CASE CONCERNING THE FRONTIER DISPUTE
(BURKINA FASO/MALI)

ORDER

The President of the International Court of Justice,

Having regard to Article 48 of thetatute of the Court, and to Articles
31, 44, 46 and 92, paragraph 1,of the Rules of Court,
Having regard to the Special Agreement concluded on 16 September
1983between the Republic of Burkina Faso (then called Upper Volta) and

the Republic of Mali for the submission of a dispute concerning the
delimitation of their common frontier to a chamber of the Court,
Having regard to the Order of 3April 1985by which the Court acceded
to the request of theParties to form a specialchamber of fivejudges to deal
with the case and declareda chamber to have been duly constituted to that
effect,

Whereas Article III, paragraph 2,of the aforesaid Special Agreement
recordsinteralia the agreement of the Parties that, without prejudice to
any questionasto theburden ofproof, thewritten proceedings shouldfirst
comprise a Memorial filedbyeach Partynot later than sixmonths after the
adoption by the Court of the Order constituting the Chamber; and
whereas, having been consulted on 14March 1985,the Parties have con-
firmed that agreement ;
Having consulted the Chamber,

Fixes 3 October 1985as the time-limit for the filing of a Memorial by
each Party. Done in English and in French, the English text being authoritative, at
the Peace Palace, The Hague, this twelfth day of April, onethousande
hundred and eighty-five,in three copies, of which one willbe placed in the
archives of the Court, and the others transrnitted to the Government of
Burkina Faso and to the Government of Mali, respectively.

Le Présidentde la Cour internationale de Justice,

Vu l'article 48 du Statut de la Cour et les articles 31, 44, 46 et 92,
paragraphe 1,de son Règlement,
Vu le compromis conclu le 16 septembre 1983entre la République du
Burkina Faso (alors Haute-Volta) et la République du Mali en vue de
soumettre à une chambre de la Cour un différend concernant la délimi-

tation de leur frontière commune,
Vu l'ordonnance du 3 avril 1985 par laquelle la Cour a accédé àla
demande des Parties tendantà former une chambre spécialede cinqjuges
pour connaître de l'affaire et a déclarélachambredûment constituàcet
effet,

Considérantquel'articleIII,paragraphe 2,du compromissusmentionné
consacre notamment l'accord des Parties pour que, sans préjugeraucune
question relativà la charge de la preuve, la procédureécrite commence
par le dépôtd'un mémoirepar chacune d'ellesau plus tard six mois après
l'adoption par la Cour de l'ordonnance constituant la chambre;et que
les Parties, interrogéeà ce sujet le 14 mars 1985, ont confirmé cet
accord ;
Après avoir consulté la chambre,

Fixe au 3 octobre 1985la date d'expiration du délai pourle dépôt d'un
