Composed as above,
After deliberation,

Having regard to Article 48 of the Statute of the Court and to Ar-i
cle 44 of the Rules of Court,

Having regard to the Judgment delivered by the Court on 30 Novem -
ber 2010 by which it found inter alia that the Democratic Republic of the
Congo is under obligation to make appropriate reparation, in the form off

compensation, to the Republic of Guinea for the injurious consequences
of the violations of international obligations committed by the Dem-
cratic Republic of the Congo,

Having regard to the decision of the Court, set forth in the said Judg
ment, to settle the question of compensation should the Parties fail to f
agree on this matter in six months from the date of the Judgment and to
reserve for this purpose the subsequent procedure in the case ;

Whereas the time-limit fixed by the Court in the operative part of its
Judgment expired on 30 May 2011 ;

Whereas the Court decided in the said Judgment that, having been suf -
ficiently informed of the facts of the present case, a single exchangef of
written pleadings by the Parties would be sufficient in order for it tof

decide on the amount of compensation due to the Republic of Guinea ;
Whereas, at a meeting held by the President of the Court with the rep -
resentatives of the Parties on 14 September 2011, the Agent of the Repub-
lic of Guinea indicated that, in view of the time which had already passfed

since the Judgment was delivered, his Government was prepared to file fits
Memorial on the question of compensation within one month ; and
whereas the Co-Agent of the Democratic Republic of Congo, referring to
the complex nature of the research to be conducted in order to respond tfo
the claims of the Republic of Guinea on the issue, requested a time-limit

of four months for the filing of his Government’s Counter-Memorial ;
Taking account of the views of the Parties,

Fixes the following time-limits for the filing of the written pleadings on
the sole question of compensation due in the present case under para -
graphs 163 and 165 (7) of its Judgment of 30 November 2010 :

6 December 2011 for the Memorial of the Republic of Guinea ;
21 February 2012 for the Counter-Memorial of the Democratic Repub -

lic of the Congo.

Done in French and in English, the French text being authoritative, at
the Peace Palace, The Hague, this twentieth day of September, two thou -

sand and eleven, in three copies, one of which will be placed in the
archives of the Court and the others transmitted to the Government of
the Republic of Guinea and the Government of the Democratic Republic
of the Congo, respectively.

Ainsi composée,

Après délibéré en chambre du conseil,

Vu l’article 48 du Statut de la Cour et l’article 44 de son Règlement,

Vu l’arrêt rendu par la Cour le 30 novembre 2010, par lequel la Cour a

dit, notamment, que la République démocratique du Congo a l’obligation
de fournir une réparation appropriée, sous la forme d’une indemfnisation,
à la République de Guinée pour les conséquences préjudicifables résultant

des violations d’obligations internationales commises par la Répubflique
démocratique du Congo,
Vu la décision de la Cour, énoncée dans ledit arrêt, de réfgler la ques -

tion de l’indemnisation au cas où les Parties ne pourraient se metftre d’ac-
cord à ce sujet dans les six mois à compter du prononcé de l’farrêt et de
réserver à cet effet la suite de la procédure ;

Having regard to Article 48 of the Statute of the Court and to Ar-i

Having regard to the Judgment delivered by the Court on 30 Novem -
ber 2010 by which it found inter alia that the Democratic Republic of the
Congo is under obligation to make appropriate reparation, in the form off

Considérant que le délai fixé par la Cour dans le dispositif fde son arrêt

est arrivé à échéance le 30 mai 2011 ;
Considérant que la Cour a décidé dans ledit arrêt que, étfant suffisam -
ment informée des faits de l’espèce, un seul échange de pièces de procé -

dure écrite lui serait suffisant pour fixer le montant de l’indfemnité due à
la République de Guinée ;
Considérant que, au cours d’une réunion que le président de fla Cour a
tenue avec les représentants des Parties le 14 septembre 2011, l’agent de la

République de Guinée a indiqué que son gouvernement, compte tenu du
temps déjà écoulé depuis le prononcé de l’arrêt, éftait prêt à déposer son
mémoire sur la question de l’indemnisation dans un délai d’un mois ; et
que le coagent de la République démocratique du Congo, faisant état du
caractère complexe des recherches à mener pour répondre aux préftentions

de la Guinée sur la question, a sollicité un délai de quatre mofis pour le
dépôt du contre-mémoire de son gouvernement ;
Compte tenu des vues des Parties,

Fixe comme suit les dates d’expiration des délais pour le dépôt fde pièces

de procédure écrite portant sur la seule question de l’indemnisfation due
en l’espèce au titre des paragraphes 163 et 165, point 7, de son arrêt du
30 novembre 2010 :
Pour le mémoire de la République de Guinée, le 6 décembre 2011 ;

Pour le contre-mémoire de la République démocratique du Congo, fle
21 février 2012.

Fait en français et en anglais, le texte français faisant foi, au Palais de
la Paix, à La Haye, le vingt septembre deux mille onze, en trois exem -
plaires, dont l’un restera déposé aux archives de la Cour et lefs autres
seront transmis respectivement au Gouvernement de la République de

Guinée et au Gouvernement de la République démocratique du Congfo.
