The International Court of Justice,

Composed as above,

Having regard to Article 48 of the Statute of the Court and to Articles
31, 44, 45, paragraph 1, and 48 of the Rules of Court,

Having regard to the Application filed in the Registry of the Court on
17 November 2008, whereby the former Yugoslav Republic of Macedo-
nia instituted proceedings against the Hellenic Republic

“to protect its rights under the Interim Accord [of 13 September
1995] and to ensure that it is allowed to exercise its rights as an inde-

pendent State acting in accordance with international law, including
the right to pursue membership of relevant international organisa-
tions [under Article 11, paragraph 1, of that Accord]”;

Whereas on 17 November 2008 a certified copy of the Application was

transmitted to the Hellenic Republic;

4 Whereas the former Yugoslav Republic of Macedonia has appointed
H.E. Mr. Antonio Milošoski as Agent and H.E. Mr. Nikola Dimitrov as

Co-Agent; and whereas the Hellenic Republic has appointed H.E. Mr.
Georges Savvaides, H.E. Mr. Constantin-John A. Rallis and Ms Maria
Telalian as Agents;

Whereas, at a meeting held by the President of the Court with the rep-
resentatives of the Parties on 19 January 2009, H.E. Mr. Nikola Dim-
itrov, Co-Agent of the former Yugoslav Republic of Macedonia, refer-
ring in particular to the legal nature of the case and the absence of a need
for factual or historical research, requested a period of four or five

months from the date of the Order for the preparation of the Memorial
of his Government; and whereas H.E. Mr. Georges Savvaides, Agent of
the Hellenic Republic, observed, inter alia, that his Government was
unable at that stage to distinguish the legal from the other questions that
could arise in the case, and therefore wished to have the necessary time at

its disposal for the preparation of the Counter-Memorial, which it esti-
mated at 12 months;

Taking into account the views of the Parties,

Fixes the following time-limits for the filing of the written pleadings:

20 July 2009 for the Memorial of the former Yugoslav Republic of

Macedonia;
20 January 2010 for the Counter-Memorial of the Hellenic Republic;
and

Reserves the subsequent procedure for further decision.

Done in French and in English, the French text being authoritative, at

the Peace Palace, The Hague, this twentieth day of January, two thou-
sand and nine, in three copies, one of which will be placed in the archives
of the Court and the others transmitted to the Government of the former
Yugoslav Republic of Macedonia and the Government of the Hellenic
Republic, respectively.

Ainsi composée,

Vu l’article 48 du Statut de la Cour et les articles 31, 44, 45, para-
graphe 1, et 48 de son Règlement,

Vu la requête enregistrée au Greffe de la Cour le 17 novembre 2008,
par laquelle l’ex-République yougoslave de Macédoine a introduit une
instance contre la République hellénique

«en vue de protéger les droits qu’[elle] tient de l’accord intérimaire
[du 13 septembre 1995] et d’être autorisé[e] à exercer ses droits en

tant qu’Etat indépendant agissant conformément au droit interna-
tional, et notamment le droit de demander son admission à des orga-
nisations internationales [en vertu du paragraphe 1 de l’article 11

dudit accord]»;
Considérant que, le 17 novembre 2008, une copie certifiée conforme de

la requête a été transmise à la République hellénique;

Composed as above,

Having regard to Article 48 of the Statute of the Court and to Articles
31, 44, 45, paragraph 1, and 48 of the Rules of Court,

Having regard to the Application filed in the Registry of the Court on
17 November 2008, whereby the former Yugoslav Republic of Macedo-
nia instituted proceedings against the Hellenic Republic

“to protect its rights under the Interim Accord [of 13 September
1995] and to ensure that it is allowed to exercise its rights as an inde-

pendent State acting in accordance with international law, including
the right to pursue membership of relevant international organisa-
tions [under Article 11, paragraph 1, of that Accord]”;

Whereas on 17 November 2008 a certified copy of the Application was

transmitted to the Hellenic Republic;

4 Considérant que l’ex-République yougoslave de Macédoine a désigné

comme agent S. Exc. M. Antonio Milošoski et comme coagent S. Exc.
M. Nikola Dimitrov; et que la République hellénique a désigné comme
agents S. Exc. M. Georges Savvaides, S. Exc. M. Constantin-John A.
Rallis et M me Maria Telalian;

Considérant que, au cours d’une réunion que le président de la Cour a
tenue avec les représentants des Parties le 19 janvier 2009, S. Exc. M.
Nikola Dimitrov, coagent de l’ex-République yougoslave de Macédoine,

se référant en particulier à la nature juridique de l’affaire et à l’absence de
nécessité d’effectuer des recherches factuelles ou historiques, a sollicité un
délai de quatre ou cinq mois, à partir de la date à laquelle l’ordonnance
serait rendue, pour la préparation du mémoire de son gouvernement; et
considérant que S. Exc. M. Georges Savvaides, agent de la République

hellénique, a notamment observé que son gouvernement n’était pas en
mesure à ce stade de faire la part des questions juridiques et autres qui
pouvaient se poser en l’affaire et souhaitait en conséquence disposer du
temps nécessaire pour la préparation de son contre-mémoire, qu’il a

estimé à douze mois;
Compte tenu des vues des Parties,

Fixe comme suit les dates d’expiration des délais pour le dépôt des

pièces de la procédure écrite:
Pour le mémoire de l’ex-République yougoslave de Macédoine, le
20 juillet 2009;

Pour le contre-mémoire de la République hellénique, le 20 janvier 2010;

Réserve la suite de la procédure.

Fait en français et en anglais, le texte français faisant foi, au Palais de

la Paix, à La Haye, le vingt janvier deux mille neuf, en trois exemplaires,
dont l’un restera déposé aux archives de la Cour et les autres seront
transmis respectivement au Gouvernement de l’ex-République yougo-
slave de Macédoine et au Gouvernement de la République hellénique.
