(REQUEST FOR ADVISORY OPINION)

ORDER

The President of the International Court of Justice,

Having regard to Article 66, paragraph 2, of theute of the Court,
Whereas on 24 May 1989the United Nations Economic and Social
Council adopted the foliowing resolution (resolution 1989/:5)

"The Economic and Social Council,
Having consideredresolution 1988/37 of 1September 1988of the
Sub-Commission on Prevention of Discrimination and Protection of
Minorities and Commission onHuman Rights resolution 1989/37 of

6 March 1989,
1. Concludesthat a difference has arisen between the United Na-
tions and the Government of Romania as to the applicability of the
Convention onthe Privileges and Immunities of the United Nations
[General Assembly resolution 22 A (1)]to Mr.Dumitru Mazilu as
Special Rapporteur of the Sub-Commission on Prevention of Dis-
crimination and Protection of Minorit;es

2. Requests, on a priority basis, pursuant to Article 96, para-
graph 2,ofthe Charter ofthe United Nations and in accordance with10 PRIVILEGES AND IMMUNITIES (ORDER 14VI 89)

General Assemblyresolution 89(1)of 11December 1946,an advisory
opinionfromthe International Court ofJustice on the legal question
ofthe applicability ofArticle VI,Section 22,oftheConventiononthe
Privileges and Immunities of the United Nations in the case of
Mr. Dumitru Mazilu as Special Rapporteur of the Sub-Commis-
sion" ;

Whereas certified true copies of the English and French texts of that
resolution were transmitted to the Court by a letter from the Secretary-
General of the United Nations dated 1 June 1989,and received in the
Registry on 13June 1989;

Whereas in fixing time-limits for the proceedings, it is necessary to
bear in mind that the request for opinion was expressed to be made "on a
priority basis",

Decidesthat the United Nations and the States which areparties to the
Convention on the Privileges and Immunities of the United Nations are
likely to be able to furnish information on the question submitted to the
Court for advisory opinion;
Fixes31 July 1989as the time-limit within which written statements
maybesubmitted to the Court in accordance with Article 66,paragraph 2,
of theStatute of the Court;

Fixes31 August 1989as the time-limit within which States and orga-
nizations having presented written statements may submit written
comments on other written statements, in accordance with Article 66,
paragraph 4, of the Statute of the Court;
Reserves the subsequentprocedure forfurther decision.

the Peace Palace, The Hague, this fourteenth day of June, one thousand
nine hundred and eighty-nine.

Considérant que, le24 mai 1989,le Conseil économiqueet social des
Nations Unies a adoptéla résolution989/75 ci-aprè:
«Le Conseiléconomiqueetsocial,

Ayant examinéla résolution1988/37de la Sous-Commission de la
luttecontre lesmesuresdiscriminatoires etdelaprotection desmino-
rités,en date dule' septembre 1988,et la résolution 1989/37 de la
Commission des droits de l'homme, en date du 6 mars 1989,
1. Conclut qu'une divergence de vues s'est éleentre l'Orga-
nisation des Nations Unies et le Gouvernement roumain quant à
I'applicabilitéde la convention sur les privilègeset immunitésdes
Nations Unies [résolution2 A (1)de l'Assembléegénérale]au cas

de M. Dumitru Mazilu, en sa qualité de rapporteur spécialde la
Sous-Commission de la lutte contre les mesures discriminatoires et
de la protection desminorités;
2. Demande à titre prioritaàla Cour internationale de Justice,
en application du paragraphe 2 de l'article 96 de la Charte des10 PRIVILEGES AND IMMUNITIES (ORDER 14VI 89)

Décideque l'organisation des Nations Unies et les Etats parties à la

convention sur lesprivilègesetimmunitésdes Nations Unies sont suscep-
tibles de fournir des renseignements sur la question soumise à la Cour
pour avis consultatif;
Fixeau 31 juillet 1989la date d'expiration du délaidans lequel des
exposés écritspourront être présentés à la Cour conformément au
paragraphe 2 de l'article 66de son Statut;

Fixeau 31août 1989la date d'expiration du délaidans lequel les Etats
ou organisations qui auront présentéun exposé écritpourront présenter
des observations écritessur les autres exposés écrits conformémentau
