CONCERNING THE TERRITORY OF
SOUTH-WEST AFRICA

(REQUEST FOR ADVISORY OPINION)

ORDER

The President of the International Court of Justice,

having regard to Article, paragraph 2, of the Statute of the
Court ;
Whereas on November 23rd, 1954,the General Assembly of the
United Nations adopted a resolution requesting the International
Court of Justice to give an advisory opinion on the following ques-
tions:

(a) 1s the following rule on the voting procedure to be followed
by the General Assembly a correct interpretatioof the
advisory opinion of the InternationCourt of Justice of
11JU~Y 1950 :

"Decisions of the General Assembly on questions relating
to reports and petitions concerning the Temtory of South-
West Africa shall be regarded as important questions
within themeaning of Article18, paragraph 2, of the
Charter of the United Nations."
(b) If this interpretatof the advisory opinion of the Court
is not correct, what voting procedure should be followed
by the General Assembly intaking decisions on questions
relating to reports and petitions concerning the Territory

li'hcreas certified true copies of the English and French texts of

the aforvsaid resolution of the General +4ssemblywere transmitted
to the Court by a letter of the Secretary-General of the United
Kations dated December znd, 1954, and filed in the Registry on
December 6th, I9j4 ;

Fixes Alarch ~jth, 19jj, as the time-limit within which written
statements may be submitted by any State entitled to appear before
the Court or any international organization considered bythe Presi-
dent as likely to be able to furnish information on the questions
referred to the Court ;

Reserves the rest of the procedure for further decision.

Done in English and French, the English text being authoritative,
at the Peace Palace, The Hague, this fourteenth day of December,
one thousand nine hundred and fifty-four.

ORDONNANCE

Le Président de la Cour internationale de Justice,

vu l'article 66, paragrap2,du Statut de la Cour;

Considérant que le 23 novembre 1954 l'Assembléegénéraledes
Nations Unies a adopté une résolution demandant la Cour inter-
nationale de Justice de rendre un avis consultatif sur les questions
suivantes :

a) L'article ci-après relatif à la procédure de vote que 1'Assem-
blée généraledevra suivre correspond-àlune interprétation
exacte de l'avis consultatif de la Cour internationalde
Justice en date du II juillet 1950 :
«Les décisions de l'Assemblée généraeur les questions
touchant les rapports et les pétitions relatifs au territoire

du Sud-Ouest africain sont considérées commequestions
importantes au sens du paragraphe2 de l'article 18 de la
Charte des Nations Unies.» ?
b) Si cette interprétation de l'avis consultatif de la Cour n'est
pas exacte, quelle procédure de vote l'Assemblée générale
devrait-elle suivre pour prendre des décisionssur les questions
touchant les rapports et les pétitions relatifs au territoire
du Sud-Ouest africain?
