After deliberation,
Havingregard to Articleofthe Statute ofthe Court and to Article 45,
paragraph 2, and Article 49,paragraph 3, ofthe Rules of Court,

Havingregard to theJudgment delivered by the Court on 26June 1992
bywhich itupheld a preliminaryobjection filed byAustralia tothe admis-
sibilityofaparticular claim,but rejected theother preliminary objections,
tojurisdiction and admissibility,filed by Australia,

Having regard to the Order made by the President of the Court on
29 June 1992by which 29 March 1993was fixed for the filing of the
Counter-Memorial of Australia;

Whereas the Counter-Memorial of Australia was duly filed on
29 March 1993;
Whereas by a letter dated 3 May 1993the Agent of Nauru statedthat,
having studied the Counter-Memorial, his Govemment considered that asecondround ofpleadingswasnecessary,and requested leavetosubmita

Reply;
Whereas the Agent of Australia, by a letter of 17 May 1993,gave
the views of his Govemment on this request, and the Agent of Nauru
commented thereon by a letter of 24 May 1993; whereas the Agent of
Australia,by a furtherletter, dated 27May 1993,suggestedthat the Presi-
dent ofthe Court mightregard itasappropriateto directa further meeting
withthe Agents;
Whereasthe President ofthe Court held a meeting with the Agentson
4 June 1993to ascertain more fully the views of the Parties on the pro-
cedure to be followed;

Whereasthe Court, having thus ascertained the viewsof the Parties, is
satisfiedthat the filing of a Replyby Nauru and a Rejoinder byAustralia
is necessary, and makes this Order under Article 45,paragraph 2, of the
Rules of Court;
Whereas the Parties agreed atthe meeting held on 4 June 1993that, if
theCourtfound itappropriateto authorizethefiling offurther pleadings,
time-limits therefor, giving an equal period for each Party, should be
calculated from the date of filing of the Counter-Memorial, but the
time-limitforthe Replyshouldbea datenot less than sixmonthsafterthe
Court's decision;

Takinginto accountthe views ofthe Parties,
Decides that the filing of a Reply by the Republic of Nauru and a
Rejoinder by the Commonwealth of Australia is necessary, and directs
that suchpleadings be filed;

Fixesasfollowsthe time-limitsfor those pleadings :

22December 1993forthe Reply of Nauru;
14September 1994forthe Rejoinder of Australia; and
Resewes the subsequentprocedure for further decision.

par l'Australie est nécessaire,et rend la présenteordonnanceen vertu du
paragraphe 2 de l'article 45 de son Règlement;
Considérant queles Parties sont convenues,àla réuniontenue le4juin
1993,que, silaCour jugeait bon d'autoriser la présentation de nouvelles
pièces écrites,les délaisà cet effet, de mêmeduréepour chacune des
Parties, devraient courir à partir de la date du dépôt du contre-
mémoire,maisque ledélaipour ledépôtdelarépliquene devraitpas être
d'une durée inférieureà six mois àcompter de la décisionde laCour;

Comptetenu des vues des Parties,
Décideque ledépôtd'unerépliquepar laRépubliquede Nauru etd'une
duplique par le Commonwealthd'Australie est nécessaire,et prescritque
cespiècessoient déposées;

Fixecommesuit les dates d'expiration des délais pour le dépôtde ces
piècesde procédure:
Pourla répliquede Nauru, le 22décembre1993 ;
Pourla dupliquede l'Australie, le 14septembre 1994;
