Composed as above,

After deliberation,
Having regard to ~rticle 48 of the Statute of the Court and to Ar-
ticles 44 and 46 of the Rules of Court,
Having regard to the SpecialAgreement between the Republic of Bot-

swana and the Republic of Namibia, signed at Gaborone on 15February
1996 and notified jointly to the Court on 29 May 1996, whereby the
Parties submitted to the Court the dispute between them concerningthe
boundary around KasikiliISedudu Island and the legal status of the
island,
Having regard to the Order of the Court dated 24 June 1996, fixing
28 February 1997as the time-limit for the filingof a Memorial by each of
the Parties and 28 November 1997 as the time-limit for the filing of a
Counter-Memorial by each of the Parties, and reserving the subsequent

Vu l'article48 du Statut de la Cour et lesarticles44 et 46 de son Règle-

ment,
Vu le compromisentre la République duBotswana et la Républiquede
Namibie, signà Gaborone le 15 février1996et notifiéconjointàment
la Cour le 29 mai 1996,par lequel les Parties onàcelle-ci ledif-
férendqui les oppose concernant la frontière autour de l'îlede Kasikilil
Sedudu et le statut juridique de cette île,

Vu l'ordonnance de la Cour en date du 24 juin 1996, fixant au

28 février1997la date d'expiration du délaipour le dépôt d'unmémoire
par chacune des Parties et au 28 novembre 1997la date d'expiration du
délaipour le dépôt d'un contre-mémoire par chacunedes Parties, et
réservant la suitede la procédure;7 KASIKILI~SEDUDU ISLAND (ORDER 27 II 98)

Whereas the Memorials and Counter-Memorials of the Parties were
duly filed within the time-limitshus fixed;
Whereas in Article II, paragraph 2 (c), of the Special Agreement, the

Parties agreed that the written pleadings in the case should include, in
addition to the Memorials and Counter-Memorials, "such other . . .
pleadings as may be approved by the Court at the request of either of the
Parties, or as may be directed by the Court";
Whereas in a joint letter dated 16 February 1998 the Agents of the
Parties notified the Court that their Governments had "jointly decided
to request further written pleadings pursuant to Article II (2) (c) of
the Special Agreement", those pleadings to be filed by 27 November
1998;

Taking into account the agreement between the Parties,
Fixes 27 November 1998as the time-limit for the filing of a Reply by
each of the Parties; and

Reserves the subsequent procedure for further decision.

Done in English and in French, the English text being authoritative, at
the Peace Palace, The Hague, this twenty-seventh day of February, one
thousand nine hundred and ninety-eight, in three copies, one of which
will be placed in the archives of the Court and the others transmitted to
the Government of the Republic of Botswanaand the Government of the
Republic of Namibia, respectively.

étédûment déposés dans les délais ainsi fixés;
Considérantque, au paragraphe 2 c) de l'article II du compromis, les

Parties sont convenues que les piècesde la procédure écriteen l'espèce
comprendraient, outre les mémoires et contre-mémoires,((toutes autres
pièces ..dont le dépôt,a la demande de l'une oul'autre des Parties, aura
étéautorisépar la Cour, ou aura été prescritpar celle-ci));
Considérant que, par lettre conjointe en date du 16 février1998, les
agents des Parties ont fait savoir a la Cour que leurs gouvernements
avaient ((décidéconjointementde demander que des piècesde procédure
additionnelles puissent êtreprésentées conformémenatu paragraphe 2 c)
de l'article II du compromis)), dans un délai venant à expiration le
27 novembre 1998 ;

Compte tenu de l'accord intervenuentre les Parties,
Fixe au 27 novembre 1998la date d'expiration du délaipour le dépôt
d'une répliquepar chacune des Parties;

Réservela suite de la procédure.

Fait en anglais et en français, le texte anglais faisant foi, au Palais de la
Paix, àLa Haye, le vingt-sept févriermil neuf cent quatre-vingt-dix-huit,
en trois exemplaires, dont l'un restera déposaux archives de la Cour et
les autres seront transmis respectivement au Gouvernement de la Répu-
blique du Botswana et au Gouvernement de la Républiquede Namibie.
