The President of the International Court of Justice,

Havingregard to Article 48oftheStatute ofthe Courtand to Article 89
of theRules of Court,

Havingregard tothe Application filed bythe Republic of Nicaragua in
the Registry of the Court on 28July 1986,institutingproceedings against
the Republic of Costa Rica,
Having regard to the appointment by the Republic of Costa Rica, to
which a copy of the Application was communicated forthwith, of an
Agent and a Co-Agent for theurposes of the proceedings,

Having regard to the notification provided for in Article 63,ra-
graph 1,ofthe Statute addressed on3 November 1986tothe Statesparties
to the American Treaty for the Peaceful Settlement of Disputes ("Pact of
Bogota") signed atBogota on 30 April 1948,which was invoked in the
Application,
Havingregard tothe Order of21October 1986bywhichthe Court fixed
the time-limit forthe filingofthe Memorial ofthe Republic of Nicaragua
at 21July 1987,and the time-limit for the filing of the Counter-Memorial
of the Republic of Costa Rica at21 April 1988,and to the Order of

21 July 1987 by which the Vice-President of the Court extended those
time-limits to 10August 1987and 2June 1988respectively,
Having regard to the Memorial filed by the Republic of Nicaragua
within the time-limitas so extended,183 ARMED ACTIONS (ORDER 19VI1187)

Whereas,bya letter dated 11August 1987addressed tothe President of
the Court, the Minister for Foreign Affairs of the Republic of Nicaragua
transmitted a copy ofthe original Spanishtext of an agreement signed on
7 August 1987at Guatemala City by the Presidents of the five States of
Central America (the "Esquipulas II" agreement, entitled "Procedi-
miento para establecer una paz firme y duradera en Centro América");
Whereas, by a communication of 12 August 1987 addressed to the
Registrar, the Agent of Nicaragua referred to that agreement and stated
that "Nicaragua discontinues the judicial proceedings instituted against

Costa Rica";.
Whereas,by letters of 11and 12August 1987,the Registrartransmitted
a copy of the above-mentioned communications to the Agent of Costa
Rica and informed him that the President of the Court, pursuant to
Article 89,paragraphs2 and 3, of the Rules, had fixed 18August 1987as
the time-limitwithin whichCosta Rica might statewhether itopposed the
discontinuance ofthe proceedings by Nicaragua;

Whereas,bya letterof 18August 1987,received inthe Registrythe same
day, the Agent'ofCosta Rica stated (interalia)that his Government did
not object to the discontinuance;

Placesonrecordthe discontinuance by the Nicaraguan Government of
the proceedingsinstituted by the Application filed on 28July 1986;
Ordersthat the case be removed from the list.

Done in English and in French,the Englishtext being authoritative, at
the Peace Palace,TheHague,thisnineteenth day ofAugust,one thousand
nine hundred and eighty-seven, in three copies, of which one will be

placed in the archives of the Court, and the others transmitted to the
Government ofthe Republic of Nicaragua, and to the Government ofthe
Republic of Costa Rica, respectively.

Vu la requête enregistrée au Greffede la Cour le 28juillet 1986par la-
quelle la République du Nicaragua a introduit une instance contre la

République duCosta Rica,
Vula désignationpar la République du Costa Rica,uelle copie de
la requêteaimmédiatement étécommuniquée,d'un agentetd'un coagent
aux fins de l'instance,
Vulanotification prévue'article63,paragraphe 1,du Statut,adressée
le 3 novembre 1986aux Etats parties au traité américainde règlement
pacifique (((pactede Bogota signàBogota le 30 avril 1948,qui était

invoquédans la requête,

Vu l'ordonnance du 21 octobre 1986,par laquelle la Cour a fixéau
21juillet 1987la date d'expiration du délaipour ledépôtdu mémoiredela
Républiquedu Nicaragua et au 21avril 1988cellede l'expiration du délai
pour ledépôtdu contre-mémoirede la Républiquedu Costa Rica,etl'or-
donnance du 21juillet 1987,par laquelle le Vice-Présidentde la Cour a
reportéces dates au 10août 1987et au 2juin 1988respectivement,

Vu le mémoiredéposépar la Républiquedu Nicaragua dans le délai

Whereas,bya letter dated 11August 1987addressed tothe President of

Considérantque,dans une communication du 12août 1987adresséeau
Greffier, l'agentdu Nicaragua s'estréférécetaccord etadéclaréque «le
Nicaragua sedésiste de l'instanceintroduite contre le Costa Rica;

Considérant que, par lettres du 11 et du 12 août 1987,le Greffier a
transmis copie des communications susmentionnées a l'agent du
Costa Rica et l'a informéque le Présidentde la Cour, conformément à

l'article 89,paragraphes2 et3,du Règlement,avaitfixéau 18août 1987la
date d'expiration du délaidans lequel le Costa Rica pourrait déclarers'il
s'opposait au désistement duNicaragua;
Considérant que, par lettre du 18août 1987,reçue au Greffe le même
jour, l'agent du Costa Rica a déclaré notammentque son gouvernement
ne faisait pas objection au désistement;

Prendacte du désistement du Gouvernement nicaraguayen de l'ins-
tance introduite par la requête enregistré28juillet 1986;
Ordonneque l'affaire soitrayée du rôle.

Fait en anglais et en français, letexte anglais faisant foi, au palais de la
Paix,à La Haye, le dix-neuf août mil neuf cent quatre-vingt-sept, en trois
exemplaires, dontl'unrestera déposéauxarchivesdela Cour et lesautres
seront transmis respectivement au Gouvernement de la République du
Nicaragua et au Gouvernement de la Républiquedu Costa Rica.
