ORDER

The President of the InternatioCourt of Justice,
having regard to Article 48 of theute of the Court,

having regard to Article 37 of thees of the Court;
Having regard to therder of November z6th, 1957, in the case
concerning the Aerial Incident of July7th, 1955, between the
United States of America and Bulgaria, whereby June end, 1958,
was fixed as the time-limit for the filing of the Memorial of the
Government of the United States of America and the fixing of the
time-limit for the filing by the Respondent of its Counter-Memorial
was reserved for a subsequentder;

Having regard to the Order of January 27th, 1958, in the said
case, whereby December gth, 1958, was fixed as the time-limit for
the filing of the Counter-Memorial of the Government ofthe People's
Republic of Bulgaria and the rest of the procedure was reserved
for further decision;
Whereas, by a letter of May znd, 1958, received in the Registry
on Mav 6th, the Agent for the Government of the United States of

4America requested an extension to September znd, 1958, of the
time-limit for the filing of the Memorial of that Government;

Whereas, on May 7th, 1958, a copy of the said letter was sent to
the Agent for the Govemment of the People's Republic of Bulgaria,
who was invited tostate the views of his Government on the request
therein contained as soon as possible; and whereas the Bulgarian
Minister for Foreign Affairs was the same day notified by a tele-
gram of the request;
Whereas no reply to these communications has yet reached the
Registry ;
Whereas, however, by a letter of January 18th, 1958, which was
received in the Registry on January asnd, and upon which the

aforementioned Order of January 27th, 1958, was made, the Agent
for the Government of the People's Republic of Bulgaria, who had
been informed of the date fixed for the filing of the Memorial of
the Government of the United States of America, stated that he
considered that, in accordance with Article 37 of the Rules and in
connection with Article 62 of the Rules, the Court should fix a time-
limit for the Counter-Memorial at least equal to that fixed for the
Memorial ;
Whereas there is no objection to granting the application of the
Agent for the Govemment of the United States of America for an
extension of the time-limit, and to granting a similar extension of
the time-limit for the Counter-Memonal of the Government of the
People's Republic of Bulgaria ;

Extends as follows the time-limits fixed by the Orders made in
this case on November z6th, 1957, and January 27th, 1958:

For the Memorial of the Government of the United States of
America: September end, 1958 ;
For the Counter-Memorial of the Government of the People's
Republic of Bulgaria: June gth, 1959;
The subsequent procedure remaining reservedfor further decision.

Done in English and French, the English text being authori-
tative, at the Peace Palace, The Hague, this nineteenth day of May,
one thousand nine hundred and fifty-eight, in three copies, one of
which will be placed in the archives of the Court and the others
transmitted to the Government of the United States of America
and to the Govemment of the People's Republic of Bulgaria,
respectively .

ORDONNANCE

Le Président de la Cour internationale de Justice,

vu l'artic48du Statut de la Cour,
vu l'article du Règlement de la Cour;

Vu l'ordonnance du 26 novembre 1957 en l'affaire relative à
l'incident aériendu 27 ju1955entre les Etats-Unis d'Amérique
et la Bulgarie fixant auuin1958 la date d'expiration du délai
pour le dépôt du mémoire du Gouvernement des Etats-Unis
d'Amériqueet réservant pour une ordonnanàerendre ultérieure-
ment la fixation d'un délai pour la présentation par la Partie
défenderesse de son contre-mémoire;
Vu l'ordonnance du 27 janvi1958 en la mêmeaffaire, fixant
au gdécembre 1958 la date d'expiration du délai pour le dépôt du
contre-mémoire du Gouvernement de la République populaire de
Bulgarie et réservant la suite de la procédure;

Considérant que, par une lettre 2umai ~958, parvenue au
Greffe le mai, l'agent du Gouvernement des Etats-Unis d'Amé-America requested an extension to September znd, 1958, of the
time-limit for the filing of the Memorial of that Government;

Whereas, on May 7th, 1958, a copy of the said letter was sent to
the Agent for the Govemment of the People's Republic of Bulgaria,

le dépôt du mémoirede ce Gouvernement;

Considérant que, le 7mai 1958,copie de cette lettre a étéadressée
à l'agent du Gouvernement de la République populaire de Bulgarie
en l'invitant à faire connaître le plus tôt possible les vues de son
Gouvernement sur la demande qui y est contenue, ce dont, le même
jour, le ministre des Affaires étrangères de Bulgarie a étéavisépar
voie télégraphique;
Considérant qu'aucune réponse à ces communications n'est
jusqu'à présent parvenue au Greffe;
Considérant toutefois que par une lettre du 18 janvier 1958,
reçue au Greffe le22 janvier, et à la suite de laquelle a étérendue

l'ordonnance du 27 janvier 1958 viséeplus haut, l'agent du Gouver-
nement de la République populaire de Bulgarie, informé de la date
fixée pour la présentation du mémoire du Gouvernement des
États-unis d'Amérique, avait déclaré estimer que, conformément
aux dispositions de l'articl37 du Règlement et en connexion avec
l'article 62 du Règlement, la Cour devrait fixer pour le contre-
mémoireun délaiau moins égalà celui qui avait étéfixépour le
mémoire;
Considérant que rien ne s'oppose à donner suite à la demande de
prolongation de délai formulée par l'agent du Gouvernement des
Etats-Unis d'Amérique et à prolonger d'autant le délai pour le
contre-mémoire du Gouvernement de la République populaire de
Bulgarie ;

Reporte comme suit la date d'expiration des délaisfixéspar les
ordonnances rendues le 26 novembre 1957 et le 27 janvie1958 en
la présente affair:
Pour le mémoiredu Gouvernement des États-unis d'Amérique:
2 septembre 1958 ;
Pour le contre-mémoire du Gouvernement de la République
populaire de Bulgarie: g juin1959;
La suite de la procédurerestant réservée.

Fait en anglais et en français, le texte anglais faisant foi, au
Palais dela Paix, àLa Haye, le dix-neuf mai mil neuf cent cinquante-
huit, en trois exemplaires, dont l'un restera déposaux archivesde
la Cour et dont les autres seront transmis respectivement au
Gouvernement des États-unis d'Amérique et au Gouvernement
de la République populaire de Bulgarie.
