ORDER
The President of the International Court of Justice,
Having regard to Article 48 of the Statute of the Court and to Article 79bis,
paragraphs 1 and 3, of the Rules of Court,
Having regard to the Application filed in the Registry of the Court on
16 September 2021, whereby the Republic of Armenia instituted proceedings
against the Republic of Azerbaijan concerning alleged violations of
the International Convention on the Elimination of All Forms of Racial
Discrimination of 21 December 1965,
Having regard to the Order of 21 January 2022, whereby the Court fixed
23 January 2023 and 23 January 2024 as the respective time-limits for
the filing of the Memorial of the Republic of Armenia and the Counter-
Memorial of the Republic of Azerbaijan,
Having regard to the Memorial of the Republic of Armenia filed within
the time-limit thus fixed;
Whereas, on 21 April 2023, the Republic of Azerbaijan filed preliminary
objections to the jurisdiction of the Court, and whereas a signed copy of
those preliminary objections was immediately transmitted to the other
Party;
Whereas, accordingly, by virtue of Article 79bis, paragraph 3, of the Rules
of Court, the proceedings on the merits are suspended and a time-limit has

ORDONNANCE
La présidente de la Cour internationale de Justice,
Vu l’article 48 du Statut de la Cour et l’article 79bis, paragraphes 1 et 3, de
son Règlement,
Vu la requête déposée au Greffe de la Cour le 16 septembre 2021, par
laquelle la République d’Arménie a introduit une instance contre la République
d’Azerbaïdjan à raison de violations alléguées de la convention
internationale du 21 décembre 1965 sur l’élimination de toutes les formes de
discrimination raciale,
Vu l’ordonnance du 21 janvier 2022, par laquelle la Cour a fixé au 23 janvier
2023 et au 23 janvier 2024, respectivement, les dates d’expiration des
délais pour le dépôt du mémoire de la République d’Arménie et du contremémoire
de la République d’Azerbaïdjan,
Vu le mémoire de la République d’Arménie déposé dans le délai ainsi
fixé ;
Considérant que, le 21 avril 2023, la République d’Azerbaïdjan a déposé
des exceptions préliminaires d’incompétence de la Cour, et qu’un exemplaire
signé de celles-ci a immédiatement été transmis à l’autre Partie ;
Considérant qu’en conséquence, en vertu des dispositions du paragraphe 3
de l’article 79bis du Règlement, la procédure sur le fond est suspendue et

to be fixed for the presentation by the other Party of a written statement of
its observations and submissions on the preliminary objections;
Taking account of Practice Direction V, pursuant to which the time-limit
for the presentation of such a written statement shall generally not exceed
four months from the date of the filing of the preliminary objections,
Fixes 21 August 2023 as the time-limit within which the Republic of
Armenia may present a written statement of its observations and submissions
on the preliminary objections raised by the Republic of Azerbaijan;
and
Reserves the subsequent procedure for further decision.
Done in English and in French, the English text being authoritative, at the
Peace Palace, The Hague, this twenty-fifth day of April, two thousand and
twenty-three, in three copies, one of which will be placed in the archives of
the Court and the others transmitted to the Government of the Republic of
Armenia and the Government of the Republic of Azerbaijan, respectively.

qu’il convient de fixer un délai dans lequel la Partie adverse pourra présenter
un exposé écrit contenant ses observations et conclusions sur les exceptions
préliminaires ;
Compte tenu de l’instruction de procédure V, aux termes de laquelle le
délai pour la présentation d’un tel exposé écrit ne devra en général pas
excéder quatre mois à compter de la date de présentation d’exceptions
préliminaires,
Fixe au 21 août 2023 la date d’expiration du délai dans lequel la République
d’Arménie pourra présenter un exposé écrit contenant ses observations
et conclusions sur les exceptions préliminaires soulevées par la
République d’Azerbaïdjan ;
Réserve la suite de la procédure.
Fait en anglais et en français, le texte anglais faisant foi, au Palais de la
Paix, à La Haye, le vingt-cinq avril deux mille vingt-trois, en trois exemplaires,
dont l’un restera déposé aux archives de la Cour et les autres seront
transmis respectivement au Gouvernement de la République d’Arménie
et au Gouvernement de la République d’Azerbaïdjan.
