MakesthefollowingOrder:

Having regard to Article48 of the Statuteof the Court and to Article44
of the Rules of Court,

Having regard to theder of 21 April 1989by which time-limits for
the written proceedings on the merits were fixed as follows: 19
ber 1989for the Memorial of Nicaragua and 19 February 1990for the
Counter-Memorial of Honduras,
Having regard totheder of 31August 1989by whichthe Presidentnf
the Court, at the request of Nicaragua, extended to 8 December 1989
the time-limit forthe Memorial of Nicaragua on the merits; and

Whereas the Memorial of Nicaragua was duly filed within the
limit assoextended;
Whereas when theOrder of 31 August 1989was adopted the question
of extension of the time-limit for the filing of theMernorial
of Honduras was reserved;175 ARMED ACTIONS (ORDER 14XII 89)

Whereas by a letter dated 13December 1989and received inthe Regis-
try thesame day, the Agent of Nicaragua transmitted to the Court a copy
of an agreement in Spanish reached by the Presidents of the Central
American countries on 12 Decernber 1989in San Isidro de Coronado,
Costa Rica, and drew the attention of the Court in particular to para-
graph 13of that agreement;

Whereas by a letter dated 13December 1989and received in the Regis-
try on 14December 1989,the Agent of Honduras similarly informed the
Court ofthe agreement of 12December 1989and referred in particularto
paragraph 13thereof;
Whereas that paragraph records the agreement of the President of
Nicaragua and the President of Honduras,inthe context of arrangements
aimed at achieving an extra-judicialsettlement ofthe dispute which isthe
subject of the present proceedings, to instruct their Agents in the case to
communicate immediately, either jointly or separately, the agreement to

theCourt, and to request the postponement ofthedate forthe fixing ofthe
time-limit for the presentation of the Counter-Memorial of Honduras
until 11June 1990;
Whereas that paragraph further provides that if no extra-judicial
settlement of the dispute has been reached by that date, either Party may
request that Honduras be granted six months for the filing of its
Counter-Memorial;

Taking into account the agreement of the Parties, in accordance with
Article 44,paragraph 2, of the Rules of Court,

Unanimously,

Decidesthat the time-limit for the filing by the Republic of Honduras
of a Counter-Memorial on the merits is extended from 19February 1990
to a dateto be fixed by anorder to be made after 11June 1990.

Done in English and in French, the English text being authoritative, at
the Peace Palace,The Hague,this fourteenthday of December, one thou-

sand nine hundred and eighty-nine, in three copies, one of which willbe
placed in the archives of the Court and the others transmitted to the
Government of the Republic of Nicaragua and the Government of the
Republic of Honduras, respectively.

Considérant que par une lettre en date du 13décembre1989,reçue au
Greffele même jour, l'agent du Nicaragua atransmisla Cour copied'un
accord en espagnol, conclu par les présidentsdespays d'Amériquecen-
trale le 12décembre 1989 à San Isidro de Coronado,(Costa Rica), et a
appelél'attention de la Cour, en particulier, sur le paragraphe 13dit
accord;

Considérantque par une lettre en date du 13décembre1989,reçue au
Greffe le 14décembre 1989,l'agent du Honduras a de mêmeinforméla
Cour de l'accord du 12décembre 1989et s'est référé en particulierau
paragraphe 13de cet accord ;
Considérantque, dans ceparagraphe, ilestrapportéque leprésidentdu

Nicaragua et le président du Honduras sont convenus, dans le contexte
des arrangements visantà parvenir àun règlementextrajudiciaire du dif-
férendqui faitl'objet de la présente procédure,de chargerleursagents en
l'affairede communiquerimmédiatement,conjointement ou séparément,
l'accordà la Cour et de demander àcelle-ciqu'elle diffèreladatede fixa-
tion du délai pour la présentation du contre-mémoire du Honduras
jusqu'au Il juin 1990;
Considérant que ce paragraphe dispose en outre que si aucun règle-

ment extrajudiciaire du différend n'était intervenucette date, l'une ou
l'autre des Parties demanderaità la Cour d'accorder au Honduras un
délaide sixmois pour le dépôtde son contre-mémoire;
Tenant compte de l'accord intemenu entre les Parties, conformément
au paragraphe 2 de l'article 44du Règlementde la Cour,

à l'unanimité,
Décidequeladate limitepour ledépôtpar la République duHonduras
d'un contre-mémoiresur lefond estreportéedu 19février1990 à unedate

à fixer par ordonnance qui sera rendue après le 11juin 1990.

Fait en anglais et en français, letexte anglaisfaisant foi, au palais de la
Paix,à La Haye, lequatorze décembremilneuf centquatre-vingt-neuf,en
trois exemplaires, dont'un restera déposé auxarchives de la Cour et les
autres seront transmis respectivement au Gouvernement de la Répu-
blique du Nicaragua et au Gouvernement de laRépubliquedu Honduras.
