SOUTH WEST AFRICA CASE

(ETHIOPIA v. UNION OF SOUTH AFRICA)

ORDER

The President of the InternationalCourt of Justice,

having regard to Article 48 of the Statute of the Court and to
'4rticle 37 of the Rules of Court;
Whereas, by letter dated 28 October 1960received in the Registry
on 4 November 1960, the Deputy Prime Minister and Minister for
Foreign Affairs of Ethiopia fonvarded to the Registrar a letter

transmitting on behalf of the Ethiopian Government an Application
instituting proceedings and relating to a dispute between Ethiopia
and the Union of South Africa concerning the interpretation and
application of the Mandate for South West Africa;
Whereas, in his letter, the Minister for Foreign Affairs of Ethiopia
stated that Dr. Tesfaye Gebre-Egzy and Mr. Ernest A. Gross had
been appointed Agents by his Government ;

Whereas the Application refers to Article 80, paragraphI,of the
Charter of the United Nations and founds the jurisdiction of the
Court on Article 7 of the Mandate for South West Africa made
at Geneva on 17 December 1920, and on Article37 of the Statute of
the International Court of Justice;
Whereas, on 4 November 1960, a copy of the Application was
communicated to the Chargéd'affaires a.i.of the Union of South
Africa in the Netherlands ;

Whereas, on 15 December 1960, the Chargé d'affaires a.i.of the
Union of South Africa handed over to the Registrar a letter from4 S.W. AFRICA CASE-G. L. NO.46 (ORDER 13 I 61)
the Minister of External Affairs of the Union of South Africa dated
3 December 1960 notifying the appointment of Dr. Joan Philip

Verloren van Themaat as Agent ;
Having ascertained the views of the Parties,
fixes as follows the time-limits for the filing of Pleadings:

for the Mernorial of the Ethiopian Government, 15 April 1961;
for the Counter-Mernorial of the Government of the Union of
South Africa, 15 December 1961 ;

Reserves the subsequent procedure for further decision.

Done in English and in French, the English text being author-
itative, at the Peace Palace, The Hague, this thirteenth day of
January, one thousand nine hundred and sixty-one, in three copies,
one ofwhich willbe placed in the archives ofthe Court and the others
transmitted to the Government of Ethiopia and to the Government
of the Union of South Africa, respectively.

Le Président de la Cour internationale de Justice,
vu l'article48 du Statut de la Cour et l'article 37 du Règlement

de la Cour;
Considérant que, par lettre du 28 octobre 1960 reçue au Greffe le
4 novembre 1960,le premier ~ninistreadjoint et ministre des Affaires

étrangèresd'Éthiopie a adressé ,au Greffier une lettre transmettant
au nom du Gouvernement dlEthiopie une requête introductive
d'instance relative à un différend entre 1'Ethiopie et l'Union sud-
africaine concernant l'interprétation et l'applicatiodu Mandat
pour le Sud-Ouest africain;
Considérant que, par sa lettre, le ministre des Affaires étrangères
d'Ethiopie a fait connaître que MM.Tesfaye Gebre-Egzy et Ernest
A. Gross avaient étédésignéscommeagents par son Gouvernement;

Considérant que la requête,seréférantàl'article 80, paragraph1,
de la Charte des Nations Gnies, prétend établir la compétence de
la Cour sur l'article du Mandat pour le Sud-Ouest africain établi
à Genève le 17 décembre1920 ainsi que sur l'article 37 du Statut de
la Cour internationale de Justice;
Considéra~t que, le 4 novembre 1960, copie de la requêtea été
communiquée au chargé d'affaires a. i.de l'Union sud-africaine
aux Pays-Bas ;

Considérant que, le 15 décembre 1960,le charge d'affaires a. i. de
l'Union sud-africaine a remis au Greffier une lettre du ministre des4 S.W. AFRICA CASE-G. L. NO.46 (ORDER 13 I 61)

de la Paix, à La Haye, le treize janvier mil neuf cent soixante et un,
en trois exemplaires, dont l'un restera déposéaux archives de la
Cour et dont les autres seront transmis respectivement au Gouver-
nement d'Ethiopie et au Gouvernement de l'Union sud-africaine.
