The International Court of Justice,

Composed as above,

After deliberation,
Having regard to Article 26, paragraph 2, Article 31 and Article 48 of
the Statute of the Court, and to Articles 17, 18 and 35 of the Rules of
Court,

Makes thefollowing Order :

1. Whereas by ajoint letter dated 14October 1983,filed in the Registry
of the Court on 20 October 1983,the Ministers for Foreign Affairs of the
Republic of Upper Volta(since and hereinafter called Burkina Faso) and
the Republic of Mali transrnitted to the Registrar a certified copy of a
Special Agreement dated 16September 1983,and entering into force on
that date, by which their Governments agreed to submit a disputeon-
cerning the delimitation of their common frontier to a Chamber of the
Court ;7 FRONTIER DISPUTE (ORDER 3 IV 85)

2. Whereas the Government of Burkina Faso subsequently appointed
Mr. Ernest Nongoma Ouedraogo, Minister for Territorial Affairs and
Security,asits Agent and Mr. Emmanuel Salambere, Ambassador in Paris,
as Co-Agent for the purposes of the case, while the Government of Mali

appointed Lieutenant-Colonel Abdourahamane Maiga, Minister of the
Interior, and Mr. Yaya Diarra, Ambassador in Brussels,to be respectively
its Agent and Co-Agent ;
3. Whereas the Special Agreement provides in Article II for the sub-
mission of the dispute to a Chamber to be formed pursuant to.Article 26,
paragraph 2, of the Statute of the Court ;
4. Whereas on 14 March 1985the Parties, duly consulted by the Presi-
dent as to the composition of the proposed Chamber, indicated that they
desired the formation of a Chamber of fivemembers, of whom two would
bejudges adhocchosen by the Partiesin accordance with Article 31of the
Statute of the Court ;and whereas on the same occasion they confirmed
their wish that the Court should now proceed to constitute such a Cham-
ber ;
5. Whereas,byaletter dated 29August 1984,theAgent of Burkina Faso

notified to the Court his Government's choice of Mr. François Luchaire,
Professor at the University of Paris 1,to sit asjudge ad hoc ; and whereas
the Co-Agent of Mali, by a letter of 18March 1985,notifed his Govern-
ment's choice of Mr. Georges Abi-Saab, Professor at the Graduate Insti-
tute of International Studies,Geneva, to sit asjudge adhoc ; and whereas
no objection has been raised by either Partyto the other's choice and none
appears to the Court itself ;

Unanimously,

1. Decidesto accede to the request of theGovernments of Burkina Faso
and Mali to form a special Chamber of fivejudges to deal with the present
case ;
2. Declaresthat at an election held on 3April 1985Judges Lachs, Ruda
and Bedjaoui were elected toform, with the above-named judges ad hoc,
a Chamber to deal with this case and that, accordingly, such a Chamber
is duly constituted by the present Order, with the following composi-

tion :

Burkina Faso and to the Government of Mali respectively.

Vu les articles 26, paragraphe 2, 31et 48 de son Statut et les articles 17,

Rend l'ordonnance suivante

1. Considérantque,par lettre conjointe du 14octobre 1983déposéeau
Greffe de la Cour le 20 octobre 1983,les ministres des affaires étrangères
de la Républiquede Haute-Volta (devenuedepuis et dénomméeci-aprèlse
Burkina Faso) et de la Républiquedu Mali ont transmis au Greffier copie
certifiéeconforme d'un compromis datédu 16 septembre 1983,entré en
vigueur le mêmejour, par lequel lesgouvernements de cesdeux Etats sont

convenus de soumettrà une chambre de la Courun différendconcernant
la délimitationde leur frontière commu;e7 FRONTIER DISPUTE (ORDER 3 IV 85)

2. Whereas the Government of Burkina Faso subsequently appointed
Mr. Ernest Nongoma Ouedraogo, Minister for Territorial Affairs and

suite M. Ernest Nongoma Ouedraogo, ministre des affaires territoriales et

de la sécuritéc,omme agent et M. Emmanuel Salambere, ambassadeur à
Paris,commecoagent aux fins del'affaire,etque leGouvernement du Mali
a désignépour sa part le lieutenant-colonel Abdourahamane Maiga,
ministre de l'intérieur, et M. Yaya Diarra, ambassadeur à Bruxelles,
comme agent et coagent respectivement ;
3. Considérant que l'article II du compromis prévoitla saisine d'une
chambredevantêtreconstituéeen application del'article26,paragraphe 2,
du Statut de la Cour ;
4. Considérant que, le 14 mars 1985, les Parties, dûment consultées
par le Présidentau sujet de la composition de la chambre en question,
ont indiqué qu'elles souhaitaient la formation d'une chambre de cinq
membres, dont deuxjuges adhocdésignés par les Parties conformément à
l'article 31 du Statut de la Cour ; et qu'à la même occasionelles ont

confirmé leurdésirde voir la Cour procéder immédiatement à la consti-
tution de la chambre ;
5. Considérantque, par lettre du 29août 1984,l'agentdu Burkina Faso
a notifié àla Cour la désignationpar son gouvernement de M. François
Luchaire, professeur àl'université de Paris1,pour siégercommejuge ad
hoc ; et que, par lettre du 18 mars 1985,le coagent du Mali a notifiéla
désignationpar son gouvernement de M. Georges Abi-Saab, professeur à
l'Institut des hautes étudesinternationales de Genève,pour siégercomme
juge ad hoc ; et considérant qu'aucune objection n'a étésoulevéepar la
Partie adverse et que la Cour elle-même n'en voia tucune ;

à l'unanimité,
1. Décided'accéder àla demande des Gouvernementsdu Burkina Faso
et du Mali tendant à former une chambre spécialede cinq juges pour

connaître de la présente affaire;
2. Déclareque, le3avril 1985,MM. Lachs, Ruda et Bedjaoui,juges, ont
étééluspour former, avec lesjuges ad hocsusmentionnés,la chambre qui
sera saisie de l'affaire etqu'en conséquenceladite chambre, dont la com-
position est indiquéeci-après, estdûment constituéeenvertu de laprésente
ordonnance :
