ORDER
Present: President DONOGHUE; Judges TOMKA, ABRAHAM, XUE, BHANDARI, SALAM, IWASAWA, NOLTE, CHARLESWORTH, BRANT; Registrar GAUTIER.
The International Court of Justice,
Composed as above,
After deliberation,
Having regard to Article 48 of the Statute of the Court and to Article 44, paragraph 3, of the Rules of Court,
Having regard to the Order dated 22 July 2022, whereby the Court fixed 24 April 2023 as the time-limit for the filing of the Counter-Memorial of the Republic of the Union of Myanmar (hereinafter “Myanmar”),
Having regard to the Order dated 6 April 2023, whereby the Court, further to a request of Myanmar received by a letter dated 14 March 2023, extended to 24 May 2023 the time-limit for the filing of the Counter-Memorial;
Whereas, by a letter dated 21 April 2023, the Agent of Myanmar requested the Court to grant a further extension of the time-limit for the filing of the Counter-Memorial until 24 February 2024; whereas, in his letter, the Agent emphasized his Government’s difficulties in complying with the

existing time-limit despite diligent efforts to do so; whereas the Agent also specified the reasons invoked by Myanmar in support of its previous request for an extension of the time-limit for the filing of the Counter-Memorial, in particular the voluminous nature of the Memorial of the Republic of The Gambia (hereinafter “The Gambia”); whereas the Agent further indicated that the additional month granted by the Court’s Order of 6 April 2023 would be insufficient for the submission of a Counter-Memorial containing the arguments and evidence necessary to respond to the claims made against Myanmar; whereas the Agent in addition responded to arguments that had been made by The Gambia in objecting to Myanmar’s previous request for an extension of the time-limit for the filing of the Counter-Memorial;
Whereas, on receipt of that letter, the Registrar immediately transmitted a copy thereof to The Gambia, in accordance with Article 44, paragraph 3, of the Rules of Court;
Whereas, by a letter dated 28 April 2023, the Agent of The Gambia stated that his Government opposed the request of Myanmar, arguing that the latter had offered no new justification for the requested extension;
Taking into account the views of the Parties,
Extends to 24 August 2023 the time-limit for the filing of the Counter-Memorial of the Republic of the Union of Myanmar; and
Reserves the subsequent procedure for further decision.
Done in English and in French, the English text being authoritative, at the Peace Palace, The Hague, this twelfth day of May, two thousand and twenty-three, in three copies, one of which will be placed in the archives of the Court and the others transmitted to the Government of the Republic of The Gambia and the Government of the Republic of the Union of Myanmar, respectively.

Après délibéré en chambre du conseil,
Vu l’article 48 du Statut de la Cour et le paragraphe 3 de l’article 44 de son
Règlement,
Vu l’ordonnance du 22 juillet 2022, par laquelle la Cour a fixé au 24 avril
2023 la date d’expiration du délai pour le dépôt du contre-mémoire de la
République de l’Union du Myanmar (ci-après le « Myanmar »),
Vu l’ordonnance du 6 avril 2023, par laquelle la Cour, faisant suite à
une demande du Myanmar reçue par lettre datée du 14 mars 2023, a reporté
au 24 mai 2023 la date d’expiration du délai pour le dépôt du contremémoire
;
Considérant que, par lettre datée du 21 avril 2023, l’agent du Myanmar a
prié la Cour de proroger encore, jusqu’au 24 février 2024, le délai pour le
dépôt du contre-mémoire ; qu’il a souligné dans cette lettre les difficultés
éprouvées par son gouvernement pour se conformer au délai existant, et ce,
malgré tous les efforts déployés à cette fin ; qu’il a également précisé les

raisons invoquées par le Myanmar à l’appui de sa précédente demande de
prorogation du délai fixé pour le dépôt du contre-mémoire, en particulier
le caractère volumineux du mémoire de la République de Gambie (ci-après
la « Gambie ») ; qu’il a en outre indiqué que le mois supplémentaire accordé
par la Cour dans son ordonnance du 6 avril 2023 ne serait pas suffisant pour
soumettre un contre-mémoire contenant les arguments et moyens de preuve
nécessaires pour répondre aux griefs formulés contre le Myanmar ; qu’il a
par ailleurs répondu à des arguments avancés par la Gambie pour s’opposer
à la précédente demande du Myanmar tendant à obtenir une prorogation du
délai pour le dépôt du contre-mémoire ;
Considérant que, dès réception de ladite lettre, le greffier en a fait tenir
copie à l’agent de la Gambie, conformément au paragraphe 3 de l’article 44
du Règlement de la Cour ;
Considérant que, par lettre datée du 28 avril 2023, l’agent de la Gambie a
indiqué que son gouvernement s’opposait à la demande du Myanmar, arguant
que ce dernier n’avait présenté aucune justification nouvelle pour la prorogation
demandée ;
Compte tenu des vues des Parties,
Reporte au 24 août 2023 la date d’expiration du délai pour le dépôt du
contre-mémoire de la République de l’Union du Myanmar ;
Réserve la suite de la procédure.
Fait en anglais et en français, le texte anglais faisant foi, au Palais de la
Paix, à La Haye, le douze mai deux mille vingt-trois, en trois exemplaires,
dont l’un restera déposé aux archives de la Cour et les autres seront transmis
respectivement au Gouvernement de la République de Gambie et au Gouvernement
de la République de l’Union du Myanmar.
