ORDER

The International Court of Justice,
having regard to Articles 40 and 48 of theStatute of the Court,

having regard to Articles 32and 37 ofthe Rules of Court,

Makes the following Order:

Whereas, on December 22nd, 1955,the Portuguese Minister to the
Netherlands deposited in the Registry an Application of the same
date, institutingproceedings on behalf of Portugal against the
Republic of India in the matter of a right of passage claimed by the
first-mentioned State over Indian territor;

Whereas the Application refers to Article 36, paragraph2,of the
Statute and to the acceptance of the compulsory jurisdiction of the
Court by the Portuguese Republic and by the Republic of India ;

Whereas the Application notifies the appointment of M. F.
Quartin de Oliveira Bastos, Portuguese Minister to the Nether-
lands, as Agent forthe Govemment of Portugal ;

Whereas, by a letter dated January ~zth, 1956, the Minister of
Extemal Affairs of India acknowledged receipt of the Application
and, by a subsequent letter dated February 3rd, 1956, notified

ORDONNANCE

La Cour internationale de Justice,

vu les articles 40 et 48 du Statut de la Cour,

vu les articl32 et37 du Règlement de la Cour,

Rend Z'ordonnancesuivante :

Considérant que, le22 décembre 1955,le ministre du Portugal
aux Pays-Bas a déposéau Greffe une requête,datée du mêmejour,
introduisant au nom du Portugal une instance contrela République
de l'Inde au sujet d'un droit de passage revendiquépar le Portugal
sur territoire indi;n
Considérant que la requete vise l'artic36, paragraphe 2, du
Statut ainsi que l'acceptation de la juridiction obligatoire de la

Cour par la République du Portugal et par la République del'I;de
Considérant que la requête porte notification de la désignation
de M. F. Quartin de Oliveira Bastos, ministre du Portugal aux
Pays-Bas, comme agent du Gouvernement du Portugal ;

Considérant que, par lettre du12 janvier1956, le ministre des
Affaires étrangères de l'Inde a accusé réceptionde la requêteet,
par une lettre ultérieure d3février1956 ,notifiéla désignation

the appointment of Shri B. K. Kapur, Ambassador of India to the
Netherlands, as Agent for the Govemment of India ;

After ascertaining the views of the Parties,

Fixes as follows the time-limits for the filing of pleadings

for the Memorial of the Government of the Republic of Portugal
June 15th, 1956 ;
for the Counter-Memorial of the Government of the Republic of
India December 15th, 1956 ;
And reserves the rest of the procedure for further decision.

Done in English and in French, the English text being authori-
tative, at the Peace Palace, The Hague, this thirteenth day of
March, one thousand nine hundred and fifty-six, in three copies,
one of which will be placed in the archives of the Court and the

others transmitted to the Government of the Portuguese Republic
and to the Government of the Republic of India, respectively.

Palais de la Paix, à La Haye, le treize mars mil neuf cent cinquante-
six, en trois exemplaires, dont l'un restera déposéaux archives de
la Cour et dont les autres seront transmis respectivement au Gouver-
nement de la République du Portugal et au Gouvernement de
la République de l'Inde.
