CASECONCERNING THE CONTINENTAL SHELF

(LIBYAN ARAB JAMAHIRIYA/MALTA)

ORDER

The Vice-President of the International Court of Justice,
Having regard toArticle 40and Article 48of the Statute of the Courtand
to Article 13, paragraph 3, Article 44, and Article 46 of the Rules of
Court,

Whereas by a letter dated 19July 1982,filed in the Registry of the Court
on 26July 1982,the Secretary of the People's Committee for the People's
Foreign Liaison Bureau of the Socialist People's Libyan Arab Jamahiriya
and theMinister for Foreign Affairs ofheRepublicof Malta transmitted to
the Registrar a certified true copy of a SpecialAgreement, and of a related
exchange of letters, signed at Valletta on 23 May 1976,by which their
Governments request the Court to decide the following question :

"What principles and rulesofinternational laware applicable to the
delimitation ofthe areaof thecontinental shelfwhichappertains tothe
Republic ofMalta and thearea ofcontinental shelfwhch appertains to
the Libyan Arab Republic, and how in practice such principles and
rules can be applied by the two Parties in this particular case in order
that theymay without difficulty delimit such areas by an agreement as
provided in Article III";

Whereas the Secretary of the People's Committee for the People's For-
eign Liaison Bureau of the Libyan Arab Jamahiriya and the Minister for
ForeignAffairs of Malta alsoenclosedwith their letter the procès-verbalof
the exchange of instruments for the ratification of the SpecialAgreement,
which took place at Valletta on 20 March 1982 ;
Whereas Article IV of the SpecialAgreement provides for its entry into555 CONTINENTAL SHELF (ORDER 27 VI1 82)

force on the date of exchange of the instruments of ratification and for its
joint notification to the Registrar of the Court ;

Whereas in the said letter the two ministers stated that Dr. Abdelrazeg
El-Murtadi Suleiman had been appointed Agent of the Libyan Arab
Jamahiriya and Dr. Edgar Mizzi Agent of Malta, for the purposes of the
case ;
Whereas the views of the Parties with regard to questions of procedure
provided for in paragraph 2 of Article II of the Special Agreement are as
follows :

"Without prejudice to any question of the burden of proof, the
written pleadings shall consist of the following documents :

(a) Memorials to be submitted simultaneouslyto the Court by each
Party and exchanged with one another within a period of nine
months from the date of the notification of this agreement to the
Registrar of the Court.
(b) Replies to be similarly submitted to the Court by each Party and
exchanged with one another within four months after the date of
the submissions of the Memorials to the Registrar.

(c) Additional written pleadings may be presented and exchanged in
thesamemanner withinperiodswhichshallbefixedby theCourt at

the request of one of the Parties, or if the Court so decides after
consultation with the two Parties" ;
Taking this agreement into account, as provided in paragraph 2 of
Article 44 of the Rules of Court ;

Fixes 26 April 1983 as the time-limit for the filing of Memorials by
the Socialist People's Libyan Arab Jamahiriya and by the Republic of
Malta ;

Reserves the subsequent procedure for further decision.

Le Vice-Président de la Cour internationale de Justice,

Vu les articles 40 et 48 du Statut de la Cour et les articles 13, para-
graphe 3, 44 et 46 du Règlement de la Cour,

Considérant que, par lettre du 19juillet 1982déposéeau Greffe de la
Cour le 26 juillet 1982, le secrétaire du comité populaire du Bureau
populaire de liaison avecl'étrangerde laJamahiriya arabe libyenne popu-

laire et socialiste et leministre des affaires étrangèresde la République de
Malte ont transmis au Greffier la copie certifiéeconforme d'un compro-
mis,accompagnéd'un échangede lettres, signé à La Valette le 23 mai 1976
et par lequel leurs gouvernements sont convenus de prier la Cour de
trancher la question suivante :
<<Quels sont les principes et les règles de droit international qui

sont applicablesà la délimitation de la zone du plateau continental
relevant de la République de Malte et de la zone du plateau conti-
nental relevant de la République arabe libyenne, et comment, dans
la pratique, ces principes et règles peuvent-ils êtreappliqués par
les deux Parties dans le cas d'espèceafin qu'elles puissent délimiter
ces zones sans difficulté par voie d'un accord, comme le prévoit
l'article III;

Considérant que le secrétairedu comitépopulaire du Bureau populaire
de liaison avecl'étrangerde laJamahiriya arabe libyenne et leministredes
affaires étrangèresde Malte ont égalementjoint a leur lettre le procès-
verbal de l'échangedesinstruments de ratification du compromis, échange
qui a eu lieuà La Valette le 20 mars 1982 ;
Considérant que l'article IVdu compromis prévoitque celui-ci entrera555 CONTINENTAL SHELF (ORDER 27 VI1 82)

la Jamahiriya arabe libyenne et M. Edgar Mizzi comme agent de Malte,
aux fins de l'affaire;
Considérantque lesvues des Parties sur lesquestions de procéduresont
énoncées à l'article II du compromis, au paragraphe 2 duquel elles sont
convenues que :

<<Sanspréjudicede toute question quipourrait se poser quant à la
charge de la preuve, la procédure écrite secomposera des pièces
suivantes :

a) Mémoiresdevantêtresoumissimultanément àla Cour par chacune
des Parties et échangésentre elles dans un délaide neuf mois à
compter de la date de la notification du présent compromis au
Greffier de la Cour.
6) Des répliquesdevant êtresoumises à la Cour de la mêmemanière
par chacune des Parties et échangéesentre elles dans un délaide
quatre mois àcompterde la date de la soumission desmémoiresau
Greffier.
c) D'autres pièces de procédure écritepourront êtreprésentéeset

échangées de la mêmemanièredans des délaisqui seront fixéspar
laCour à lademandede l'unedesPartiesou, sila Courjuge qu'ilya
lieu, après consultation avec les deux Parties));
Tenant compte de cet accord ainsi que le prévoit l'article44, para-
graphe 2, du Règlement ;

Fixe au 26 avril 1983la date d'expiration du délai pour le dépôt des
mémoiresde la Jamahiriya arabe libyenne populaire et socialiste et de la
République de Malte ;

Réserve lasuite de la procédure.

Fait en anglais et en français, le texte anglais faisant foi, au palais de la
Paix, à La Haye, le vingt-sept juillet mil neuf cent quatre-vingt-deux, en
trois exemplaires, dont l'un resteradéposéaux archives de la Cour et dont
les autres seront transmis respectivement au Gouvernement de la Jama-

hiriya arabe libyenne populaire et socialiste et au Gouvernement de la
Républiquede Malte.
