ORDER

The seniorjudge, actingPresident of the International Court of Justice
under Article 13,paragraph 3, of the Rules of Court,
Having regard to Article 66, paragraphsand 4, of the Statute of the
Court,

Whereas on 5 August 1998the United Nations Economic and Social
Council adopted the followingecision (decision 1998129:)
"The Economic and Social Council,

Having consideredthe note by the Secretary-General on the privi-
leges and immunities of the Special Rapporteur of the Commission
on Human Rights on the independence of judges and lawyersl,
Considering that a difference has arisen between the United
Nations and the Government of Malaysia, within the meaning of
Section 30of the Convention on the Privilegesand Immunities of the
United Nations, with respect to the immunity from legal process of
Dato' Param Cumaraswamy, the SpecialRapporteur of the Commis-
sion on Human Rights on the independence of judges and lawyers,
Recalling General Assembly resolution 89 (1) of 11 December

1946,
1.Requests on a priority basis, pursuant to Article 96, para-
graph 2, of the Charter of the United Nations and in accordance with General Assembly resolution 89 (1), an advisory opinion from the
International Court of Justice on the legal question of theapplicabi-

lity of Article VI, Section22, of the Convention on the Privilegesand
Immunities of the United Nations in the case of Dato' Param Cuma-
raswamyas SpecialRapporteur of the Commissionon Human Rights
on the independence of judges and lawyers, taking into account the
circumstances set out in paragraphs 1 to 15of the note by the Secre-
tary-Generall, and on the legal obligations of Malaysia in this case;
2. Calls upon the Government of Malaysia to ensure that al1
judgements and proceedings in this matter in the Malaysian courts
are stayed pending receipt of the advisory opinion of the Interna-
tional Court of Justice, which shall be accepted as decisive by the
parties.

Whereas certified true copies of the English and French texts of that
decision,of the note bythe Secretary-Generalreferredto therein,and of the
Addendum thereto (El1998194and Add. 1)were transmitted to the Court
by a letterfromthe Secretary-Generalof the United Nations dated 7August

1998and received in the Registry by facsimile on 10August 1998;
Whereas in fixingtime-limitsfor the proceedings, it is necessaryto bear
in mind that the request for opinion was expressed to be made "on a
priority basis",
Decides that the United Nations and the States which are parties to
the Convention on the Privilegesand Immunities of the United Nations
are likely to be able to furnish information on the question submitted to
the Court for advisory opinion;

Fixes 7 October 1998as the time-limit within which written statements
on the question may be submitted to the Court in accordance with
Article 66, paragraph 2, of its Statute;
Fixes 6 November 1998 as the time-limit within which States and
organizations having presented written statements may submit written
comments on other written statements, in accordance with Article 66,
paragraph 4, of the Statute of the Court; and
Reserves the subsequent procedure for further decision.

Le juge doyen,faisant.fonction de présidentde la Cour internationale
de Justiceenvertu du paragraphe3 de l'article13du Règlementde la Cour,

Vu les paragraphes2 et 4 de l'article 66 du Statut de la Cour,

Considérant que, le 5 août 1998,le Conseil économique et social des
Nations Unies a adoptéla décision19981297ci-après:

Ayant examinéla note du Secrétairegénérlur lesprivilèges et im-

munitésdu rapporteur spécialdela Commission desdroits del'homme
chargé dela question de l'indépendancedesjuges et des avocats',
Considérantqu'un différendoppose l'Organisation des Nations
Unies et le Gouvernement malaisien, au sens de la section 30 de la
convention sur les privilègeset immunitésdes Nations Unies, au
sujet de l'immunité dejuridiction de Dato'ram Cumaraswamy,
rapporteur spécialde la Commission des droits de l'homme chargé
de la question de l'indépendance desjuges et des avocats,

Rappelant la résolution89 (1)de l'Assembléegénérale, endate du

1. Prie la Cour internationale de Justice de doàntitre priori-
taire, en vertu du paragraphe2 de l'article 96 de la Charte des General Assembly resolution 89 (1), an advisory opinion from the

Cour par une lettre du Secrétairegénéral del'organisation des Nations

Considérant que,pour fixer les délaisde procédure,il est nécessairede
tenir compte du fait que la requêtepour avis consultatif a étéexpressé-
ment présentée «à titre prioritaire»,

Décideque l'organisation des Nations Unies et les Etats parties à la
convention sur lesprivilègeset immunitésdes Nations Unies sont suscep-
tibles de fournir des renseignements sur la question soumise à la Cour
pour avis consultatif;
Fixe au 7 octobre 1998la date d'expiration du délaidans lequel des
exposésécrits sur la question pourront êtreprésentés à la Cour confor-
mémentau paragraphe 2 de l'article 66 de son Statut;
Fixe au 6 novembre 1998la date d'expiration du délaidans lequel les

Etats ou organisations qui auront présentéunexposéécritpourront pré-
senter des observations écritessur les autres exposésécritsconformément
au paragraphe 4 de l'article 66 du Statut de la Cour;
Réservela suite de la procédure.
