ORDER

The International Court of Justice,

Composed as above,
Having regard to Article 48 of the Statute of the Court and to
Articles4 and 48 of the Rules of Court,

Having regard to the Application filed in the Registry of the Court on
23 June 1999,whereby the Democratic Republic of the Congo instituted
proceedings against the Rwandese Republic in respect of a dispute
cerning "acts ourmlyd uggressioperpetrated by Rwanda on the terri-
tory of the Democratic Republic of the Congo, in flagrant violofion
the United Nations Charter and of the Charter of the Organization of
African Unity";

Whereas. on 23 June 1999, a certified copy of the Application was
transmitted to the Rwandese Republic;
Whereas the Denlocratic Republic of the Congo has appointed as
Agent Maître Michel Lion, advocate at thessels Bar; and the Rwan-dese Republic has appointed as Agent Mr. Gérard Gahima, procureur

Whereas, in its Application, the Democratic Republic of the Congo, in
order to found the jurisdiction of the Court, invokes the declaration
which it made on 8 February 1989in accordance with Article 36, para-
graph 2, of the Statute, and, while acknowledging that the Rwandese
Republic has not made such a declaration, states that "Article 38, para-
graph 5, of the Rules of Court allows a State against which an applica-

tion is filed to accept the jurisdiction of the Court for therpose of the
case"; and whereas, in the said Application, the Democratic Republic of
the Congo, referring to Article 36, paragraph 1, of the Statute, also
invokes, in order to found the jurisdiction of the Court, Article 30, para-
graph 1,of the Convention against Tortureand Other Cruel, Inhuman or
Degrading Treatment or Punishment, adopted by the General Assembly
of the United Nations on 10 December 1984, together with Article 14,
paragraph 1, of the Convention for the Suppression of Unlawful Acts
against the Safety of Civil Aviation, done at Montreal on 23 September
1971;

Whereas, at a meeting between the President of the Court and the rep-
resentatives of the Parties held on 19October 1999,the Agent of Rwanda
indicated, first, thatiis Government did not accept the proposal of the
Democratic Republic of the Congo that the jurisdiction of the Court
should be founded on a consent to be given in accordance with
Article 38, paragraph 5, of the Rules of Court, and second, that in the
opinion of his Governiment, the Court had no jurisdiction to entertain the
Application; and whereas, at the conclusion of this meeting, the Parties
agreed to request the Court to determine separatelythe questions ofjuris-
diction and admissibility in this case before any proceedings on the
merits, on the understanding that the Rwandese Republic would first
present a Memorial dealing exclusivelywith those questions and that the
Democratic Republic: of the Congo would reply to it in a Counter-
Memorial confined to the same questions;

Whereas it is necessary for the Court to be informed of al1the con-
tentions and evidence of fact and law on which the Parties rely in that
connection ;
Taking into account the agreement concerning the procedure reached
between the Parties, consulted under Article 31 of the Rules of Court,
and their views regarding the time-limits to be fixed for that purpose,

Decides that the ~vritten proceedings shall first be addressed to the
questions of thejuriscliction ofthe Court to entertain the Application and
of its admissibility;

Fi.ues the following:time-limits for the filing of those pleadings;

21 April 2000 for the Memorial of the Rwandese Republic; 23 October 2000 for the Counter-Memorial of the Democratic Repub-
lic of the Congo; and

Rrserves the subsequent procedure for further decision.

Done in French and in English, the French text being authoritative, at
the Peace Palace, The Hague, this twenty-first day of October, one thou-
sand nine hundred and ninety-nine, in three copies, one of which will be
placed in the archives of the Court and the others transmitted to the
Government of the Democratic Republic of the Congo and the Govern-
ment of the Rwandese Republic, respectively.

Having regard to Article 48 of the Statute of the Court and to

Whereas. on 23 June 1999, a certified copy of the Application was

Whereas the Denlocratic Republic of the Congo has appointed as

Considérant que, dans sa requête,la République démocratique du
Congo, aux fins de fonder la compétence dela Cour, invoque la déclara-
tion qu'elle a faite le 8 février1989 conformément au paragraphe 2 de

l'article 36 du Statut, et, tout en reconnaissant que la République rwan-
daise n'a pas fait une telle déclaration, expose que «[l']article 38, para-
graphe 5, du Règlement de la Cour permet ... à1'Etat contre lequel la
requêteest formée d'accepter la compétence de la Cour aux fins de
l'affaire)); et considérant que, dans ladite requête,la République démo-
cratique du Congo, se référantau paragraphe 1de l'article 36 du Statut,
invoque en outre, pour fonder la compétence dela Cour, le paragraphe 1
de l'article 30 de la convention contre la torture et autres peines ou trai-
tements cruels, inhumains ou dégradants, adoptée par l'Assemblée géné-
rale des Nations Unies le 10décembre1984,ainsi que le paragraphe 1de
l'article 14 de la convention pour la répression d'actesillicites dirigés
contre la sécurité de l'aviationcivile, faiteà Montréal le 23 septembre
1971 ;

Considérant que,au cours d'une réunion quele présidentde la Cour a
tenue avec les représentants des Parties le 19 octobre 1999, l'agent du
Rwanda a indiqué d'une part que son gouvernement n'acceptait pas la
proposition de la République démocratiquedu Congo de fonder la com-
pétencede la Cour sur un consentement qui serait donnéconformément
au paragraphe 5 de I'article38du Règlementet d'autre part que, de l'avis
de son gouvernement, la Cour n'avait pas compétencepour connaître de
la requête;et considérant que, au terme de cette réunion,les Parties sont
convenues de demander qu'il soit statuéséparément,avant toute procé-
dure sur le fond, sur les questions de compétence et de recevabilitéen
l'espèce,étantentendu que la Républiquerwandaise présenteraitd'abord

un mémoireconsacré àces seules questions et que la République démo-
cratique du Congo lui répondrait dans un contre-mémoire limitéaux
mêmesquestions;
Considérant qu'il échetque la Cour soit informéede tous les moyens
de fait et de droit sur lesquels les Parties se fondentce sujet;

Compte tenu de l'accord intervenu entre les Parties, consultées en vertu
de l'article1 du Règlement, au sujet de la procédure,ainsi que de leurs
vues quant aux délais à fixerà cet effet,

Dicide que les piècesde la procédure écriteporteront d'abord sur la
question de la compétence dela Cour pour connaître de la requêteet sur
celle de la recevabilitéde cette dernière;
Fix-c comme suit les dates d'expiration des délaispour le dépôtde ces
pièces:
