ORDER

The President of the International Court of Justice,

having regard to Article 48 of thetatute of the Court,

having regard to Article 69 of the Rules of Co;rt
Having regard to the Application, filed in the Registry of the
Court on August qth, 1953, by which the Government of the
French Republic instituted proceedings against the Government
of the Republic of .Lebanon concerning certain concessions for
the exploitation of public services in Lebanon, granted by the
latter Government to the "Électricité de Beyrouth" Company,

Having regard to the Order of October zoth, 1953, whereby
the Court fixed January 18th, 1954, as the time-limit for the
filing of the Memorial of the Government of the French Republic
and Aprilz8th, 1954,as the time-limit for the filing of the Counter-
Memorial of the Government of the Republic of Lebanon and
reserved the rest of the procedure for further decision,
Having regard to the Memorial filed by the Government of the
French Republic within the time-limit so fixed,
Having regard to the Order of April 8th, 1954, whereby the
President of the InternationaCourt of Justice, at the request
of the Agent of the Government ofanon, extended to July 28th,
1954, the time-limit previously fixed for the filing of the Counter-
Mcmorial of the Governmcnt of the Republic of Lebanon,

4 Whereas by a letter dated July 13th, 1954, and received in the
Registry of the Court on July 17th, 1954,the Agent of the Lebanese
Government informed the Registrat that " ...the presentation
of this pleading, as well as the continuation of the proceedings,
is now devoid of object, having regard to the settlement of the
dispute by the Parties, which has been ratified by the Lebanese
Parliament on June 3oth, 1954", and that "It was, moreover,
agreed between the Lebanese and French Governments that, as
soon as the settlement was made, the French Government would
discontinue the proceedings which it had instituted against the
Lebanese Government before the International Court of Justice",

Whereas by a letter dated July aoth, 1954, the Registrar trans-
mitted a certified true copy of the afore-mentioned letter to the
Agent of the French Government,
Whereas by a letter dated July 23rd, 1954, and received in
the Registry of the Court on July 26th, 1954, the Agent of the
Government of the French Republic, "in view of the ratification
of the Agreement of March 26th, 1954", requested the Registrar,
"in accordance with the provisions of Article 69, paragraph a,
of the Rules of Court, and in pursuance of an exchange of letters
between the President of the Republic of Lebanon and the French
Ambassador at Beirut ...to be good enough to inform the Court
that the Government of the French Republic is not going on
with the proceedings and requests that its case be removed from
the Court's List",

Whereas in these circumstances it is not necessary to fix the
time-limit provided for in Article 69, paragraph 2, of the Rules
of Court ;
Places on record the -discontinuance by the French Government
of the proceedings instituted by the Application of August 14th,
1953 ;

Orders that the case shall be removed from the List.

Done in French and English, the French text being authoritative,
this twenty-ninth day of July, one thousand nine hundred and
fifty-four, in three copies, one of which will be placed in the
archives of the Court and the others transmitted to the Govern-
ment of the French Republic and to the Government of the
Republic of Lebanon, respectively.

Le Président de la Cour internationale de Justice,

vu l'article 48 du Statut de la Cour,
vu l'article 69 du Règlement de la Cour ;

Vu la requête introductive d'instance, déposéeau Greffe le
14 août 1953, par laquelle le Gouvernement de la République
française a saisi la Cour du différend qui l'opposait au Gouverne-
ment de la République libanaise concernant diverses concessions
pour l'exploitation des services publics au Liban, octroyées par ce
dernier Gouvernement à la société «Électricité de Beyrouth »,

Vu l'ordonnance du 20 octobre 1953 par laquelle la Cour a fixé
lc 18 janvier 1954 comme date d'expiration du délai pour le dépôt
du mémoire du Gouvernement de la République française et le
28 avril 1954 comme date d'expiration du délai pour le dépôt du
contre-mémoire du Gouvernement de la République libanaise et
a réservéla suite de la procédure,
Vu le mémoire déposépar le Gouvernement de la République

française dans le délai ainsi prescrit,
Vu l'ordonnance du 8 avril 1954 par lzquelleà la demande de
l'agent du Gouvernement du Liban, le Président de'la Cour a
prorogéjusqu'au 28juillet 1954 l'expiration du délaipour le dépôt

The President of the International Court of Justice,

4 Considérant que par sa lettre du 13 juillet1954 ,eçue au Greffe
de la Cour le 17 juillet1954 'agent du Gouvernement libanais a
porté à la connaissance du Greffier que (...la présentation de
cettepic'ceainsi que la continuation de la procéduren'a plus d'objet
étant donné le règlement amiable du litige intervenu entre les

Parties et ratifiépar le Parlement libanais en date du 30 jui1954 )),
ct que (Il était, au demeurant, convenu entre le Gouvernement
libanais etle Gouvernement français que, dès que serait intervenu
ce rc'glement, le Gouvernement français se désistera de l'action
qu'il avait portée contre le Gouvernement libanais devant la Cour
internationale de Justice)),
Considérant que par lettre du 20 juillet1954 le Greffier a transmis
copie certifiée conforme de ladite lettre l'agent du Gouvernement
français,

Considérant que par lettre du 23 juillet 1954 ,eçue au Greffe
de la Cour le 26 juillet1954 l'agent du Gouvernement de la Répu-
blique française, (la ratification de l'accord du 26 mars1954 étant
intervenue »,a prié le Greffier(conformément aux dispositions de
l'article69, paragraphe 2, du Règlement et en application de
l'échange de lettres intervenu entre le Président de la République
du Liban et l'ambassadeur de France à Beyrouth ....de vouloir
bien faire connaître à la Cour que le Gouvernement de la Républi-
que française renonce à poursuivre la procédure et demande que
son action soit rayée du rôle de la Cour »,

Consid6rant que dans ces circonstances il n'y a pas lieu de fixer
le délai prévu par l'article 69,paragraphe 2, du Règlement;

Prend acte du désistement-du Gouvernement français de l'ins-

tance introduite par la requête du 14 août 1953 ;

Ordonne que l'affaire soit rayée du rôle.

Fait en français et en anglais, le texte français faisant foi, au
I'alais de la Paix, à La Haye, le vingt-neuf juillet mil neuf cent

cinquante-quatre, en trois exemplaires, dont l'un restera déposé
aux archives de la Cour et dont les autres seront transmis respecti-
vement au Gouvernement de la République française et au Gouver-
nement de la République du Liban.
