CASE CONCERNING SOVEREIGNTY OVER

PULAU LIGITAN AND PULAU SIPADAN

(INDONESIAIMALAYSIA)

ORDER

The President of the International Court of Justice,

Having regard to Article 48 of the Statute of the Court and to
Article 44 of theules of Court,
Having regard to the Special Agreement between the two Parties,
which was signed in Kuala Lumpur on 31 May 1997 and entered into
force on 14 May 1998,

Having regard to the Order of 14September 1999,whereby the Court,
taking account of the agreement of the Parties, extended until2 July 2000
the time-limit for the filingof a Counter-Memorial by each of the Parties;
Whereas, on 8 May 2000, the Agents of the two Parties addressed to
the Court a joint letter worded as follows:

"It is the Parties' position that the current eighttime-limit
for thesimultaneous filing of the Counter-Mernorial does not leave
sufficient time for the Parties to address issues which have been
raised in each Party's Memorial. Therefore, the Parties have agreed
to request jointly a further oneth extension for filing the Coun-
ter-Memorials to 2 August 2000. In al1 other respects, the Special
Agreement signed by the Parties on31May 1997and notified to the
Court on 2 November 1998 remains unchanged, including the date
for submission of the Reply.
The Parties would be grateful if the Court would take note of the
joint request and thereby modify the Order [of 14 September 19991 for the filing of the Parties' Counter-Memorials so as to reflect a
filing date of2 August 2000";
Taking account of the agreement of the Parties,

Extends until 2 August 2000 the time-limit for the filing of a Counter-
Mernorial by each of the Parties; and

Reserves the subsequent procedure for further decision.

Done in French and in English, the French text being authoritative, at
the Peace Palace, The Hague, this eleventh day of May, two thousand, in
three copies, one ofwhich will be placed in the archives of the Court and
the others transmitted to the Government of the Republic of Indonesia
and the Government of Malaysia, respectively.

ORDONNANCE

Le président dela Cour internationale de Justice,

Vu l'article 48 du Statut de la Cour et l'article 44de son Règlement,

Vu le compromis entre les deux Parties, signé Kuala Lumpur le
31 mai 1997et entréen vigueur le 14mai 1998,

Vu l'ordonnance du 14 septembre 1999,par laquelle la Cour, compte
tenu de l'accord desParties, a reporté au 2 juillet 2000 la date d'expira-
tion du délaipour le dépôtd'un contre-mémoirepar chacune des Parties;
Considérant que, le 8 mai 2000, lesagents des deux Parties ont adressé
àla Cour une lettre conjointe ainsi libellée:

((Les Parties estiment que le présent délai de huit mois pour le
dépôtsimultanédes contre-mémoiresne leur laissepas suffisamment
de temps pour traiter des questions qui ont été soulesans les
différentsmémoires.En conséquence, lesParties sont convenues de
demander conjointement un nouveau report d'un mois, jusqu'au
2 août 2000, de la date d'expiration du délai pour le dépôt des
contre-mémoires.Pour le reste, le compromis, signépar les Parties le
31 mai 1997 et notifiéà la Cour le 2 novembre 1998, demeure
inchangé, demêmeque la date fixéepour le dépôtdes répliques.
Les Parties seraient reconnaissantesla Cour de bien vouloir
prendre acte de cette demande conjointe et de modifier l'ordonnance INTERNATIONAL COURT OF JUSTICE

restera déposéaux archives de la Cour et les autres seront transmis res-
pectivement au Gouvernement de la Républiqued'Indonésie etau Gou-
vernement de la Malaisie.
