OBLIGATIONS OF STATES IN RESPECT OF CLIMATE CHANGE
(REQUEST FOR ADVISORY OPINION)
ORDER
The President of the International Court of Justice,
Having regard to Articles 48, 65 and 66 of the Statute of the Court and to Articles 104 and 105 of the Rules of Court;
Whereas on 29 March 2023 the United Nations General Assembly adopted, at the 64th meeting of its Seventy-seventh Session, resolution 77/276, by which it decided, pursuant to Article 65 of the Statute of the Court, to request the International Court of Justice to render an advisory opinion;
Whereas certified true copies of the English and French texts of that resolution were transmitted to the Court under cover of a letter from the Secretary-General of the United Nations dated 12 April 2023 and received on 17 April 2023;
Whereas the operative paragraph of this resolution reads as follows:
“The General Assembly,

Decides, in accordance with Article 96 of the Charter of the United Nations, to request the International Court of Justice, pursuant to Article 65 of the Statute of the Court, to render an advisory opinion on the following question:

‘Having particular regard to the Charter of the United Nations, the International Covenant on Civil and Political Rights, the International Covenant on Economic, Social and Cultural Rights, the United Nations Framework Convention on Climate Change, the Paris Agreement, the United Nations Convention on the Law of the Sea, the duty of due diligence, the rights recognized in the Universal Declaration of Human Rights, the principle of prevention of significant harm to the environment and the duty to protect and preserve the marine environment,
(a) What are the obligations of States under international law to ensure the protection of the climate system and other parts of the environment from anthropogenic emissions of greenhouse gases for States and for present and future generations;
(b) What are the legal consequences under these obligations for States where they, by their acts and omissions, have caused significant harm to the climate system and other parts of the environment, with respect to:
(i) States, including, in particular, small island developing States, which due to their geographical circumstances and level of development, are injured or specially affected by or are particularly vulnerable to the adverse effects of climate change?
(ii) Peoples and individuals of the present and future generations affected by the adverse effects of climate change?’”;
Whereas the Secretary-General indicated in his letter that, pursuant to Article 65, paragraph 2, of the Statute, all documents likely to throw light upon the questions would be transmitted to the Court in due course;
Whereas, by letters dated 17 April 2023, the Deputy-Registrar gave notice of the request for an advisory opinion to all States entitled to appear before the Court, pursuant to Article 66, paragraph 1, of the Statute,
1. Decides that the United Nations and its Member States are considered likely to be able to furnish information on the questions submitted to the Court for an advisory opinion and may do so within the time-limits fixed in this Order;
2. Fixes 20 October 2023 as the time-limit within which written statements on the questions may be presented to the Court, in accordance with Article 66, paragraph 2, of the Statute;
3. Fixes 22 January 2024 as the time-limit within which States and organizations having presented written statements may submit written comments on the written statements made by other States or organizations, in accordance with Article 66, paragraph 4, of the Statute; and
Reserves the subsequent procedure for further decision.

ORDONNANCE
La présidente de la Cour internationale de Justice,
Vu les articles 48, 65 et 66 du Statut de la Cour et les articles 104 et 105 de
son Règlement ;
Considérant que, le 29 mars 2023, l’Assemblée générale des Nations Unies
a adopté, à la 64e séance de sa soixante-dix-septième session, la résolution
77/276, par laquelle elle a décidé, conformément à l’article 65 du
Statut, de demander à la Cour internationale de Justice de donner un
avis consultatif ;
Considérant que des copies certifiées conformes des versions française et
anglaise de la résolution susmentionnée ont été transmises à la Cour sous le
couvert d’une lettre du Secrétaire général des Nations Unies datée du 12 avril
2023 et reçue le 17 avril 2023 ;
Considérant que le dispositif de cette résolution est ainsi libellé :
« L’Assemblée générale,

Décide, conformément à l’Article 96 de la Charte des Nations Unies,
de demander à la Cour internationale de Justice, en application de
l’Article 65 du Statut de la Cour, de donner un avis consultatif sur la
question suivante :
“Eu égard en particulier à la Charte des Nations Unies, au Pacte
international relatif aux droits civils et politiques, au Pacte international
relatif aux droits économiques, sociaux et culturels, à la

Convention-cadre des Nations Unies sur les changements climatiques,
à l’Accord de Paris, à la Convention des Nations Unies sur le droit de
la mer, à l’obligation de diligence requise, aux droits reconnus dans
la Déclaration universelle des droits de l’homme, au principe de prévention
des dommages significatifs à l’environnement et à l’obligation
de protéger et de préserver le milieu marin :
a) Quelles sont, en droit international, les obligations qui incombent
aux États en ce qui concerne la protection du système climatique et
d’autres composantes de l’environnement contre les émissions
anthropiques de gaz à effet de serre pour les États et pour les générations
présentes et futures ?
b) Quelles sont, au regard de ces obligations, les conséquences juridiques
pour les États qui, par leurs actions ou omissions, ont causé
des dommages significatifs au système climatique et à d’autres
composantes de l’environnement, à l’égard :
i) Des États, y compris, en particulier, des petits États insulaires
en développement, qui, de par leur situation géographique et
leur niveau de développement, sont lésés ou spécialement
atteints par les effets néfastes des changements climatiques
ou sont particulièrement vulnérables face à ces effets ?
ii) Des peuples et des individus des générations présentes et
futures atteints par les effets néfastes des changements climatiques
?” » ;
Considérant que le Secrétaire général a indiqué dans sa lettre que, conformément
au paragraphe 2 de l’article 65 du Statut, tout document pouvant
servir à élucider les questions serait transmis à la Cour en temps utile ;
Considérant que, par lettres en date du 17 avril 2023, le greffier adjoint a
notifié la requête pour avis consultatif à tous les États admis à ester devant
la Cour, conformément au paragraphe 1 de l’article 66 du Statut,
1. Décide que l’Organisation des Nations Unies et ses États Membres sont
jugés susceptibles de fournir des renseignements sur les questions soumises
à la Cour pour avis consultatif et qu’ils pourront le faire dans les délais
fixés par la présente ordonnance ;
2. Fixe au 20 octobre 2023 la date d’expiration du délai dans lequel des
exposés écrits sur les questions pourront être présentés à la Cour, conformément
au paragraphe 2 de l’article 66 de son Statut ;
3. Fixe au 22 janvier 2024 la date d’expiration du délai dans lequel les
États ou organisations qui auront présenté un exposé écrit pourront présenter
des observations écrites sur les exposés écrits faits par d’autres
États et organisations, conformément au paragraphe 4 de l’article 66 du
Statut ;
Réserve la suite de la procédure.
