a communication
from the Agent for the Government of the United States of America.
referring to Article 69 of the Rules of Court and requesting the
discontinuance of the proceedings and the removal of the case from
the Court's List;
Whereas, on 17 May 1960, the Registry, referring to Article 69,
paragraph 2, of the Rules of Court, transmitted a copy of that
communication to the Agent for the Government of the People's
Republic of Bulgaria ;
Whereas in reply the Registry, on 18 May 1960, received from
the Agent for the Government of the People's Republic of Bulgaria
a communication stating that "the Government of the People's
Republic of Bulgaria does not oppose discontinuance and has no
objection to formulate"; places on record the communications thus received from the two
Governments Parties to the case;
and consequently orders that the case shall be removed from the
Court's List.
Done in English and in French, the English text being author-
itative, at the Peace Palace, The Hague, this thirtieth day of May
one thousand nine hundred and sixty, in three copies, one of which
willbe placed in the archives ofthe Court and the others transmitted
to the Government of the United States of America and to the
Government of the People's Republic of Bulgaria, respectively.

Vu la requête, datéedu 24 oct1957et enregistréeau Greffe le
28octobre, par laquelle le Gouvernement des Etats-Unis d'Amérique
a introduit devant la Cour une instance contre le Gouvernement de
la République populaire de Bulgarie au sujet du préjudice subi par
des ressortissants américains, passàgbord d'un avion de la

on board an aircraft of El Al Israel Airlines Ltd., which was
destroyed on 27 July 1955 by Bulgarian fighter aircraft ;
Having regard to the Orders of 26 November 1957, 27 January,
19 May, 12 August and 8 October 1958, fixing or extending the
time-limits for the filing of the Memorial of the Government of the
United States of America and of the Counter-Memorial of the
Government of the People's Republic of Bulgaria;

Vu les ordonnances des 26 novembre 1957, 27 janvier, 19 mai,
12août et 8 octobre 1958 fixant ou prorogeant la date d'expiration
du délaipour le dépôt du mémoire du Gouvernement des Etats-
Unis d'Amérique et du contre-mémoire du Gouvernement de la
République populaire de Bulgarie;
Vu le mémoire déposépar le Gouvernement des États-unis
d'Amériquedans le délaifixé;
Vu les exceptions préliminairesprésentéespar le Gouvernement
de la République populaire de Bulgarie dans le délaifixépour le
dépôtdu contre-mémoire;
Vu l'ordonnance du 9 septembre 1959 constatant que, de ce fait,
la procédure sur le fond était suspendue et fixant au 9 novembre
1959 le délaidans lequel le Gouvernement des Etats-Unis d'Amé-
rique pouvait présenter un exposé écritcontenant ses observations
et conclusions sur les exceptions préliminaires;
Vu l'ordonnance du 23 octobre 1959 prorogeant ledit délai au
9 février 1960, à la demande du Gouvernement des États-unis
d'Amérique ;
Vu l'exposéécrit présentépar le Gouvernement des États-unis
d'Amériquedans le délai ainsiprorogéet contenant ses observations
et conclusions sur les exceptions préliminaires;
Considérant que, le 18 mars 1960, les agents des Parties ont été
avisésque la Cour avait décidéd'ouvrir la procédure orale relative
aux exceptions préliminaires le I~~juin 1960;
Considérant que, le 16 mai 1960, le Greffe a reçu de l'agent du
Gouvernement des États-unis d'Amériqueune communication se
référant à I'article 69 du Règlement de la Cour et demandant
qu'il soit mis fin àla procédureet que l'affaire soitrayéedu rôle;
Considérantque, le 17mai 1960,le Greffe,seréférantàl'article 69,
paragraphe 2, du Règlement de la Cour, a transmis copie de cette
communication à l'agent du Gouvernement de la République
populaire de Bulgarie;
Considérant qu'en réponsele Greffe a reçu le 18 mai 1960 de
l'agent du Gouvernement de la République populaire de Bulgarie
une communication portant « que le Gouvernement de la République
populaire de Bulgarie ne s'oppose pas à ce désistement et n'a pas
d'objection à formuler 1);
