The case conccrning CertainPhosphatel~nds InNauru (Nauruv. AustraliaJ~
entered on the Court'sGeneral List on 19 May 1989under Number 80, was the
subject of a Judgment delivered on 26 June 1992(Certain Phosphale land.^in
Nauru (Nuirru v. Austraiiu), Preliminary Objections, Judgment,1.C.J. Reports
1992, p. 240) The case was removed from the Listby an Order of 13September
1993, followingdiscontinuance by agreement of the Parties (Certain Phosphate
Landsin Nuilru (Naurin v. Atistxalaa),1.C.J Reports 1993,p.322).

Regarding the reproduction of case filcs, the Court has decided that hence-
forth, irrespectiveof the stagat which a casehas termiiiatcd, publication shouId
be confined to the writtcn proceedings and oral arguments in the case, together

trate its decision. The Court has also specificallyrequested that, whenever tcch-
nically feasiblc, the volumes should consist of facsimile versionsof the docu-

FOR THE SETTLEMENT OF THE CASE
INTl-ETINTERNATION A LURT OF JUSTlCE
CQNCERNING CERTAW PHOSPHATL EANDS IiNAURU
THE REPUBLIC OF NAURU AND AUSTRALIA,
Wishing to strengthen the existing friendlyrelations betweentwoecoun-
tries, and
Wishing tesettle amicably the application brought by the Republic of Nauru
against Australia iri the International Court of Justice,
Havc agreed asfollows:
Article J
(1) Australia agrccs that, in an effort to assist thc Rcpublic of Nauru in its
preparations for ils post-phosphate future, it shall pay the Republic of Nauru
a cash seulement ofone hundred and seven million dollars ($A107 millias)
follows:
(a) The sum of ten milliondollars ($A10million) onor before 31 August 1993.
(b) The sum of thirty million dollars $A30 milliassoon as itmay lawfully
be paid and not later than 31 December 1993
(c) The sum of seventeenmillion dolla($A 17million)on 31 Augusi 1994.
(d) An amoiint of fifty million doll($A50 million) to be paid at an annual
rate of $2.5 million dollars, maintained in real terms by reference to the
Australian Bureau of Statistics'non-faGDP deflator, for twcnty ycars
commencingin the financial year 1993-94.
The above payments are made wlthout prejudice to Australia'slong-standing
position that it bears no responsibiforthe rehabilitatiof the phosphate
lands worked ou^beïore 1 3uly 1967.
(2) At the end of the 20 year period referred in paragraph (1) (d) the
Republicof Nauru shall continue to recedevelopment CO-operationassistance
from Australiaata iiiutuallyagreed Ievel.
Article2
inconsequenceof the undertakingsby Australia in Articletheparties agree
that they shall take the action necessadiscontinuethe present proceedings
brought by the Republicof Nauru against Australia in ihe International Court
of Justice.
Article 3
Thc Republicof Nauru agrcçsthat it shamakeno claim whatsoever,whether
in the International Court of Justice or oiherwise, againor any of Aus-
rralia, the United Kingdom of Great Britain and Northern Treland anNeiv
Zealand, their servants or agents arising out of or concerning the administration
of Nauru during the period of the Mandate or Trusteeship or the termination

including matters pertalning ta the British Phosphate Cornmissioners. their

This Agrecrncnt shallenterinto force onthe date on which the parties have
notiiïed each other that the constitutional requirements of each party for the
entry into force of thAgreement have ken complied with.
