ORDER

The President of the Interilational Court of Justice,
Having regard to Article 48 of the Statute of the Court and to Article
74 of the Rules of Court,
Having regard to the Application by Pakistan filed in the Registry of
the Court on 11 May 1973, instituting proceedings against India in

respect of a dispute concerning charges of genocide against 195Pakistani
nationals, prisoners of war or civilian internees in Indian custody,
Whereas this Application was, inaccordance withArticleragraph
2, of the Statute of the Court, communicated to the Government of India,
and was, in accordance with Article 40, paragraph 3, of the Statute,
notified to Members of the United Nations and to the other States
entitled to appear before the Court;
Whereas the notification provided for in Article paragraph 1, of

the Statute was addressed to the States parties to the Convention for the
Prevention and Punishment of the Crime of Genocide adopted by the
General Assembly of the United Nations on 9 December 1948, which
was invoked in the Application;
Whereas by an Order dated 13 July 1973the Court decided that the
written proceedings should first be addressed to the question of the juris-
diction of the Court to entertain the dispute, and fixed 1 October 1973
as the time-lirnit for the Memorial of the Government of Pakistan and
15 December 1973 as the time-limit for the Counter-Memorial of the348 PAKISTANI PRISONERS OF WAR (ORDER 15XII 73)

Government of India, and whereas by an Order of 29 September 1973
the President of the Court extended to 15December 1973,at the request
of the Agent of Pakistan, the time-limit for the filing of the Memorial
and extended to 17May 1974the time-limit for the filing of the Counter-
Memorial ;

Whereas by a letter dated 14 December 1973 and received in the
Registry the same day, the Agent of Pakistan referred to negotiations
between the Government of Pakistan and the Government of India which
had resulted in an agreement signed at New Delhi on 28 August 1973,
and, with a view to facilitn'ing further negotiations, requested the Court
to make an Order officiallyrecording discontinuance of the proceedings
in thiscase;
Whereas the Government of Pakistan has thus informed the Court in

writing that it is not going on with the proceedings;
Whereas the Government of India, while it has addressed certain
communications to the Court through its Ambassador in The Hague,
has not yettaken any step in the proceedings;

Places on record the discontinuance by the Government of Pakistan
of the proceedings instituted by the Application filed on 11May 1973;
Orders that the case be removed from the list.

Done in English and in French, the English text being authoritative,
at the Peace Palace, The Hague, this fifteenth day of December, one
thousand nine hundred and seventy-three, in three copies, one of which
will be placed in the archives of the Court and the others transmitted to
the Government of Pakistan and the Government of India respectively.

Le Présidentde la Cour internationale de Justice,
Vu l'article 48 Statut de la Cour et l'article 74 du Règlementde la
Cour,

Vu la requêteenregistréeau Greffe de la Cour le 11 mai 1973, par
laquelle le Pakistan a introduit une instance contre l'Inde au sujet d'un
différend concernant des accusations de génocide portéescontre 195
Pakistanais, prisonniers de guerre et internéscivils, détenusen Inde,
Considérant que cette requête a été communiquéaeu Gouvernement
indien conformémentà l'article 40, paragraphe 2, du Statut de la Cour,
et que les Membres des Nations Unies ainsi que les autres Etats admis
ester en justice devant la Cour en ont étéinformés conformémeàt
l'article 40, paragra.phe 3, du Statut;

Considérant que la notification prévuerticle 63, paragraphe 1, du
Statut, a éadresséeaux Etats parties Convention pour la prévention
et la répressiondu crime de génocideadoptée par l'Assemblée générale
des Nations Unies le 9décembre1948,qui était invoquéedans la requête;

Considérant que, par ordonnance du 13juillet 1973,la Cour a décidé
que les pièces écritesporteraient d'abord sur la question de la compé-
tence de la Cour pour connaître du différendet fixéauctobre 1973
la date d'expiration du délaipour ledépôtdu mémoiredu Gouvernement
pakistanais et au 15décembre1973celle de l'expiraduodélaipour le

I'agent du Pakistari et au 17 mai 1974la date d'expiration du second;

Considérant que,par lettre du 14 décembre1973, reçue au Greffe le
mêmejour, I'agent du Pakistan a fait état de négociations entre son

gouvernement et le Gouvernement indien ayant abouti à la conclusion
d'un accord signéà New-Delhi le28 août 1973et, en vue de faciliter des
négociationsultérieures, apriéla Cour de rendre uneordonnanceprenant
acte du désistement deson gouvernement dans l'affaire;

Considérant que le Gouvernement pakistanais a ainsi fait connaître
par écritàla Cour qu'ilrenonce àpoursuivre la procédure;

Considérant que,bien qu'ilait adressécertaines communications à la
Cour par l'intermédiairede son ambassadeur à La Haye, le Gouverne-
ment indien n'apas encore fait acte deprocédure;

Prend acte du désistementdu Gouvernement pakistanais de l'instance
introduite par la requêteenregistréele 11 mai 1973;
Ordonne que l'araire soit rayéedu rôle.

Fait en anglais et en français, le texte anglais faisant foi, au palais de
la Paix,à La Haye, le quinze décembremil neuf cent soixante-treize, en
trois exemplaires, dont l'un restera déposéaux archives de la Cour et
dont les autres seront transmis respectivement au Gouvernement pakis-
tanais et au Gouvernement indien.
