(PORTUGAL v. INDIA)

ORDER

The Presidcrit of the Interriational Court of Justice,

having regard to Article8of the Statute of the Court,

having regard to Article 37 of theles of Court,

Makes the following Orde:
Having regard to the Order of March 13th, 1956, whereby the
Court fixed June 15th, 1956, as the time-limit for the filing of the
Memorial of the Government of the Republic of Portugal and De-
cember 15th, 1956, as the time-limit for the filing of the Coun-

ter-Memorial of the Government of the Republic of India, and
reserved the rest of the procedure for further deci;ion
Whereas the Memorial of the Government of Portugal was filed
within the time-limit so fix;d

Whereas by a letter dated November ~oth, 1956, a certified true
copy of which was transmitted by the Registrar to the Agent for
the Government of Portugal on November ~zth, 1956,the Agent for
the Government of India, after restatins the intention of his
Government to file a Preliminary Objection to the exercise of
jurisdiction by the Court in this case, referred, among other con-siderations, to exceptional difficulties which had been encountered
by his Government in the preparation of its pleading and requested
that the time-linlit fixed by the said Order of March 13th, 1956,
be extended for an additional period of not less than six months ;
Whereas by a letter dated November 26th, 1956, the Agent for
the Government of Portugal, while maintaining that the request of

the Government of India was not sufficiently justified, and that his
Government could not agree to a postponement of the assigned
time-limit for a substantial period, stated that if nevertheless a
postponement for reasons beyond the control of the Government of
India be imperative, the Government of Portugal was prepared to
trust "the Court's discretion to make the extension as short as
required by the interest of justice";

The President of the International Court of Justice,
After conferring with the Agents of the Parties and taking into
account their respective positions,

Decides
To postpone to April 15th, 1957, the time-limit for the filing of
the Counter-Memorial or of the Preliminary Objection of the
Government of the Republic of India ;

And reserves the rest of the procedure for further decision.

tative, at the Peace Palace, The Hague, this twenty-seventh day of
iNovember,one thousand nine hundred and fifty-six, in three copies,
one of which \vil1be placed in the archives of the Court and the
others transmitted to the Government of the Republic of Portugal
and to the Government of the Republic of India, respectively.

ORDONNANCE

Le Président de la Cour internationale de Justice,

vu l'article8 du Statut de la Cour,

vu l'articl37 du Règlement de la Cour,

Rend l'ordonnancesuivante:

Vu l'ordonnance du 13 mars 1956 par laquelle la Cour a fixéau
15 juin 1956 l'expiration du délai pour le dépôt du mémoire du
Gouvernement de la République du Portugal, et au 15décembre
1956 l'expiration du délai pour le dépôt du contre-mémoire du
Gouvernement de la République de l'Inde et a réservéla suite de
la procédure;

Considérant que le mémoiredu Gouvernement du Portugal a été
déposédans le délai ainsfixé;
Considérant que par lettre du IO novembre rgj6, dont copie
certifiSe conforme a ététransmise par le Greffier à l'agent du
Gouvernement portugais le 12 novembre 1956 'agent du Gouver-
nement de l'Inde, après avoir réitérél'intention de son Gouver-
nement de déposer une exception préliminaire à l'exercice de la

compétence de la Cour en cette affaire, s'est ré,armi d'autres

Registrar.considérations, aux difficultés exceptionnelles rencontrées par son
Gouvernement dans la préparation de cette pièce de procédure et a
demandé que le délai fixépar ladite ordonnance du 13 mars 1956
soit prorogé d'une période additionnelle d'au moins six mois ;

Considérant que, par lettre datée du 26 novembre 1956, l'agent
du Gouvernement portugais, tout en maintenant que la demande
du Gouvernement de l'Inde n'était pas suffisamment justifiée et
que son Gouvernement ne pouvait donner son accord à ce que le
délaifixésoit prorogépour une périodesubstantielle, a déclaréque,
si néanmoins la prorogation pour des raisons indépendantes de la
volonté du Gouvernement de l'Inde s'imposait, le Gouvernement
du Portugal était prêt à faire confiance (à la discrétion de la Cour
pour que la prorogation soit aussi courte que le demande l'intérêt
de la justice» ;

Le Président de la Cour internationale de Justice,

Après en avoir conféréavec les agents des parties et tenant
compte de leurs positions respectives,

Décide
De proroger au 15 avril 1957 la date d'expiration du délai fixé

pour le dépôt du contre-mémoire ou de l'exception préliminaire du
Gouvernement de la République de l'Inde ;
Et réservela suite de la procédure.

Fait en anglais et en français, le texte anglais faisant foi, au
Palais de la Paix, à La Haye, le vingt-sept novembre mil neuf cent
cinquante-six, en trois exemplaires, dont l'un restera déposéaux
archives de la Cour et dont les autres seront transmis respectivement
au Gouvernement de la République du Portugal et au Gouver-
nement de la République de l'Inde.
