I have the honour to refer to my letter (
No. 152867) dated 11 November 2019 informing
your Government that the Republic of The Gambia filed in the Registry of the Court an Application
instituting proceedings against the Republic of the Union of Myanmar in the case concerning
Application of the Convention on the Prevention and Punishment of the Crime of Genocide
(The Gambia v. Myanmar). A copy of the Application was appended to that letter. The text of the
Application is also available on the website of the Court (www.icj..cij.org).
Article 63, paragraph I, of the Statute of the Court provides that:
[w]henever the construction of a convention to which States other than those
concerned in the case are parties is in question, the Registrar shall notify all such
States forthwith”.
Further, under Article 43, paragraph 1, of the Rules of Court:
“Whenever the construction of a convention to which States other than those
concerned in the case are parties may be in question within the meaning of Article 63,
paragraph , of the Statute, the Court shall consider what directions shall be given to
the Registrar in the matter.”
On the instructions of the Court, given in accordance with the said provision of the Rules of
Court, I
have the honour to notify your Government of the following.
In the above-mentioned Application, the Applicant seeks to found the Court’s jurisdiction on
the compromissory clause contained in Article IX of the 1948 Convention on the Prevention and
Punishment of the Crime of Genocide (hereinafter the “Genocide Convention”) and alleges that the
Respondent has violated Articles I, Ill, IV, V and VI of the Convention. It therefore appears that
the construction of this instrument will be in question in the case

laquelle j’ai porte a Ia connaissance de votre Gouvernement que Ia Republique de Gambie a, Ic
11 novembre 2019, depose au Greffe de La Cour internationale de Justice une requête introduisant
une instance contre Ia République de l’Union du Myanmar en I’affaire relative a I’Application de Ia
convention pour Ia prevention et Ia repression du crime de genocide (Gambie c. Myanmar). Une
copie de Ia requête ëtaitjointe a cette lettre. Le texte de ladite requête est également disponible sur
le site Internet de la Cour (www.ici-cij.oig).
Le paragraphe I
de l’article 63 du Statut de Ia Cour dispose que
<[l]orsqu’il s’agit de l’interprétation d’une convention a laquelle ont participé d’autres
Etats que les parties en litige, le Greffier les avertit sans délai>.
Le paragraphe I
de l’article 43 du Règlement de Ia Cour precise en outre que
<[l]orsque I’interprétation d’une convention a laquelle ont participe d’autres Etats que
les parties en litige peut étre en cause au sens de I’article 63, paragraphe 1, du Statut,
Ia Cour examine queues instructions donner au Greffier en Ia matière>>.
Sur les instructions de Ia Cour, qui m’ont été données conformément a cette dernière
disposition, j’ai l’honneur de notifier a votre Gouvernement cc qui suit.
Dans Ia requête susmentionnée, Ia convention de 1948 pour Ia prevention et Ia repression du
crime de genocide (ci-aprés Ia ((convention sur le genocide>>) est invoquée a Ia fois comme base de
competence de Ia Cour et a I’appui des demandes de Ia Gambie au fond, Plus précisément, celle-ci
entend fonder Ia competence de Ia Cour sur Ia clause compromissoire figurant a l’article IX de cet
instrument et affinne que le défendeur a violé les articles 1, III, IV, V et VI de celui-ci. II semble,
des lors, que l’interprétation de cette convention pourrait être en cause en l’affaire.

Further, under Article 43, paragraph I, of the Rules of Court:
“Whenever the construction of a convention to which States other than those
concerned in the case are parties may be in question within the meaning of Article 63,
paragraph 1, of the Statute, the Court shall consider what directions shall be given to
the Registrar in the matter.”
On the instructions of the Court, given in accordance with the said provision of the Rules of
Court, I have the honour to notify your Government of the following.
In the above-mentioned Application, the Applicant seeks to found the Court’s jurisdiction on
the compromissory clause contained in Article IX of the l948 Convention on the Prevention and
Punishment of the Crime of Genocide (hereinafter the “Genocide Convention”) and alleges that the
Respondent has violated Articles I, III, IV, V and VI of the Convention. It therefore appears that

We have the honour to write to you in relation to the proceedings instituted by The Gambia
against Myanmar concerning the application of the Convention on the Prevention and
Punishment of the Crime of Genocide, alleging that ‘acts adopted, taken and condoned by the
Government of Myanmar against members of the Rohingya group, a distinct ethnic, racial and
religious group that resides primarily in Myanmar’s Rakhine State (...) have been perpetrated in
manifest violation of the 1948 Convention on the Prevention and Punishment of the Crime
of Genocide’ (Application of The Gambia, para. 2).
In this regard, we respectfully refer to your notes 153177 and 153168 of 24 January 2020
notifying the Governments of Canada and the Kingdom of the Netherlands as a party to the
Convention on the Prevention and Punishment of the Crime of Genocide (Genocide Convention),
and as contemplated by Article 63, paragraph 1, of the Statute of the Court, that the
construction of Articles I, Ill, IV, V and VI of the Genocide Convention may be in question in the
case.
We have the honour to inform you that the Governments of Canada and the Netherlands are
interested in theconstruction of the Genocide Convention in this case and may wish to exercise
their right to intervene through the submission of a joint intervention in the abovementioned
proceedings instituted by The Gambia against Myanmar under Article 63, paragraph 2, of the
Statute of the Court.

the United Kingdom of Great Britain and Northern Ireland to the
Convention on the Prevention and Punishment of the Crime of Genocide,
adopted by the General Ae.embly of the United Nations on 9 December l98,
was deposited with the Secretary-General, in accordance with article XI.
At the time of deposit of the instrument of access ion, the
Government of the United Kingdom notified the Secretary-General, in

In accordance with the third paragraph of article XIII of the
Convention, the accession of the United Kingdom will become effective on
