The President of the International Court of Justice,
having regard to Article 48 of the Statute of the Court,
having regard to Article 37 of the Rules of Court,
Whereas, on December 13th, 1950, the Government of the
Republic of Colombia instituted proceedings before the Court
against the Government of the Republic of Peru ;
Whereas the Application, which refers to the Judgments of the
Court of November 20th and November 27th, 1950, in the Asylum
Case, declares that the Governmeilts of the Republic of Colombia
and of the Republic of Peru were unable to come to an agreement
on the manner in which effect should be given to the said Judg-
ments concerning the surrender of the refugee Victor Raul Haya
de la Torre ;
TTJzereas,in this Application, the Governnient of Colombia
requests the Court :
(a) As a PRINCIPAL CLAIN,
To adjudge and declare, whether the Government of the
Republic of Peru enters an appearance or not, after such
time-limits as the Court may fix in the absence of an agree-
ment between the Parties :
In pursuance of the provisions of Articl7 of the Protocol
of Friendship anci Co-operation between the Republic of

19-34,to deterniine the manner in which effect shall be given
to the Judgment of November zoth, 1950 :
and, furthermore, to state in this connection, particularly :
Whether Colombia is, or is not, bound to deliver to the
Government of Peru Rlr. Victor Raid Haÿa de la Torre, a
refugee in the Colombian Embassy at Lima.
(b) As ail ALTERNATIVE CLBIII,
In the event of the above-rilentioned claiin beirlg dis-
missed, to adjudge and declare, in the exercise of its ordinary
competence, whether the Government of Peru enters an
appearance or not, and after such time-limits as the Court
may fix in the absence of an agreement between the Parties,
whether, in accordance with the law in force between the
Parties, and particularly American international law, the
Government of Colombia is, or is not, bound to deliver
Mr. Victor Kaiil Haya de la Torre to the Gorerntnent of
Pcru ;

tic la Vega, Envoy Extraordinary and llinister Plenipotentiary
of the Goverilment of Colonlbia to the Netherlands, acting as
Agent, refers :
(a) to thc Protocol of Friendship and Co-operation betweeri
thc Kepublic of Colombia and the Republic of Peru

(b) to Articles 36 and 37 of the Statiite of the Court,
thus spccifying the prr)visioiîs on wliich the Applicant founds the
jtirisdictioil of the Court ;

1950, decided as soon as possible, and suggested that the written
proceedings be limited to the subinissioii of a Memorial and a
Counter-Memorial ;
Fixes as follows the time-limits for the presentation by the
Parties of the pleadings :
for the Memorial of the Republic of Coloinbia : February yth,
1951;
for the Counter-Meinorial of the Republic of Peru :31arch 15th,
1951.

Le Président de la Cour internationale deJustice,
vu l'articl48 du Statut de la Cour,
vu l'article37 du Règlement de la Cour,
Considérantqu'à la date du 13 décembre 1950, le Gouvernement
de la République de la Colombie a introduit une instance devant
la Cour contre le Gouvernement de la République du Pérou ;
Considérantque la requête, qui se réfèreaux deux arrêtsrendus
par la Cour aux dates du 20 et du 27 novembre 1950 dans l'affaire
du droit d'asile, énonce que les Gouvernements de la Colombie et
du Pérou n'ont pas pu se mettre d'accord sur la suità donner aux
arrêts précitésen ce qui concerne la remise du réfugiéVictor Raul
IIaya de la Torre ;
Considérantque, par cette requête,lc Gouvernement de la Colom-
bie demande à la Cour :
a) A TITRE PRIKCIPAL,
De dire et juger, tant en la présence qu'en l'absence du
Gouvernement du Pkrou, aprils les délais que, sous réserve
d'un accord entre les Parties, il appartiendra à la Cour de
fixcr:
En exécution de ce qui a étédisposéà l'articl7du Protocole
d'amitié et de coopération signé entre la République de la

présence qu'en l'absence du Gouvernement clu Pérou, et après
les délais que, sans préjudice d'un accord entre les Parties, il
appartiendra à la Cour de fixer, si, conformément au droit en
vigueur entre les Parties et particulièrement au droit inter-
national américain, le Gouvernement de la Colombie est ou
n'est pas obligéde remettre M. Victor Rai11Haya dv la Torre
