After deliberation,
Having regard to Article 48 of the Statute of the Court and to Articles 31, 44, 45, paragraph 1, and 48 of the Rules of Court,
Having regard to the Application filed by Canada, the Kingdom of Sweden (hereinafter “Sweden”), Ukraine and the United Kingdom of Great Britain and Northern Ireland (hereinafter the “United Kingdom”) on 4 July 2023 instituting proceedings against the Islamic Republic of Iran (hereinafter “Iran”) concerning alleged violations by the latter of its obligations under the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation of 23 September 1971 arising out of the shooting down of a Ukrainian civil aircraft on 8 January 2020;

Whereas a signed copy of the Application was communicated to Iran on the day it was filed;
Whereas each applicant State has appointed an Agent for the purposes of the proceedings; whereas Canada has appointed Mr Alan H. Kessel, Sweden has appointed HE Ms Elinor Hammarskjöld, Ukraine has appointed Ms Oksana Zolotaryova and the United Kingdom has appointed Ms Sally Langrish; and whereas Iran has appointed Mr Tavakol Habibzadeh as Agent;
Whereas, on 21 September 2023, a meeting was held by the President of the Court with the Agents of the Parties pursuant to Article 31 of the Rules of Court, in order to ascertain their views with regard to the time-limits for the filing of the initial written pleadings in the case;
Whereas at this meeting, the Agent of Canada, speaking on behalf of the four applicant States, emphasized that an early resolution of the present dispute was of key importance for the families of the victims of the downing of Ukraine International Airlines Flight PS752, who deserved transparency, accountability and justice; whereas the Agent of Canada indicated that the Applicants wished to have at their disposal a period of nine months for the preparation of their joint Memorial; and whereas the Agent of Iran stated at the outset that, while the accident that had occurred was indeed tragic, his Government was of the view that the Court lacked jurisdiction to entertain the case and that the applicant States had no standing to institute proceedings; whereas the Agent further expressed the wish that the Court avoid fixing time-limits in the current case which might overlap with the preparation by Iran of its written and oral pleadings in the other pending cases before the Court to which it was a party; and whereas the Agent of Iran stated that his Government would need a period of eighteen months for the preparation of its Counter-Memorial, following the filing of the Memorial of the applicant States;
Taking into account the views of the Parties,
Fixes the following time-limits for the filing of the written pleadings:
16 October 2024 for the Memorial of Canada, the Kingdom of Sweden, Ukraine and the United Kingdom of Great Britain and Northern Ireland;
16 October 2025 for the Counter-Memorial of the Islamic Republic of Iran; and
Reserves the subsequent procedure for further decision.

Après délibéré en chambre du conseil,
Vu l’article 48 du Statut de la Cour et les articles 31, 44, 45, paragraphe 1,
et 48 de son Règlement,
Vu la requête introductive d’instance déposée par le Canada, le Royaume-
Uni de Grande-Bretagne et d’Irlande du Nord (ci-après le « Royaume-Uni »),
le Royaume de Suède (ci-après la « Suède ») et l’Ukraine le 4 juillet 2023
contre la République islamique d’Iran (ci-après l’« Iran ») au sujet de manquements
allégués de cette dernière aux obligations que lui impose la convention
du 23 septembre 1971 pour la répression d’actes illicites dirigés contre la
sécurité de l’aviation civile, à raison de la destruction en vol, le 8 janvier
2020, d’un aéronef civil ukrainien ;
Considérant que, le jour même du dépôt de la requête, un exemplaire signé
de celle-ci a été transmis à l’Iran ;
Considérant que chaque État demandeur a désigné un agent aux fins de
l’instance ; que le Canada a désigné M. Alan H. Kessel, que le Royaume-Uni

Considérant que, le 21 septembre 2023, la présidente de la Cour a tenu
une réunion avec les agents des Parties, en application de l’article 31 du
Règlement de la Cour, afin de s’informer de leurs vues en ce qui concerne
les délais pour le dépôt des premières pièces de la procédure écrite en
l’affaire ;
Considérant que, à cette réunion, l’agent du Canada, s’exprimant au nom
des quatre États demandeurs, a souligné qu’un règlement rapide du présent
différend était essentiel pour les familles des victimes de l’appareil abattu de
la compagnie Ukraine International Airlines qui assurait le vol PS752,
lesquelles méritaient qu’il soit fait preuve de transparence, que les responsabilités
soient établies et que justice soit rendue ; que l’agent du Canada a
indiqué que les demandeurs souhaitaient disposer d’une période de neuf
mois pour l’élaboration de leur mémoire commun ; et que l’agent de l’Iran a
indiqué d’emblée que, si l’accident survenu était assurément tragique, son
gouvernement estimait toutefois que la Cour n’avait pas compétence pour
connaître de l’affaire et que les États demandeurs n’avaient pas qualité pour
introduire une instance ; que l’agent a en outre exprimé le souhait que la
Cour évite de fixer en l’espèce des délais susceptibles d’entraver l’élaboration,
par l’Iran, de ses écritures et plaidoiries dans les autres affaires
pendantes devant elle auxquelles il est partie ; et que l’agent de l’Iran a
précisé que son gouvernement aurait besoin de disposer d’une période de
dix-huit mois à compter de la date de dépôt du mémoire des États demandeurs
pour préparer son contre-mémoire ;
Compte tenu des vues des Parties,
Fixe comme suit les dates d’expiration des délais pour le dépôt des pièces
de la procédure écrite :
Pour le mémoire du Canada, du Royaume-Uni de Grande-Bretagne et
d’Irlande du Nord, du Royaume de Suède et de l’Ukraine, le 16 octobre
2024 ;
Pour le contre-mémoire de la République islamique d’Iran, le 16 octobre
2025 ;
Réserve la suite de la procédure.
Fait en anglais et en français, le texte anglais faisant foi, au Palais
de la Paix, à La Haye, le seize octobre deux mille vingt-trois, en six
exemplaires, dont l’un restera déposé aux archives de la Cour et les autres
